H.A. Goodman just released an interesting video this morning on the Email scandal

Interesting that the one thing she did ask about, the blackberry, she was told not to use.

Not a ton of new information, but when laid out clearly there is an obvious attempt to evade having to comply with FOIA requests at the minimum.

The reality is probably even much more insidious.

I guess the rules don't matter if you are Clinton.

The FBI CAN'T set the precedent that politicians can get away with circumventing security for convenience and get away with it just because they are powerful.

It would permanently damage their reputation, and they are one of the few branches of Law Enforcement that still has somewhat of a positive reputation to protect.

I think if TPTB try to bury this there will be more leaks coming from their agents than the floor of my 75 Nova, lol!

Their bosses may be corruptible, but there are a LOT of agents in the Feebees that hold personal integrity as priceless.

Among the few that I have known it was practically like a religion.

line officers that I have gotten to know over the years always struck me as being very upright, if also in one case fairly uptight as well, and generally "true believers" in what they do.

Granted that is a small pool and anecdotal, but I try to look for the good in most cases and would usually rather err on the side of thinking someone that was indecent decent rather than unfairly lump a decent person in with the slime...

I may be a bit foolish, but I still would rather live a life where I tend to think people are good until they prove otherwise.

The other option just seems too bleak and soul crushing...

I believe Comey has the reputation of being straight shooter. What may happen is that the FBI recommends indictments and the DOJ refuses to do so. This could lead to some very ugly public off the record data releases. IMHO, if Obama prevents the DOJ from indicting after the FBI recommends them doing so, he will have severley tarnished his record more so than before. It seems as though Obama has been trying to rehabilitate his legacy and this certainly will not help if he interferes with the process.

the FBI recommends that Hillary be charged, DOJ declines, furious FBI agent(s) leaks the file, the agent(s) is discovered and becomes the only one(s) punished for Hillary's wrongdoings?

On a side note, some are saying that FBI Director Comey will resign if the Bureau recommends that charges be brought and Lynch declines. Gawd, I hope not! He has almost 7 years left in his term. Hang in there, Director Comey. If she's elected, odds are that she'll do something to give you another chance.

from others who's opinions are better informed than my own, it seems that Comey my very well be biding his time as he is less than confident that the AG will move on a recommendation for indictment. In doing so, she may get elected and then the second best thing happens -- the R's will find cause to impeach on multiple grounds rendering her ineffective -- useless really as a sitting president -- giving them all they need to continue to obstruct.

Another scenario might be that she steps down before November. A plea agreement? Something like what was offered to BetrayUs?

If Clinton is indicted, what would happen?

Innocent until proven guilty, she would not be legally barred from running for president. Handy draws parallels with Sheldon Silver, the former speaker of the New York assembly who last month was jailed for 12 years for corruption.

“I would hope that she would step down but even given Shelly Silvers’ indictment, it took tremendous pressure to get him to step down as speaker. Even if there were an indictment, I don’t know if she would step aside. I would hope someone indicted would say, ‘For the good of the party, for the good of the nation.’ But her supporters would probably say, ‘She deserves her day in court’.”

While she would not be arrested, experts say, she would normally be expected to appear in court. The optics would be disastrous for a would be commander-in-chief but she could apply to have the charges dismissed or plead to a minor dismeanour in the hope that it would not necessarily disqualify her.

The political, media and public pressure on Clinton might be overwhelming, however, making her candidacy untenable and prompting a sensational, unprecedented and humiliating withdrawal.

Stewart says: “I don’t know how you couldn’t pull out, especially for something like this involving national security.”

Cox adds: “If charges came down before the convention, it would raise questions over whether the Democratic party really wanted to proceed with a nominee facing criminal charges but, again, I think it is very unlikely that is going to happen.”

But what if she is forced to pull out?

The Democratic party’s charter and bylaws state that responsibility for finding a replacement nominee would fall to the Democratic National Committee, but the rules do not specify exactly how this would be done.

Sanders would presumably claim that he should inherit the mantle of nominee after pushing Clinton close in the primaries and earning the right to face Donald Trump. Indeed, it has been speculated that the Vermont senator has clung on so long in case the FBI investigation proves a cataclysmic event for the former first lady and a gamechanger for him.

Hard to live with uncertainty, but we've got to for another month I think.

He makes some very good points, and if we were living in the US before Bush v Gore, Ed Snowden and this ripped off Democratic primary, I might believe him on the precedents at risk of being set without indictment, but after that SCOTUS decision and it's blatant rigging of an election, I'm not sure I have that much faith anymore in our captured government. The NSA is still in business, exposure aside, and we all can see just what happened to our primary.

Pretty damning for four years of Pagliano's emails to just not exist too. It's all there, right out in the open now, and I still think it won't happen before the Primary. As for Obama's legacy, I think what must be on that damned server probably "indicts" him too, and he will bend over backwards to prevent that from coming out. No, I think they push this off until after the Election, and once she's safely ensconced. But it won't go away forever, so then we can look forward to Impeachment hearings and all the hype, blather and outrage those will bring on. Plus, it will completely obstruct ANY meaningful action out of an already worthless Congress, keeping the neo-liberal order alive and well fed. She'll get her wars started though, they'll all be down for those.

Just my two cents, cynical and depressing as it is. I don't mean to be a downer, but I can't be that hopeful anymore.
