Oklahoma cops are now just highwaymen

Civil asset forfeiture has long been a civil rights nightmare that should have been banished to the 9th circle of Hell, but Oklahoma has decided to do the opposite. They've put civil asset forfeiture on steroids.

Now, the Oklahoma Highway Patrol has a device that also allows them to seize money in your bank account or on prepaid cards.
It's called an ERAD, or Electronic Recovery and Access to Data machine, and state police began using 16 of them last month.
Here's how it works. If a trooper suspects you may have money tied to some type of crime, the highway patrol can scan any cards you have and seize the money.
"We're gonna look for different factors in the way that you're acting,” Oklahoma Highway Patrol Lt. John Vincent said. “We're gonna look for if there's a difference in your story. If there's someway that we can prove that you're falsifying information to us about your business."
Troopers insist this isn't just about seizing cash.

Sure. Right. It's not about seizing cash. I believe that (big eye roll).
All the policeman has to do is "believe" that you lied and then he can take everything and ruin your life. You better hope he's not having a bad day.

"If you can prove can prove that you have a legitimate reason to have that money it will be given back to you. And we've done that in the past," Vincent said about any money seized....
News 9 obtained a copy of the contract with the state.
It shows the state is paying ERAD Group Inc., $5,000 for the software and scanners, then 7.7 percent of all the cash the highway patrol seizes.

Oh goody. Private enterprise teaming up with the police to steal everything from you without due process.
I believe that this is the proper response.

The one state that has gone complete anti-democratic is Oklahoma. It is wise not to travel in that state at all. Oklahoma should be on a no-fly zone. Now, Oklahoma police can outright seize everything you have from debit cards to bank accounts on a traffic stop without any criminal charges being filed. If some policeman thinks you’re doing something illegal, your life is over. Without money, you cannot hire a lawyer and they can just rob everything you have on a whim....
Just stay out of Oklahoma at all costs. If other states follow, you better migrate to another country and fast. Look for a country not based on common law (English countries). This will destroy the freedom to travel for broke police have become highway criminals with guns.

Make that highway criminals with guns AND a badge.

Notice how the private company gets 7.7 percent of the proceeds. Where is that even reasonable when the cop is writing a ticket for something - how does he 'prove' anything.

If they lock people out of their own accounts based on the suspicion of a cop on the highway, what new levels of desperation will people be encouraged to take?

Some of the most dangerous people are those who have nothing left to lose, and our single party system is working both sides of the coin in hurting as many people in this country as they can.

Hell, the Clinton Party are the ConservaDems - the moderate Republican pro business party of 25 to 30 years ago.

Maybe their next trick will be shipping out a few million more jobs, watching people fall off the unemployment registers and congratulating themselves for having an even lower unemployment rate.

          Civil asset forfeiture has been around for a very long time, but it really got going in the 1980s with the newly declared civil war on anyone even tenuously connected to a demographic suspected even marginally of being near a non-approved drug.
          So, now I have one more reason to avoid approaching Oklahoma.

A group I am a speaker for has been bringing up asset forfeiture since we formed. (Law Enforcement against Prohibition.)

Check out this video if/when you have time, If you are at all on the fence on ending prohibition these arguments may just swing you over. (Granted the production values are not great, but the message is one that I think resonates.)

I am amazed at how many people come around to supporting this position when I give these talks at local rotary's, universities and such.

The most common comment I get basically boils down to, "an hour ago I would have said you were crazy for what you are proposing, but now I think you may be right!"

The second most common, "You are a lunatic out to kill our grandkids!" (That one isn't a paraphrase but the actual statement some lady screamed in my face, lol!)

There isn't much grey area there as far as responses go. Wink

The Drug War is a nightmare.

And I still can't quite wrap my head around how any country or any person can tell me what I can or can't ingest in my own body.

Want to make trading in those substances illegal? Ok, I guess. (Not really, but you could make a case for it)

What makes no sense is making it illegal for me to eat a mushroom growing in the earth or ingest a plant growing on the side of the road. It might be the most absurd thing humans have ever attempted to do.

The attack on natural psychedelics is the most ridiculous. They have been used across the entire span of human history in sacred rituals and religious experiences. Studies have shown they cause positive outcomes for depression and anxiety. They are not addictive, and they tend to have a positive effect on one's mental health, worldview and to open one up to larger ideas (specifically the naturally-occuring ones, and like everything, in moderation). Which is the ONLY reason they are outlawed. No one is to be allowed to even peek outside the prison walls. Sorry for the rant, I feel strongly about this.

I too am very passionate about this subject.

Joe Rogan has several podcasts on the various psychedelics and their religious, physical and mental significance and has had some incredibly good guests on it that are extremely knowledgeable on this subject.

I recommend you check them out if you like podcasts, He is always pretty good, but there are so many episodes now that it may be best to just listen to those that have guests or subjects that you like. The amount of detail you get from people in his 2+hour long non-structured interview style is amazing, and sometimes it's on stuff completely unrelated to their main subject that you usually hear from them about.

Cops don't work for the citizens, they never have. They work for the system. If the system is corrupt, so are their enforcers. That old motto of "Protect and Serve" doesn't indicate who they're protecting and serving.

I certainly never feel safe when a cop is around, and I'm a middle class white guy. I can only imagine the fear felt by those who don't share my race, gender, or income level.

Sometimes titles dictate behavior, if for no other reason than the mindset of the person that would be drawn to "Enforcing" rather than just keeping the peace.

Last year[2014], according to the Institute for Justice, the Treasury and Justice departments deposited more than $5 billion into their respective asset forfeiture funds. That same year, the FBI reports that burglary losses topped out at $3.5 billion.

And that's just the feds - this doesn't even include the states.

I remember shortly after the law was enacted that a cruise ship and an Eastern Airlines (Remember them? You're OLD!) plane were confiscated due to employee smuggling. I'm SURE you'd be amazed to learn that the law was modified to exempt any corporation from such seizures unless and until legal prosecution was completed and the corporate owner found guilty.
