What Constitution?

Open Thread Image.jpg

Do schools even teach civics anymore? It seems no one read the Constitution, including our Attorney General. Free speech for accepted thoughts, but not for wrong thought. Get ready for the new "Censorship Industrial Complex". De-platform any media which doesn't ban the people we tell them, or provides imagery of the genocide which we deny. Conduct illegal acts of war with no oversight. Declare elected leaders in other countries illegitimate. Impose tariffs without congressional approval. Then there's constant surveillance and monitoring of social media. Not to mention the majority of elected leaders more loyal to Israel than the US. Someone needs to start a Constitution Party to get the US back on track...yeah, and unicorns and rainbows too. Orwell was a prophet.

Either you believe in free speech, or you don't!

(86 sec)

First Amendment
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

This is a dangerous.

Attorney General Pam Bondi appeared on the podcast hosted by Miller’s wife, Katie Miller, and vowed that the Justice Department would “go after” people who engage in “hate speech” against conservatives.
“There’s free speech and then there’s hate speech, and there is no place, especially now, especially after what happened to Charlie, in our society,” Bondi said. “We will absolutely target you, go after you, if you are targeting anyone with hate speech.”
While many prominent conservatives denounced Bondi’s remarks and reiterated that hate speech is protected by the First Amendment of the United States Constitution, Trump himself appeared to give her views his endorsement.
When asked by ABC News reporter Jonathan Karl about Bondi’s comments on Tuesday, the president signaled that he would favor prosecuting journalists on “hate speech” charges.
“We’ll probably go after people like you because you treat me so unfairly,” Trump said in response to Karl’s question. “You have a lot of hate in your heart.”

You gotta be kidding. So called "Hate Speech" is protected speech. The AG doesn't understand the basics of the Constitution.

The Judge was interviewed by Trump in his first term for the Supreme Court. He asked Napolitano, "What is your legal philosophy?".
The Judge asked him, "Have you read the Constitution?."
"No, I don't read books."
The Judge replied, "It is just a few pages"
Trump, "I have people to do that for me."

That story speaks volumes.

One trick they use is to control media platforms.
Israel Takes Over TikTok!

(15 min)
Guest host James Li and Jimmy discuss reports that TikTok is in final talks to be bought by Oracle, Silver Lake, and Andreessen Horowitz, linking the deal to efforts by Zionist billionaires and former IDF officials to control online narratives about Israel. They highlight how TikTok has introduced a new “M2” algorithm designed to suppress pro-Palestine voices, retroactively punish past content, and throttle dissenting creators.
Jimmy argues that this form of censorship, framed as combating “anti-Semitism,” is really about silencing criticism of Israel and controlling what young people see online. He compares the U.S. to China by pointing out the irony of Americans getting mass surveillance and censorship—but without the benefits of functioning infrastructure or social programs.

and one more from Jimmy...
What Everyone Missed About ABC Cancelling Jimmy Kimmel! (17 min)
Jimmy Kimmel’s late night talk show has been suspended after the host joked about Charlie Kirk’s killer, sparking FCC criticism and ABC’s abrupt decision to pull the show.
Guest host James Li and Jimmy discuss how the controversy highlights hypocrisy: Kimmel wasn’t punished for past remarks about the unvaccinated but is now targeted over politically charged comments. They note the absurdity of the FCC floating “remedies” against a comedian while mainstream media outlets routinely spread misinformation without consequence. Ultimately, Jimmy frames the episode as corporate-driven censorship, fueled by ratings decline and political weaponization, while pointing out how both parties exploit “free speech” arguments only when convenient.

‘Show Me Your Papers!’
Last week, in an unsigned order issued without an explanation, and in direct defiance of the plain language of the Fourth Amendment to the Constitution, the Supreme Court of the United States permitted federal police to stop persons in public and demand to see proof of lawful presence here — and in the absence of that proof, to arrest them.

Charlie Kirk Shooting, Ukraine Russia War Update /Lt Col Daniel Davis & Larry Johnson

(58 min) The discussion centers on the shooting of Charlie Kirk. Larry Johnson, a weapons instructor, argues against rumors of a “palm gun,” insisting video evidence shows Kirk was hit by a supersonic, high-caliber rifle round, not a small concealed weapon. Frame-by-frame analysis of the footage reveals the shockwave effect, Kirk’s shirt movement, head motion, and neurological stiffening consistent with a neck shot from the front. Johnson stresses this rules out alternative theories of the shot’s direction.
Speculation exists about why false narratives are spreading—possibly to muddy the truth. Broader conspiracy angles have surfaced, including alleged Israeli pressure on Kirk, Mossad involvement, and family ties of shooter Tyler Robinson to Ukraine’s Azov Battalion. Still, forensic evidence (DNA, rifle, texts) firmly ties Robinson to the attack.
Questions remain about Robinson’s sudden radicalization—how he went from no record to assassination in a week. Johnson suggests he may have been incited or influenced by outside actors. Both commentators note that while Kirk was uncompromising in his beliefs, he was respectful in debate, and claims of him being hateful are exaggerated.

USA Dumping Ukraine War & Rogue State Politics | Amb. Chas Freeman

(45 min) The West champions a 'rules-based order' while supporting a genocide in Gaza and fueling a proxy war in Ukraine. Has this hypocrisy shattered its global moral standing for good? And are rising powers actually trying to restore the international law the West has abandoned?
To discuss this and more, today I’m talking again to Ambassador Chas Freeman, a former US diplomat, and Assistant Secretary of Defense.
We explore the alarming rebranding of the US Department of Defense to the "Department of War" and its historical roots in the Monroe Doctrine. We also break down the escalating tensions with Venezuela, the moral bankruptcy of Western policy on Israel-Palestine, and why Ambassador Freeman calls Europe's approach to Ukraine the "coalition of the deluded." Finally, we discuss the collapse of US diplomacy and the rise of a 'Global Majority' seeking to conserve the very international order the West now undermines.

Prof. Jeffrey Sachs : Definitely Genocide.

At 12 min they discuss the Constitution and the Judicial branch.

Taking the Constitution Seriously

Last week, the President of the United States did not take the Constitution seriously. He ordered the murders of 11 people who were riding in a speedboat in the Caribbean Sea around 1,300 miles from the U.S.
Afterward he said he did so because he believed that they were members of a “narco-terrorist gang” and were delivering illegal drugs to America. He also did so, he said, as a “message” to other drug dealers who should fear a similar fate.
The boat had no ability to reach the U.S. According to the former head of drug interdiction for the Department of Justice, this so-called boat gang is not known for trafficking in illegal drugs. The crimes that the president said these folks committed did not occur in the U.S., and if they had, do not permit the imposition of the death penalty.
He offered no evidence to support his claims and didn’t even suggest that the riders in the boat posed a threat to the American military personnel who killed them. He couldn’t say if anyone in the boat was an American.
When he was asked for the legal authority for these killings, President Donald Trump replied that these folks were waging war on the U.S., and, because he is the president of the United States, he can do as he wishes to them.
These are constitutionally ignorant, morally repugnant, profoundly erroneous responses from a person who has taken an oath to uphold the Constitution.

Don't forget in his first term Trump recognized his selected puppet, Juan Guaido, as Venezuela's President and called on all our minions to do the same. The UK used it as an excuse to steal all Venezuela's gold stores in London. Here in the US we stole their Company CITCO and it's associated refineries. We want their oil...BAD.

Declaring War
The Constitution’s Article I, Section 8 specifically lists as a power of Congress the power “to declare War,” which unquestionably gives the legislature the power to initiate hostilities. The extent to which this clause limits the President’s ability to use military force without Congress’s affirmative approval remains highly contested.
Most people agree, at minimum, that the Declare War Clause grants Congress an exclusive power. That is, Presidents cannot, on their own authority, declare war.

After 9/11, Congress gave the President the ability to start wars whenever and where ever they want. The same is true about Tariffs.
The Constitution actually grants Congress the power to levy tariffs, but in recent years as a result of certain laws Congress has passed, the president and the executive branch have controlled when and how tariffs are placed on goods entering the United States.
The Constitution’s Article I, Section 8 states: “The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, … but all Duties, Imposts and Excises shall be uniform throughout the United States.”
Over time, as Congress gave the president expanded powers on its behalf to enact tariff policies, opponents to several tariffs laws argued the statutes were an unconstitutional congressional delegation of authority to the president.

It seems Trump has become a law unto himself.
"I have the right to do anything I wanna do. I’m the President of the United States."
Reminds me of Nixon.

If anything Europe is worse. They are ruled by unelected bureaucrats.

So what good is the US Constitution if it isn't read, and politicians have been bribed to ignore it? Perhaps some parts are out modded, but all in all it would be a good start toward reform in the US. Unfortunately the web of deceit and corruption envelops the US government, and prevents fair treatment of our citizens and other countries. At least for the time being we can still complain.

I hope you all have a wonderful Sunday. The thread is open to any and all ideas, insights, and commentary.

Colonel: New Wars Will End The US Empire | Lawrence Wilkerson

(38 min) Donald Trump ran on ending "stupid wars," but his administration is now seen as the most chaotic and war-prone in modern history. Is this incompetence pushing the American empire over the edge, and is a catastrophic conflict with Iran the inevitable result?
To discuss this and more, today I’m talking again to Colonel Lawrence Wilkerson, a retired US army officer, former Chief of Staff of the Secretary of State, and a member of the activist group “Veteran Intelligence Professionals for Sanity.”
We explore his stark assessment of the "unbelievable incompetence" and lack of coordinated policy in the White House, and why Trump, despite his rhetoric, "relishes killing people" through proxies. Col. Wilkerson also breaks down the historical decline of the American empire, the unstoppable shift of power back to the East, and how Israel could drag the US into a disastrous, decade-long war with Iran before Thanksgiving.

used to the speed of things and I think would have a difficult time settling into a much slower routine which we should have.

Thanks for focusing on first amendment issues. Any of us could fall on the wrong side of a label and therefore into cancellation of some kind. This is a truly frightening prospect.

Alex Krainer was interviewed by Ivor Cummins, an Irishman. They talk about the evolution of moneylenders and how we got where we seem to be today. I think it is a worthwhile capitulation of what brought us here. The surprise was the reference to Jesus Christ and the moneylenders in the temple. The explanation of how Rome treated its vassel states may sound familiar to the IMF.

In the fervor of "me too" death penalty statements, I am stating for the record I'm against the death penalty for anything. I know we have Charles Manson still in custody, so it's entirely possible to keep the worst societal offenders in jail forever. Oh I read somewhere that he may have been MKUltra. Sigh.

We are getting two inches of rain this day with a high of 13° C after 31°C yesterday. I have whiplash. It does look like our week of fall just jumped into winter. Looking at three gorgeous Potiron, or peach blush large pumpkins. Trying to figure out when to pick them. They are volunteers from the compost bin.

I got my sweet corn in a month too late. But I've checked a cob with nicely developed silks and all kernals were developing. I'm inclined to leave the rest for as long as I think I can in hopes they will embiggen. We are so looking forward to eating fresh corn.

In another bed I have some 'Little Gem' Popcorn/Indian corn. Long growth time to tassle but now they are developing fast. I hope we get a few as they are so so pretty. Can be eaten, ground into flour or dried for popcorn.

We have our Jøtul going for the office and floor tiles. Checking the pellet stove for working parts and hopefully the last battle of condensation in the inner flue. We've learned a lot about stoves especially one made in Slovenia. We got it mail order. The stove works quite well. We married it to our floor tile heated water system. That works well. The vertical flue has been a condensate generator of impressive volumes. We put a small diameter pipe inside our old 50mm stove pipe and slowed down the rate. Now we're putting in a capture bucket/sink right where the flue moves from horizontal to vertical. It's a two story rise plus clear the tile roof. Long haul for low temp exhaust. We shall see.

Have a good week.

It is always nice to hear from you. I often think of you when hearing all the shit going down in France. Nice to hear your homestead is doing well as we head into winter. I'm dusting with BT to control looper damage.

Fall color change is around the corner here. We're getting our firewood accumulated for the winter campfires. The wild flowers are outstanding now. I'll try to post some photos next week.

@Dawn's Meta for attending law school was to be that lawyer that found the magical legal argument to end the death penalty in this country. Of course, in my private practice, I had no choice but to expand to other areas of law to make a living.
We have a very long and sordid history of killing the wrong convict. Many perfectly innocent men and women have been killed in a death chamber. An imperfect legal system has no right to end a case with such irreversible finality.
For now, I am self-censoring in order to remain trouble free. I have to put my focus on taking care of my husband, which is impossible from a jail cell.
Stay safe!

As the sun was shining, and I was strolling
And the wheat fields waving and the dust clouds rolling
A voice come chanting as the fog was lifting
This land was made for you and me

Sung by the King...

"America the Beautiful" is an American patriotic song. The lyrics were written by Katharine Lee Bates and the music composed by church organist and choirmaster Samuel A. Ward. Bates originally wrote the words as a poem, Pikes Peak, first published in the Fourth of July edition of the church periodical The Congregationalist in 1895. At that time, the poem was titled America for publication. Ward had originally written the music, Materna, for the 17th century hymn O Mother dear, Jerusalem in 1882. Ward's music combined with the Bates poem was first published in 1910 and titled America the Beautiful.
The song is one of the most beloved and popular of the many American patriotic songs. From time to time it has been proposed as a replacement for The Star-Spangled Banner as the National Anthem.

Thanks for the musical interlude! Hope all is well with you across the pond.

I'm not sure anybody truly believes in complete freedom of speech, it's really a question of how many exceptions one accepts or declares. Consider snuff films using kidnapped enslaved children, or the like. Similarly, very few truly oppose all hate speech, it is, again, the number, variety and type of exceptions that they admit or accept. And, of course, those who do both constitute an impossible set.. I keep pondering writing something on the topic but can't figure out how to keep it to a reasonable length without trivializing the subject. Nonetheless, I'll just toss out this thought.

There is a word, or cluster of them which has been used to demonize, mark for torture or death or mark for sufficiently total ostracism that death will have to slowly follow. Over the ages these hate words have been responsible for innumerable deaths and unmentionable horrors, yet they are very common and very widely and frequently used. These words are socialkly acceptable without asterisks or disguised and are the family of words which includes, "sinner", "heathen", "heretic", "witch", "wizard", "unbeliever", "apostate" and the like. They are not, regardless of being obviously divisive and hate based because they are purported;y divinely inspired. Let's abandom them first, and then worry about all the rest.

is a suspicion of fire, evidence of fire, etc, then it is arguably ok. Also if it is done by an actor as part of a stage play. It comes from a court decision widely considered to say it is illegal, but the court did not go that far, but merely said that there should be no presumption that such an utterance was protected.

Being a weapons expert doesn't mean Larry Johnson knows what he is talking about. There are many videos of how even a 50 caliber round does not cause enough disturbance to lift a t-shirt.

Regardless of the path in life I chose, I realize it's always forward, never straight.

A cut from my friend and neighbor...

Norman plays it a bit faster than I like. Why? Cause he can. A great tune none the less.

....has ever ratified the US Constitution.

The USians follow Dead People's obsolete rules for running the government, rules written when a horse was the fastest thing on the planet.

The is a fail, according to Thomas Jefferson, because if new generations of people do not formally consent (or ratify or clarify) the out of date rules written long ago by Dead People —rules that the government is supposed to follow (constitution definition) — then the People have waived their Generational Sovereignty and abandoned their duty. The Government is therefore free to alter the rules as they see fit and redefine the the original purpose of government: People form governments to benefit, insure, underwrite, protect, and improve the quality and caliber of all citizens of the United States.

USians have zero understanding of how modern constitutions are written — but every other country in the world, except the United States, is either working on constitutional revisions — or preparing to do so — without fear or confusion. This is how the US became a failed state so rapidly.

I haven't fully trusted them since they joined the dogpiling on trans teen athletes.
Screaming bloody murder about a trans girl softball pitcher on what on the face of it was a surprisingly strong team - pitchers can't do it all, they need good fielders behind them. Not that that matters to gender essentialist fanatics....

There is no justice. There can be no peace.

So far I have learned that the Israelis are counting on white Christian young men being the shock troops and cannon fodder for their planned war with Iran. No wander Mr. Kirk was beginning to question his allegiances. I also learned his student audiences had begun challenging him about Israel.

Woke up with a sore throat, so today can be a lazy video watching day. Which one is the Corbet video?

Chas Freeman is new to me. I liked the way he puts current events in some historical context. I do tend to doubt that Pres. Maduro is A Bad Guy. I would like to see some independent evidence on that point.

Zionism is a social disease

I think the Judge Napolitano pointed it out, that Israel has free healthcare and higher education for all its' citizens. No wonder the Israelis don't want Palestinians to become citizens.

I don't seem to be able to cancel the extra one. I also found out that the Israelis think they can do anything they want, regardless of law, custom or basic decency, because they "have Trump."
