Saturday Open Thread - 6/1/24: Odds and Ends

Good morning, friends!

Hope everyone has a great weekend in store.

Here, we have to dodge rain. High winds. Trees laying across highways. I am sick of it. So dangerous.

As I write this, there is a baby rabbit in the yard. My memorable pet as a 3 yr old was a white rabbit.

Thursday was a bench trial that lasted almost 8 hours. I won, but it took a toll. I was so damn worn out!

It involved parental abuse.

Gonna head to a zydeco concert in a week, am on the countdown to see the dancers on the floor, kids (alongside me) tossing French fries to the gators, and it is past time to get away, to go somewhere and do something!

Still writing, baby rabbit is still in the yard. I am pretty certain they live under the house.

What else might sometimes live under the house? A feral cat! Or prostitute? You decide!

Dear One suggested I explain the "under the house thingie".

Where I live, the water table is very close to the top soil. People can simply pound a pipe into the ground 6 feet, or less, and water can be pumped.

We do not have basements, and home foundations do not remotely resemble what other parts of the country look like. This means we commonly get cats, dogs, armadillos, rabbits, rats, snakes, and scorpions under our homes set up on blocks, etc... possibly prostitutes?

I am on a personal campaign to find all kinds of products I regularly consume at a cheaper price. This is in anticipation of my retirement one day. It is actually interesting. Anyone else doing that?

I might be spoiled now, but need to grow up. (Old, but still wonder what I will be when I grow up.)

FWIW, some photos posted above are from a museum that featured whatever was found that might be of some historic interest to someone somewhere, as the country has no historic foundation, and until fairly recently, no interest in preserving anything. Some fortress stuff that had no value, fine. Some robes worn by priests, fine. But anything of value, sold on the street long ago.
There might come a day when we do not give a shit about our history, and just might, in fact, be very ashamed of it.
Until then, I suggest we rock on.

We have a wet weekend in store. Light rain through Wed. predicted. We've not been inundated like y'all so the garden will appreciate it.

Managed to get most of my mowing done this week. I leave the big field in the bottom unmowed till after the 1st frost to promote fall wildflowers.

As to the news, Biden has suggested a three part plan for a Gaza ceasefire. I'll be surprised if the Zionists go for it, but we'll see.

Trump's lawfare battle has resulted in conviction which I suspect will be over turned due to the blatant bias of the court, but that also remains to be seen.

@Lookout Mowing is a chore, and yet, farmers and ranchers seem to get into that tractor seat, turn the key, go off to their up and down, round and round, mowing hour after hour as though time magically stopped for them. I see them almost glowing with their satisfaction, seeing the beauty of the tended fields when they are done.
Rain has stopped outdoor work in its' tracks for a month. People who make their living mowing, clearing trees and fence lines, landscaping, and the like, have lost their income stream this spring. The rest of us have to plan trips to shop, see a doctor, attend meetings, with strategy.
The Trump case exemplifies forum shopping, judicial misconduct, prosecutorial misconduct, ignoring statutes of limitations, and creating a jury charge out a hat. But looking at it from a historical prospective, this is what we have seen in other countries, particularly third world countries, as accomplishing a coup. When looking forward, with this precedent established, a political party or faction can bring charges against an opponent with relative ease.
This is a historic blunder that will be the forever trend.
Today is a sunny day, then heavy thundershowers hit us this afternoon and tonight. More or less the same for tomorrow. We will be staying indoors this weekend, listening to music. Sounds great to me!

Third show I have managed to see, if it all works out.
Should be the fourth, because I had front row center at Carnegie Hall for a Pirates concert that was ON MY BIRTHDAY, but canceled. A few similar event failures in that town for me, but that one stung like a mother.
Had some mind blowing experiences there as well.
All in all, I will find something else to complain about.
She is awesome incarnate.
Now I know how Chuck E showed them how.
Tom Waits owes a great deal it appears.
I always considered him derivative while others were agape at his innovation.
Now I realize he was mostly an actor doing a good impersonation.
Firewalker is from Ghostyhead 1997. there were no clean clips of it on youtube for a long time. Finally grabbed a copy of the album rather than sorting through the delicious anthology I have to hear it. Quite a lovely work.

Not sure we will get to the store today due to the forecast. I do not want to dodge lightning bolts getting to the car.
I haven't been able to find any info on the two strange bolts of lightening I saw Thursday evening. They were close by, one to the east, the other to the west. After they hit the ground, they turned into a string of yellow lights, then disappeared. One way to describe it would be to compare it to a string of Christmas lights following the same trajectory as the bolt.
I can say it was not red sprites. The color of the lights was the same color as the bolt.
First time in my life I have seen this.

The first bolt barely caught my eye, then I saw the lights. At first, I figured my view might have been blocked by a tree, but then, the second one was in a clear spot.
I couldn't believe my eyes! It was extremely strange!
Surely I am not the only person here that has seen this phenomenon?
Anyway, I am beginning to see and experience weird skies, weird weather constantly.
A gust of wind broke a tree in my yard. Another broke a huge limb that is resting in part on the roof of my office.
This is not normal and customary.

...which resulted in his recent conviction on 34 counts of falsifying business records, etc. Frankly, I haven't paid attention. As I am from the NYC greater metropolitan area originally, I've been sick of Trump for decades, and just tune him out, and any media coverage of him. I think the last time, I actually listened to anything about Trump till today, was the Rosie O'Donnell bruhaha because I thought it was hilarious.

In any case, his recent conviction and the associated noise, caused me to try to seek some authoritative accounts like transcripts, actual records of proceedings, briefs laying out the injustice of the trial, etc. The only thing I could really find were the indictment, and the associated statement of facts. As I understand the violations, there is the instant crime specified in each count the falsification of the business records themselves, and then the intent to further or aid and abet or conceal the commission of another crime. Based upon this limited exposure to actual records in the case file, the lack of a transript or record, the only deficiency I detect is in the indictment, in terms of defining the elements of what I'll call the crime which was the object of the business falsification specified in the indictment, and not really clarified in the statement of facts. That appears to be a defect in the indictment, imo, maybe it has been cured in some way in the course of the proceedings, but I can't seem to find any evidence of that one way or the other.

Does anyone know where any authoritative records or transcripts can be found? In the alternative, does anyone know of any legal expert, who has publicly laid out the legal argument or arguments, that are the contended foundation(s) for a successful appeal? That would be secondary, but might be helpful in terms of evaluating the fairness of the case.

Most of the stuff I've seen on this case are he said, she said bs.

He talks about the alien and seduction act and the espionage act to stifle decent. Says Biden is the most anti free speech president since John Adams.

He also says that the judge was appointed and not randomly selected.

I don’t like Trump and I think a better case to bring against him would have been for killing the 8 year old American girl in Yemen without due process. But then Obama would need to be charged for killing her father and brother without due process too.

The silliest thing about this is that an American president was actually held accountable for crimes, but not for the crimes that were more heinous. Banana Republic indeed. The world is laughing at Biden because all 4 cases against Trump originated in the White House.

@snoopydawg when I got the news of his guilty verdict, and had this flash that I would damn sure vote for Trump to stick a finger in the eye of the crooked Democratic party.
Think of what Trump now has in common with blacks who have been statistically way more targeted by Biden's 3 strike rule, and his infamous Crime Bill. They are now all brothers.

Seems the starting place for the appellate brief would be the statute of limitation having run on the 34 misdemeanors.
Another thing I can't ascertain is if the judge or jury will do the sentencing.
Snoopy has suggested Jonathan Turley as a good analyst.
Why aren't the Clinton's and the entire Biden family packing up and heading for a foreign country with no extradition treaty with the US? They must realize they are in the docks.

According to one prosecutor I found who's been commenting on the case frequently. As, charged, it was 34 counts of a Class E felony under NY State penal code 175.10. This prosecutor I've been listening to this am says he can get up to 20years total, but doesn't think he'll be confined, opined he might get a suspended sentence, with probation, etc.

I regard the counts as multiplicious in nature, although I'm guessing technically they aren't because each one, seems to have one different factual element. I've been watching this channel today only with a former 30 year prosecutor, who takes a jaundiced view of Trump and his defense team. He seems to think appeals will not be successful, unless the US Supreme Court takes the case on cert.

I will look for Turley. I actually am interested to hear some colorable appellate arguments.

n one example that Turley gave of this, prosecutor Joshua Steinglass said during his closing argument, "the Election Law Violations to which [Michael] Cohen pled guilty were committed at the Defendant's [Trump's] direction and for his benefit."

Cohen was Trump's lawyer at the time of the hush money scheme. He served prison time after pleading guilty to eight criminal counts, including campaign finance violations related to the scheme.

Even though, "Merchan had repeatedly said that Cohen's earlier plea could not be used to imply Trump's guilt," the judge overruled an objection to Steinglass' statement from Trump's lawyers, Turley pointed out.

At the outset of the article he mentioned the political nature of the prosecution. Okay, I watched the Turley short post mortem on Fox. He brings up what I said above about the indictment, namely, "what is the secondary crime?" The jury form allowed three different theories whether federal election law, campaign violations... I don't know the third. So what was he charged with? The indictment was insufficient on its face. What was he found guilty of? Not sure.

@soryang I suppose if you or I wrote 34 hot checks, we would face 34 counts, so I am not as focused on that as I am the goofball indictment, and the statute of limitations.
I had not heard if the jury had been excused, or if they would hear the sentencing portions of the trial. In Texas, the jury can be chosen to do the sentencing. Judges are the default for sentencing.
A jury sentence is easier to raise on appeal as being defective, but a judge is always presumed to have discretion. It is always a gamble.
I will check your sources in a couple of hours after I go grocery shopping.

@soryang @soryang Mom won custody, but the judge gave Dad a restricted, unsupervised visitation with the kids he loves to beat.
I had kept them away from him for 6 months. This judge gave an order for him to take them immediately after court for a 2 hour visit to a restaurant with his Mom, who had driven in from Arkansas to testify how the kids needed to be with their Dad, the Best Father In the World.
The Perfect Dad had been arrested 3 times for assault on the children's Mom, a neighbor, and stranger. Unfortunately, the investigating police officer on the 2 felony assaults was himself arrested for some felony, could not testify against Dad. Cases had to be dropped. That made my case for Violent Dad impossible to prove.
So, Dad and his parents went to eat at a local restaurant with the kids he hadn't laid eyes on in 6 months, and what did he do? He started an argument with his 14 yr old daughter, had to be held back from hitting her by strangers, and Grandma! When he took them home to my client, kid's Mom, he started an argument with her bf, cops had to be called to escort him from the property. THEN, a couple of hours later, the Best Father in the World got into a fight with somebody, and at midnight, was arrested with criminal mischief and 2 counts of felony assault!
As soon as I can find a witness to the restaurant near-fight, I will file for a partial re-hearing.
I want an armed cop with him at any time he is with his children. If he gets a chance, he just might beat his daughter to death.
That should explain why this trial completely wore me out, and I got the info about the arrest today, which explains why I work all the day, day in, day out.

I find the adoption of the theory that giving weapons to Ukraine makes them Ukrainian weapons. Blame Ukraine, Russia! Forget that the sophisticated weapons require military personnel from the country of origin to be fired. Forget that all countries supplying the weapons are not in military conflict, but all are supplying the weapons to Ukraine, who is, indeed, in a war with Russia.
Which country will Russia fire on first? My bet is the good ol' USA.

@usefewersyllables I developed an attitude at a young age, 15, to be exact. From then until I was 30 years old, I fought through a liver disease from which nobody expected me to survive from one day to the next. I started my mental process of reading everything I could get my hands on so I would not die uneducated and ignorant. Then, taking some philosophy courses in college, I took a deep dive into Jean-Paul Sartre and Existentialism.
Seems I was already living in the frame of mind, accepting the inevitably of death, living my limited life to my fullest personal capability, as he described as the philosophy best suited to the acceptance of the inevitable. In other words, I was an Existentialist before I knew it was a "thing".
My reaction to the nuke bomb videos I saw in elementary school gave me the same reaction about dropping one directly on my head is much like yours.
Our difference is I never gave the inevitable another fucking thought. Maybe I was an existentialist from age 7, not at age 15, when I was given no more than 6 months to live.

Living in Central Texas, do understand under the house. After our winter of severe freezes and the grid broke down, I had to have my pipes replaced all over the house. No more using PVC, the company used the blue and red tubing which is supposed to work better. Has lasted through out last freeze so believe it is working.

When it came time to run the pipes, someone had to get under the house. There was a crawl space of about 8” and the company has a very thin man to get under the house. He helped run the lines to the various parts of the house and reported what he had found under the house which led the boss to explain to me I indeed did have “monsters under my house.” Bones, skin etc. were found there. I have heard squirrels in my roof and occasionally bumps under the house but none have surfaced for me.

@jakkalbessie After the ice storm of February 2021, my PVC pipes were replaced with PEX as well. It is a vast improvement.
Armadillos really crack me up. They get all excited, run around, hit the floor boards, and we can hear the smack, sometimes feel the floor vibrate a little.
We will have to figure out a new route to Pine Tree Lodge. A bridge fell apart on one of the highways we travel. It will be a very long time before it is repaired. I figure our drive time will be at least 1 hr 45 min, instead of the usual 1 hr 10 minutes.
One must sacrifice for zydeco!

We do not have anything planned until sometime in August, and that is more a family business thing than a holiday trip. While Dear One is doing his thing, I will likely be reading some books.

But now a research paper has confirmed it.

UK pandemic deaths caused by euthanasia drug Midazolam, new research paper claims

An extremely well-cited Australian paper, published by the open-access journal Medical and Clinical Research claims that the pandemic in the UK from 2020-2022 was caused not by the SARS-CoV-2 virus, but by euthanasia of elderly patients in hospitals and care homes using the sedative Midazolam, ostensibly to clear beds in a clogged NHS in anticipation of a COVID-19 epidemic that never materialised.

People were made to sign DNR or their doctors would sign one for them without their knowledge. Doctors here put patients on ventilators and given respiratory depressant drugs to keep medical staff safe from the virus.

There were problems with running a campaign of Joy while committing a genocide? Who could have guessed?

@snoopydawg they needed the rooms, snoopy. They were old and sick. Rooms were needed for new elderly and sick people.
See, it makes perfect sense to kill them off, amirite? Call it death from COVID, get paid extra!
Nobody goes to a hospital anymore if there is another work around. Nobody wants their parents in a nursing home unless they have full medical power of attorney for them. Or a guardianship.
Drs. became beast for a few years. Are they back to normal Hippocratic Oath yet?

work for money, not for some higher concept of curing disease
the few Dr.'s that I know that have taken a different path are not
listed as providers on the insurance schemes, so they only take cash
can't say I blame them. Money is not the motivator for them.
It is to be free to practice care without the interim restrictions.
Mountains of paperwork forms don't add up to much for health

@QMS kicked insurance billing to the curb and went their own way, charging cash. They followed their education, not f'king insurance charts.
Hell, I flew my first husband and I to Mexico for his cancer treatment back in the early 90's, to avoid insurance dictates. Here in Texas, the drs. literally tortured him. The best treatment he received was at the Biomedical Center in Tijuana, not the world famous cancer center in Houston.
I saw it, did all I could to prevent it, lost my admiration for our healthcare system then, have not regained confidence in it thus far.

And it should be considered criminal.

Well over 500,000 Ukrainians have been killed and twice that wounded in just over 3 years. And for what? After Russia beat the first army Ukraine should have sued for peace. They could have had peace in March, 2022, but NATO told Zelensky to keep fighting. We lost 58,000 in Vietnam in how many years?
Would pro Ukraine folks change their tune if they knew the truth about Ukraine deaths?

While I have no sympathy for the Neo-Nazis there, the others deserve better than to serve US murderous purposes.
