Notice of Appeal Filed in DNC Fraud Lawsuit
This is my first blog entry here at C99. Fingers crossed that the formatting comes out right.
As we've discussed in previous blog entries, the judge in the DNC Fraud Lawsuit (Wilding, et al vs. DNC Services Corporation and Debbie Wasserman Schulz) dismissed the case a few weeks ago, on procedural grounds pertaining to jurisdiction and standing.
Late Thursday evening, Sept. 7, plaintiffs' attorney Elizabeth Lee Beck announced that they have formally appealed the court order to the 11th Circuit Court of Appeals in Atlanta, GA. (That's the federal appellate court for Florida and other southeastern states.)
The Notice of Appeal was filed on Thursday, well before the 30-day deadline for filing appeals. If you want to read the Notice of Appeal, it was uploaded to the website maintained by the Becks. It's document #63 here:
It's a standard Notice of Appeal, short and sweet. The legal arguments will come later.
The decision to appeal was apparently a tough one, as Elizabeth Beck discussed in a video posted to their Facebook group last weekend. This is partly because of the financial considerations, and no doubt partly because of the stress of going up against the Clinton-DNC machine. (Unfortunate things seem to happen to people who do that.)
Because the Becks have taken the case on a contingency fee basis, they do not receive any compensation unless and until the plaintiffs win and receive a monetary judgment. This doesn't just include reimbursement of expenses, but compensation for their time and work.
If the appeal is granted and the case proceeds, it could go on for years and consume most of the Becks' time and energy. Unlike the DNC's D.C. lawfirm, the Becks don't have a huge base of wealthy clients or a large staff of lawyers to maintain the flow of income. So it certainly involves some risks for them. My impression is that they seem almost driven to do this.
The Becks have also announced that Jared Beck is writing a book about the 2016 primary, and just signed a contract with a book publisher.

There was some doubt as to what the Becks were going to decide about appealing, so it was great to go online tonight and see this. Elizabeth Beck looked stressed out in her video message last weekend. Tonight she looked relaxed, even with Hurricane Irma threatening South Florida, where they live.

To be honest, at this point I think what they could use the most is moral support. They've said that they don't want and will not accept monetary donations.
The Becks are active on social media. For people who use Facebook, they have a FB group where supporters and class members can communicate with them.

Thinking about it, the other big need right now is to get more publicity for the lawsuit, to increase public awareness that it exists and what it's about.
The MSM has pretty much ignored it. Most of the reporting on it so far has been by alternative news media and by right wing media. One way the Becks are using the FB group is to archive all news articles and media mentions about the lawsuit, no matter where they're from. (Some group members don't like the fact that right wing media outlets are linked to.)
The Becks do media appearances and give interviews, and I imagine they'd like to do more. Jared Beck recently had a great interview on the Jimmy Dore show. Maybe there's something interested supporters could do to help in that effort.

Reads just fine, thanks a lot for the good news.
The Becks are a trip, I liked them in the interview they did with George Webb. Briefly watched Jared lose his mind on twitter the day of dismissal, then realized that is "normal" for twitter. Strange times. The Becks seem like good lawyers, I even watched the interview Elizabeth did where she broke down crying answering those outrageous questions, how awful.

To me, the Becks come across as real people. They display authentic emotions. From the court transcripts I've read and the interviews they've given, they're very intelligent and know their stuff.

I admire Beck for his righteous challenge.
In a fully functioning judicial system (which we don't have), this case could potentially topple the corrupt duopoly electoral system of which the masses (well, maybe less than half the population who vote) pay fealty. Can't have that. Imagine everyone, who are so used to reflexively saying "we're the greatest country in the world," having to come to terms that our electoral system, and therefor whole idea of "democracy" are a complete charade, and having to come to terms with that existential crisis?
We need a good many reality checks in this country. This would be a big, if not the biggest, one. Truth is probably most know in their hearts it is deeply corrupt.
Thomas Frank was on The Real News with Paul Jay. And while his views on how the Democratic Party has been selling out the working and middle class for the past 35 year and why they lost in 2016 are dead on, he contradicts himself about Bernie being cheated, defending his statement that she won by calling it a "paradox," because he does acknowledge the DNC had titled the scales.

Frank is a weird one
I read Listen, Liberal (and many of his other works.) I've heard so many interviews with him. He's smart. He has the facts. He knows the truth. (He's even remarked about becoming persona non grata on the talking head circuit since writing Listen, Liberal.) And yet, he just can't seem to bring himself to accepting the premises and conclusions of his own work. He'll twist himself in a pretzel or laugh it off when someone like Jimmy Dore challenges him on this, but he has no real defense either. I just don't get how someone could understand things well enough to accept the primary was rigged and still believe Her won fair and square. Her coronation wouldnt have been a done deal with out the cheating with as strong as Bernie was running.

Sanders Was Asked About the DNC Lawsuit on Iowa Radio Today
Just caught this from Jimmy Dore's video list. It's new. I think C99 folks will find Bernie's response to be a little pedestrian. Like Dore and the other panelists, I give the Iowa Radio interviewer a little credit for pressing Sanders by asking a follow-up to the caller's question.
