WASHINGTON — Two Democratic Party donors and a former party staff member have filed an invasion of privacy lawsuit against President Trump’s campaign and a longtime informal adviser, Roger J. Stone Jr., accusing them of conspiring in the release of hacked Democratic emails and files that exposed their personal information to the public.The case was organized by Protect Democracy, a government watchdog group run by former Obama administration lawyers. It filed the claim just short of a deadline under a one-year statute of limitations for privacy invasion lawsuits: WikiLeaks published the first archives of stolen Democratic National Committee emails, which intelligence agencies say Russia hacked to harm Hillary Clinton’s presidential campaign and help Mr. Trump, last July 22.
Mr. Trump and his political advisers, including Mr. Stone, have repeatedly denied colluding with Russia, and the 44-page complaint, filed on Wednesday in the Federal District Court for the District of Columbia, does not contain any hard evidence that his campaign did. But it is seeking to depose witnesses and obtain campaign emails and other documents during the discovery process that is a standard part of lawsuits
If a judge permits the case to reach that stage, the lawsuit would become a new and independent fact-finding investigation into the Trump-Russia issue — one that is overseen by a judge rather than by congressional Republicans, like the oversight inquiries conducted by the House and Senate Intelligence Committees, or by the Trump administration, like the criminal inquiry led by the special counsel, Robert S. Mueller III.

A couple of questions for those smarter than myself on this issue (which includes pretty much all of you):
1. During discovery would not all pertinent info of the 'hack' have to be turned over to the 'other' side which would include access to the actual server and all corresponding documentation regarding records of who was using and who was accessing it during the period in question?
2. Why is Wiki not part of the lawsuit as a co-defendant? Wiki was the means used to get the information out to the public. Shouldn't some kind of 'collusion' (irony alert) need to be proven between the defendant's (Stone & Co.), the Russians, and Wiki?
3. Will this get thrown out pronto or will it be allowed to run its course like the suit against the DNC filed by Sanders supporters?
4. How fucking stupid are these 'lawyers' who filed this suit?

Regarding #1, I think you are right. Discovery opens up can of
worms for the plaintiffs. Since there is zero evidence of a hack, the servers would have to be forensically inspected to establish this as fact.

I don't see where Protect Democracy has standing to sue. They were not the allegedly injured party. My take is that this case will be quickly dismissed.
Even if the case was allowed to proceed, where exactly do invasion of privacy laws apply? As a public entity, the DNC doesn't have the same protections as individuals do.
Under the "intrusion" category of invasion of privacy, the law requires the intrusion be against a "person". In addition, the wrong occurs at the time of the invasion, not the time of publication. So the statute of limitations has been exceeded.
There's no apparent case under the other possible category, "public disclosure", either. It requires "dissemination of little-known, private facts that are non-newsworthy, not part of public records, public proceedings, not of public interest, and would be offensive to a reasonable person if made public". It's hard to see the DNC leaks as non-newsworthy, they were certainly not offensive to a reasonable person in the legal sense, and they are of public interest.

They argue about the emails, but never even refute the content.
I still find it stunning that they still get away with treating these emails as if it was the just bits and bytes that mattered and not the content and messages in them. It's as if these emails are some abstract thing with the power to destroy and no one wants to talk about why that is so. Not one person in the MSM can call these people and say "so, the real problem here is people could see with their own eyes that the DNC was in fact doing what people had only suspected, not Trump or Russia or whatever." They all but admit the content was accurate and true and it just goes unnoticed. I don't care if they were hacked and not phished or whatever. To me, the real scandal is still going to be how nakedly they laid out how they cheated Sanders, how they manipulated the election to try to benefit Her and the blatant disregard for anyone not of the donor class.
And as a side note, I'd love to believe these emails had as much of an impact on the election as they claim because that would mean people were waking up. But I don't think the evidence supports that. Few people were following this and, for those that were, this probably just confirmed what they assumed was happening anyway. The reality is, Her ran a campaign that made Kerry and Romney look like a combination of Obama and Her own husband by comparison. As much as I wish this peak behind the curtain changed things, the reality is, Her campaign sucked so much, I think she would have lost with or without Wikileaks.
