Obama's Newest War.

The first shots of our next war have been fired.
The media and government claim they were non-lethal.

Now, while I am a peacenik hippie who would never take up a weapon again unless my life depended upon it, I do know quite a bit about the subject. Since I was 14, I've studied Military History. I started with WWII, specifically the Battle of Britain, and moved on to the classics of Von Clausewitz, Rommel, Patton and Grossman. I've read my Sun Tzu, and My Musashi, and I know the theories and practices. I also know when a war is happening.

Let's talk about war here. Specifically let's talk about Irregular Warfare.

An Irregular war differs from a regular war in that at least ONE side doesn't wear uniforms and has no easily identifiable chain of command. One side represents a nation state, and the other does not. They may represent an ethnic group, a community or an ideology, or even a non-governmental body, but they do not specifically represent a government that is recognized and a signatory to the Geneva Convention.

I will be referencing the Geneva Convention, because it is the touchstone for what governments currently consider "Legal" war.

What we have at this point is a governmental organization, attacking a non-governmental group, for the purposes of influencing their actions and resolving a conflict. This is quite nearly the textbook definition of an asymmetrical war. The fact that the water protectors are not fighting back is irrelevant and makes the state of war even more apparent. Asymmetrical war is NOT only exclusive to a guerilla force fighting against a government, and in fact is often referenced in history books as a government "Going to war against its own people."

The legal points of private property and minor points of disorderly conduct, etc., have been effectively put aside by the military actions of the government. Essentially, by ignoring and overriding all legal framework, the US government has declared a war against the people of the United States, enforced by the government, and supported by the government through their actions. It is no longer a matter of law enforcement, when the tactics currently in use are meant not to enforce laws, but to hurt, cripple and disperse the enemy in a disorderly manner. The ideal reaction to the Police tactics, to judge by the manner in which they are occurring, is that the protestors will flee the site, allowing the aggressors to occupy the territory. That is a military action. There is no emphasis on maintaining order, and the arrests that have occurred were carried out under the veneer of law, which have often been struck down. As a result arrests have been discontinued in favor of onsite Military justice. Namely: Defeating the enemy.

Now, let's be straightforward here. The Water Protectors DO fit the definition of a legal, irregular force. They do not attempt to hide or blend in with the populace at large. They do not engage in terror actions against the populace, since all of their actions have been direct. They simply have stated their opposition, and are being met with force. If the irregulars chose, they would be fully within their legal rights as an irregular force to respond to the military action in kind. The fact that they do not do this means that they are effectively showing that it is the US which is engaging in an illegal war against its own people. The actions used by the police include:

1. Use of Weapons which include weapons calculated to cause unnecessary suffering (Water cannons in subzero temperatures, Chemical weapons, LRAD devices which specifically are designed to cause suffering.)
2. Failure to Identify Oneself as a Legal Combatant. (By acting under the veneer of Law enforcement, the Police are committing a war crime, since they are operating in a military function.)
3. Terrorism. (Police actions against civilians not a part of the protest intended to cow and silence dissent)
4. Attack or Bombardment of Undefended Towns. (Water Protector settlement is an undefended non-military target.)
5. Seizure or Willful damage to Cultural Institutions. (Sacred Land. Seizure for a third party is still Seizure.)
6. Reprisals against Protected Persons. (Assassination falls under this category, as do attempts to target "Ringleaders" in order to end resistance.)
7. Breach of an Armistice. (Legal rulings against the aggressors have been ignored.)

Those are just the seven I came up with from a quick reread of the Geneva Convention.

Essentially, The Water Protectors would have more protections if they declared war against the United States, than the US will grant them under the 1st Amendment.

I find that absolutely horrifying.

The Sioux were the only tribal group to win a war against the United States.

Red Cloud's War (also referred to as the Bozeman War or the Powder River War) was an armed conflict between the Lakota, Northern Cheyenne, and Northern Arapaho on one side and the United States in Wyoming and Montana territories from 1866 to 1868. The war was fought over control of the Powder River Country in north-central Wyoming.

With peace achieved under the Treaty of Fort Laramie in 1868, the Indians were victorious. They gained legal control of the Powder River country, although their victory would only endure for 8 years until the Great Sioux War of 1876.

Nothing gauls Uncle Scam like losing. Revenge for loss is always sought, for dominance must be established and maintained - even by resorting to what later international law would consider war crimes in order to achieve this when nothing else worked.

The Powder River Country was to be henceforth closed to all whites. The treaty ended Red Cloud's War.

The Seminole managed to outlast the desire of the US government to achieve a complete victory, which is itself a notable achievement. But there was no surrender as with the Sioux and their allies.

Some will say that #2 is not a crime since the police and Mercenaries are wearing uniforms.

It is Illegal in war to kill or engage civilian law enforcement personnel who are not acting in a military function.

This is how, at the end of WW2, during the surrender of the Wehrmacht, the Wehrmacht kept their own MP's armed, and on duty in several German cities until the Allies relieved them of duty.

Hence, by pretending to be Cops, and engaging the enemy, it is similar to every aggressor there wearing a "Red Cross" symbol while opening fire.

I spent a semester on Clausewitz...one on Sun Tsu...the Geneva Conventions permeated many classes. I had a semester on Vietnam, and one on irregular warfare. I went through SERE. I taught SERE. When it was to prepare to resist something that was possible from our enemies...not a torture manual to use on them.

If, as the aggressors insist, it is NOT a war, then there is no reason to be using these weapons against protestors who are unarmed and merely expressing their first amendment rights. They allegation that weapons were present among the protestors is the only defense possible, and unless the DA wants to ignore the case against cops, as usual... , there should be prosecution for assault, maim, and attempted murder. Essentially if it's not a war, the "Only Following Orders" defense will probably be trotted out to the largest extent possible.

However, IF this is a military action, it gets MUCH nastier. Just following orders is not an excuse in a war crimes trial. Every aggressor is at the minimum engaging in a false flag operation, which is a serious breach of the Geneva convention. Essentially if this ever went before an international court of law, every single member of the aggressors could be found guilty of war crimes. Not that I ever expect it to, but again, it's sad that there are better protections for the Water protectors under international laws than there are under our laws.

The last time I looked at her go fund me account, it was close to $100,000 for the goal of $150,000.
I hope that they increase the amount if they reach the goal because she is going to need a lot of physical therapy and probably psychological therapy too.
I'm reading an article on truthout about the protests and the author points out that again our taxes are paying for the police and the national guard's actions against them.
One way to get this to stop is a financial protest.
What if everyone who is opposed to this raises their taxes exemptions from their paychecks to the highest level possible in order to keep the money out of the government's hands?
Do not shop for anything except for essentials until this passes, or other ways to financially protest against this?
Our money is paying for them to attempt to kill those people and there has to be a way to keep it out of their hands.
As dmw has stated, this is an illegal war against the people and we are paying those damned asshole's salaries.
If we can't get them to stop attacking the protesters it's going to embolden them to do this to the next protesters.
And again, F'ck you Obama for watching this happen while you let the White Militias threaten federal officials and take over a federal reserve for over a month.

I'm blown away with your writing and your knowledge of what our government, and it is with the consent of the government, is doing to the water protectors.
Just the fact that this company with the backing of foreign banks can do these actions against peaceful protesters is appalling.
You noted that they are going against the rule of law and you are correct.
I have posted that Bush had signed an executive order against foreign companies using eminent domain against the people and their property because in order for eminent domain to be used it has to benefit the community, not private companies.
There are 9 farmers who have also had eminent domain used against them and they are suing for this company to stop drilling on their lands.
And Obama's silence on this is very loud.
Trump will be in trouble over this when he becomes president because he has money in the pipeline.

Is there a law that says he has to make it public if he revokes (or whatever it's called) a previous President's exec order?

And if he didn't revoke it, who is representing the Protectors?

Speaking of that, shouldn't the ACLU be all up in this whole atrocity? Dog kennels have been used. People detained for days only to have charges dropped, sometimes. Excessive force, on at least 1000 people (collectively), some causing serious injuries, and no legal org is standing up - speaking up?

Oh, and I heard on Houston's Pacifica station this afternoon that the sheriff either changed his story about putting out fires, or added another to his list of bullshit: water cannons came out after one of "the protestors" threw a rock at the terrorists, er um, "law (my ass) enforcement". Gag!

I would think that would raise up all sorts of legal questions...ones I have no experience in, since my education took place where mercenaries were considered too disgusting for professional soldiers to even consider.

See, this is where it gets sticky. Industrial warfare has always been the purview of nations. Even when Corporations enforced rules they did so under the veneer of a nation. (East India Company, for example, used the British Army as their enforcement branch.)

It's only recently with the rise of the Private Military Corporation, that it becomes a major problem. Because the corporation is not recruited to fight, OFFICIALLY, they do not follow the rules of warfare. As a result they engage in numerous atrocities, and the only people who can stop them are the employers, or the enemy. The employers have no interest in stopping the action, because acting through an intermediary provides a legal buffer zone. The Mercenaries were NOT hired to fight a war or commit atrocities, therefore those atrocities were not the actions of the government.

Prosecuting the corporation, of course, is not really possible, because the actions were not authorized officially, by the corporation. Unless the victim has name, face and phone number, the guy doing the actual action will probably get away with it too, because there's the little matter of him being a civilian, and therefore any trial does not go to international jurisdiction, but rather to the local courts, and all of the joy that goes through. Essentially, the Blackwater guys that got burned and dragged were the only check on corporate mercenary power. And the Corporation gets to claim that they were murdered.

Essentially, it's like trying to take a corporate citizen to court. Hence why I hate modern mercenaries.

With very few exceptions, Mercenaries have had a well deserved reputation for:

1. Changing sides whenever more money was thrown their way.
2. Deliberately avoiding battles they had been contracted to fight in, in order to be paid for doing nothing.
3. Looting and Pillaging anybody nearby.

Essentially, employing Mercenaries has always been a risky, and self-defeating endeavor. Mercenaries make money when there is conflict, and so have an active interest in maintaining and expanding conflicts as much as possible.

The Colombians had entered the United Arab Emirates posing as construction workers. In fact, they were soldiers for a secret American-led mercenary army being built by Erik Prince, the billionaire founder of Blackwater Worldwide, with $529 million from the oil-soaked sheikdom.

Mr. Prince, who resettled here last year after his security business faced mounting legal problems in the United States, was hired by the crown prince of Abu Dhabi to put together an 800-member battalion of foreign troops for the U.A.E., according to former employees on the project, American officials and corporate documents obtained by The New York Times.

The force is intended to conduct special operations missions inside and outside the country, defend oil pipelines and skyscrapers from terrorist attacks and put down internal revolts, the documents show. Such troops could be deployed if the Emirates faced unrest in their crowded labor camps or were challenged by pro-democracy protests like those sweeping the Arab world this year.

167 Water Protectors have been injured. 3 of those people are elders.
7 people have been hospitalized for severe head injuries. The police are targeted the heads and legs of Water Protectors.

Yes, there are mercenaries there, but many (most?) of the perpetrators of the violence are uniformed cops, sheriffs, and national guard. As I said in another comment above, they are removing their name tags and badge numbers, so they are not identifiable personally, but many (most?) of them are doing these sadistic acts of torture and repression while in the uniform of their home agencies.
