4th Circuit orders case to proceed

On Friday, the 4th Circuit Court of Appeals ordered the case of Gavin Grimm v Gloucester County School Board to proceed in district court.

GCSB had asked that the case be put on hold while they prepare a writ of certiorari...an appeal to the Supreme Court.

In April the Court of Appeals sided with Grimm and the Obama administration's position that denying transgender students equal access amounted to sex discrimination and as such violated Title IX.

The court remanded the case to a district court to be reheard in light of their judgment. The district court Judge Robert Doumar had denied that Title IX applied.

The Obama administration later issued guidance to all of the nation's public schools, instructing them to allow transgender students equal access or risk losing federal funding.

The court on June 9 rejected the request by GCSB to put a hold on the case, and on Friday issued a mandate ordering the case to move forward in the lower court. The school board can still pursue its appeal to the U.S. Supreme Court as the case progresses.

Grimm is being represented by the ACLU. He will be a senior at Gloucester High School in September
