Hillary's Lawyer Said She has no Obligation to Meet with FBI

This is breaking news by David Shuster:

If true (and Shuster is a reliable, well respected journalist, so I assume his source is a good one, probably someone in the DOJ or FBI) then the sheer audacity of this action, to tell the FBI, that no, I am Hillary Clinton, and I am too big to talk to the FBI even if you are investigating me, is astonishing. It also is, as they say. very bad optics.

Hopefully the mainstream media, including CNN picks this up. I'd love to hear the justification for why a private citizen, no matter how important she thinks she is, is above the law. In effect, she is exposing herself as a liar of the highest order. The FBI will now have to obtain a subpoena to force her to talk to them. And all after she promised this:

Clinton said recently that the FBI has not approached her for an interview, but that she would fully cooperate if they do.

Brian Fallon, a spokesman for the Clinton campaign, said she has offered to answer any FBI questions and remains confident that she and her aides acted appropriately.

"From the start, Hillary Clinton has offered to answer any questions that would help the Justice Department complete its review, and we hope and expect that anyone else who is asked would do the same," Fallon said in an email. "We are confident the review will conclude that nothing inappropriate took place."

Yes, I don't really think she's that motivated: the dullest, least inspired campaign in modern history, and perhaps ever.
Her main goal is money: for herself and her coterie: she doesn't appear, based on her "server" issue, to really care about anyone else. And she is massively dissmissive of the law. (reputed to be disagreeable in the extreme, even to those charged with protecting her life with their own . . . to them she is reported to say "f--k you", so its not much of a leap to believe most of us are completely expendable to her, and she has been a complete, unimaginative, unmotivated slug as a candidate:

Even if he fills the inside straight with two cards and ends up with more delegates and more votes, they will not give it to him. but I just noticed a line of articles saying that the FBI has for some time been investigating whether Clinton made "materially false" statements, or coerced a third party (Pagliano?) to do such, in violation of US Code 18, Section 1001.

There were earlier reports that a company (Datto) backed up her server in the cloud and her crew requested (in 2013 I believe) that the backups be shortened to 30 days (presumably to cover up the mass deletions of so-called "personal" emails).

If the FBI recovered deleted emails that were highly classified, she is completely fucked.

How could anyone actually vote for her?

One is legal and one is political.

While she has every legal right to decline, the political backlash from declining to be interviewed after she has publicly stated on multiple occasions that she will be forthcoming is political suicide. It does two things. First, it reinforces the public's view that she is not to be trusted and second, it provides even more ammunition to the Republicans during the general election campaign.

The Democratic party will be truly foolish to nominate her from a politically partisan aspect. The Democrats need a national win. They have lost both the House and the Senate in the last six years and they need to win the White House. Clinton has been a very flawed candidate from the beginning and her ability to win is now seriously in jeopardy.

Just an FYI, the statement is correct, she is not under any obligation to speak with the FBI.

The FBI questioning in this sort of investigation is offered to the person being investigated as an opportunity to explain their side of the story and help the FBI put things in the correct context (ahem) and help clear up any questions or misconceptions that the FBI might have.

Most lawyers in this situation would advise her not to speak with the FBI; because while not under oath, any misstatements can be construed as 'an attempt to mislead and misdirect the investigators' and that is a felony.

That is how Comey sent Martha Stewart to jail after all. Not for what she did, but for misleading the government about it.

We all know, that HRC could not possibly do anything but misdirect and mislead the FBI; so no lawyer in their right mind would let her talk to them. She would be guaranteed to hang herself.

Even if they had not found any felonies before talking to her, they would have some after talking to her.

But there's all those statements by Clinton she would meet with the FBI. It's a very bad look to say one thing and then force the FBI to issue a subpoena to interview her. There is the legal side to this and the political side and frankly this makes her look guilty in the court of public opinion. I can only see a justification for doing this if she knows that the DOJ will not authrorize the FBI to get a subpoena or she is concerned that they have something that would justify an indictment. Either way it is an incredibly bad look, especially after her aide Cheryl Mills refused to answer questions in her deposition in the Judicial Watch lawsuit Friday claiming attorney client privilege.

I think the only reason Clinton publicly said she'd meet with the FBI was to make sure people would vote for her. She knew her lawyers would not agree to her being interviewed.. It was simply said to manipulate her own supporters and any potential primary voters.

With that now on record, any meeting of Hillary with the FBI could then be characterized as some gracious favor she's granting the FBI to assist them in every way she possibly can....or whatever other self-serving garbage they can come up with.

Of course we don't know for sure, but I can imagine she'll try to drag it out until she's won, been sworn in and can preemptively pardon herself.

Hopefully, the aren't relying on her tripping up to make charges stick. Hope they can just say "you have until this date, and then we announce you chose not to cooperate and we move on."

Hopefully that date is no later than Friday, so at least they can be on record as saying "she refused the interview" they can then indict her anytime before the convention.

Out of the blue. And all this time she said she would fully cooperate with the investigation or as she wrongfully referred to it a "security inquiry." She, of course has the right to refuse to cooperate and plead the 5th amendment right against self incrimination. But to claim she did nothing wrong, which the OIG report concluded was false, and to say she would fully cooperate with the FBI when in fact it now appears she had no intention of ever doing so, well that is not the action of someone who has all along asserted she was innocent of any wrongdoing. This is an investigation by the FBI of her actions while Secreatry of State under a Democratic administration that to date has supported her candidacy (short of an outright endorsement by the President) and yet she now has her attorney tell the FBI to go eff themselves?

No other major party candidate would still be running for the nomination under similar circumstances. We have seen both Dem and GOP candidates be forced to suspend their campaigns for far less. What does that tell you about our democracy, much less the Democratic Party establishment? It is frankly an unprecedented campaign by Clinton in an unprecedented election cycle.

And your comparison of the FBI investigation of her to a police state intent on bringing her down is laughable. Not surprising, for someone who is wiling to unquestionably support her, but it is a prime facie ludicrous defense of her behavior as she proceeds toward a seemingly inevitable nomination by corrupt party leadership who apparently benefits from the same pay to play political system as the Clinton family has done over the last 16 years.

I don't think any of us are necessarily saying she 'should'. This is really about Clinton manipulating primary voters by saying she "would'.. knowing the whole time that it would never happen.. We knew that... but her supporters and those uninformed... did not... or if they did know (since it only takes common sense to know) they wanted her to pretend.... to make herself ... look good in the meantime. ... to me... the whole thing is rather pathetic.. actually.

The FBI interview or refusal to do it will be the last straw. Soon, very soon the Clinton's will be faced with a choice, withdraw from the race or face possible jail or even worse the destruction of The Clinton Foundation which will be thew next target of any investigation.
