Hillary's Lawyer Said She has no Obligation to Meet with FBI

This is breaking news by David Shuster:

If true (and Shuster is a reliable, well respected journalist, so I assume his source is a good one, probably someone in the DOJ or FBI) then the sheer audacity of this action, to tell the FBI, that no, I am Hillary Clinton, and I am too big to talk to the FBI even if you are investigating me, is astonishing. It also is, as they say. very bad optics.

Hopefully the mainstream media, including CNN picks this up. I'd love to hear the justification for why a private citizen, no matter how important she thinks she is, is above the law. In effect, she is exposing herself as a liar of the highest order. The FBI will now have to obtain a subpoena to force her to talk to them. And all after she promised this:

Clinton said recently that the FBI has not approached her for an interview, but that she would fully cooperate if they do.

Brian Fallon, a spokesman for the Clinton campaign, said she has offered to answer any FBI questions and remains confident that she and her aides acted appropriately.

"From the start, Hillary Clinton has offered to answer any questions that would help the Justice Department complete its review, and we hope and expect that anyone else who is asked would do the same," Fallon said in an email. "We are confident the review will conclude that nothing inappropriate took place."

Interestingly, some of her biggest wins have been in states with closed primaries and those infernal voting machines that flip the vote. She has no issues to talk about because her attention is solely on fundraising and how to steal the next primary.

On CBS’ “Face the Nation” this month, Clinton said, “I’ve made it clear that I’m more than ready to talk to anybody, anytime. Well, every time that I come home
Nobody wants to let me be
It seems that all the friends I've got
Just got to come interrogate me
I appreciate your feelings
And I don't want to pass you by
But I don't ask you 'bout your business
Don't ask me about mine

Well it's true I love the money
And I love my brand new car
I like drinkin' the best of whiskey
And playin' in a honk-tonk bar
But when I come off the road
I just gotta have my time
'Cause I got to find a break in this action
Or else I'm gonna lose my mind

So don't ask me no questions
And I won't tell you no lies
So don't ask me 'bout my business
And I won't tell you goodbye

Well, what's your favorite color
And do you dig the brothers, is drivin' me up a wall
And every time I think I can sleep
Some fool has got to call
Well, don't you think that when I come home
I just want a little piece of mind?
If you want to talk about the business
Buddy you're just wasting time

So don't ask me no questions
And I won't tell you no lies
So don't ask me 'bout my business
And I won't tell you goodbye

I said don't ask no stupid questions
And I won't send you away

Well, I guess that'll be OK

They've been denying Climate Change since 1977: that means every administration has been in on this: The Clintons got media monopoly as well as the repeal of any financial oversight: so what does everyone think? My sense is that fascism will be fine: Both Trump and Hillary are down with genocide: Trump with Naziis; HRC with Kissinger "genocide is necessary" . . . she is funded by Monsanto. Pharma, and Fossil fuels: he will likely get similar funding from these groups ("broke") but lots of free air time. (nauseating) . . . so whether its her or Trump: we are f-----d. They are siphoning off U.S. assets: NOTHING that benefits the public is happening: and they are enacting things like there is no tommorrow that are devastating: because there is no tommorow for us as far as they are concerned.

The same tired talking heads are all millionaires many times over, and they serve the billionaires in their aspirational grab for the lifeboats: but its pretty grim for the rest of humanity.

Yes, I don't really think she's that motivated: the dullest, least inspired campaign in modern history, and perhaps ever.
Her main goal is money: for herself and her coterie: she doesn't appear, based on her "server" issue, to really care about anyone else. And she is massively dissmissive of the law. (reputed to be disagreeable in the extreme, even to those charged with protecting her life with their own . . . to them she is reported to say "f--k you", so its not much of a leap to believe most of us are completely expendable to her, and she has been a complete, unimaginative, unmotivated slug as a candidate:

So yes, she is a foil for Trump and fascism.

The DNC and the Democratic establishment WILL NOT give the nomination to Bernie. Even if he fills the inside straight with two cards and ends up with more delegates and more votes, they will not give it to him. If an indictment comes down or an indictment recommendation, they *may* not nominate Hillary - but they will find some other establishment lackey to run. Their goal now is to lose and blame it on the hippies. Then, they can purge 'progressives' from the party while saying, "Where else are you gunna go?" A casual glimpse at GOS will tell you that.

Hillary Clinton’s systematic conduct of government business over a homebrew e-mail system resulted in serious violations of federal law.

the increasingly plausible implosion of Clinton’s candidacy — i.e., a scenario in which Democrats dump her owing to her metastasizing legal woes, coupled with her extraordinarily high negatives

Replace her with: Biden, Warren.

Democrats would make the switch in the next few weeks rather than at the last minute.

Of course, relief at Clinton’s departure would have to be discounted by the hit Democrats took when Obama issued the pardon Hillary would demand as the price of stepping aside. I deeply doubt that the Clintons would accept an Obama promise of a post-election pardon. They’d demand up front any pardons necessary to cover the e-mail scandal, the destruction of government files, and any corruption, fraud, or other offenses arising out of the Clinton Foundation. With Hillary’s nomination, the Clintons will have leverage, and they would surely use it to (a) pressure Obama to spin any pardons as an exoneration (“I see no criminal activity here, but for the good of the country . . . ”); (b) spare themselves the humiliation (and potentially worse) of criminal prosecution; and (c) protect the fortune they’ve amassed by monetizing their “public service.”

but I just noticed a line of articles saying that the FBI has for some time been investigating whether Clinton made "materially false" statements, or coerced a third party (Pagliano?) to do such, in violation of US Code 18, Section 1001.

There were earlier reports that a company (Datto) backed up her server in the cloud and her crew requested (in 2013 I believe) that the backups be shortened to 30 days (presumably to cover up the mass deletions of so-called "personal" emails).

If the FBI recovered deleted emails that were highly classified, she is completely fucked.

It appears that JW is trying to pinpoint if Hillary was deliberately evading FOIA and who in the state department knew about it and when. This is just the portion with some of Platte and Datto mentions.

One is legal and one is political.

While she has every legal right to decline, the political backlash from declining to be interviewed after she has publicly stated on multiple occasions that she will be forthcoming is political suicide. It does two things. First, it reinforces the public's view that she is not to be trusted and second, it provides even more ammunition to the Republicans during the general election campaign.

The Democratic party will be truly foolish to nominate her from a politically partisan aspect. The Democrats need a national win. They have lost both the House and the Senate in the last six years and they need to win the White House. Clinton has been a very flawed candidate from the beginning and her ability to win is now seriously in jeopardy.

Just an FYI, the statement is correct, she is not under any obligation to speak with the FBI.

The FBI questioning in this sort of investigation is offered to the person being investigated as an opportunity to explain their side of the story and help the FBI put things in the correct context (ahem) and help clear up any questions or misconceptions that the FBI might have.

Most lawyers in this situation would advise her not to speak with the FBI; because while not under oath, any misstatements can be construed as 'an attempt to mislead and misdirect the investigators' and that is a felony.

That is how Comey sent Martha Stewart to jail after all. Not for what she did, but for misleading the government about it.

We all know, that HRC could not possibly do anything but misdirect and mislead the FBI; so no lawyer in their right mind would let her talk to them. She would be guaranteed to hang herself.

Even if they had not found any felonies before talking to her, they would have some after talking to her.

But there's all those statements by Clinton she would meet with the FBI. It's a very bad look to say one thing and then force the FBI to issue a subpoena to interview her. There is the legal side to this and the political side and frankly this makes her look guilty in the court of public opinion. I can only see a justification for doing this if she knows that the DOJ will not authrorize the FBI to get a subpoena or she is concerned that they have something that would justify an indictment. Either way it is an incredibly bad look, especially after her aide Cheryl Mills refused to answer questions in her deposition in the Judicial Watch lawsuit Friday claiming attorney client privilege.

Hopefully that date is no later than Friday, so at least they can be on record as saying "she refused the interview" they can then indict her anytime before the convention.

Out of the blue. And all this time she said she would fully cooperate with the investigation or as she wrongfully referred to it a "security inquiry." She, of course has the right to refuse to cooperate and plead the 5th amendment right against self incrimination. But to claim she did nothing wrong, which the OIG report concluded was false, and to say she would fully cooperate with the FBI when in fact it now appears she had no intention of ever doing so, well that is not the action of someone who has all along asserted she was innocent of any wrongdoing. This is an investigation by the FBI of her actions while Secreatry of State under a Democratic administration that to date has supported her candidacy (short of an outright endorsement by the President) and yet she now has her attorney tell the FBI to go eff themselves?

No other major party candidate would still be running for the nomination under similar circumstances. We have seen both Dem and GOP candidates be forced to suspend their campaigns for far less. What does that tell you about our democracy, much less the Democratic Party establishment? It is frankly an unprecedented campaign by Clinton in an unprecedented election cycle.

And your comparison of the FBI investigation of her to a police state intent on bringing her down is laughable. Not surprising, for someone who is wiling to unquestionably support her, but it is a prime facie ludicrous defense of her behavior as she proceeds toward a seemingly inevitable nomination by corrupt party leadership who apparently benefits from the same pay to play political system as the Clinton family has done over the last 16 years.

So now they are going to try and stop the FBI from interviewing her, she must have had lunch with Martha Stewart.

Hillary's diemmia, if she is interviewed and lies she can go to jail for that, if she tells the truth, she can go to jail for that

I'll shed a few tears for her, as long as she doesn't deliver the Presidency to Trump.

Love is my religion.

She built her world by pathologically lying and now she can go live in it. She's got war criminal Henry Fucking Kissinger to console her.

I have been amazed and disgusted by the careless manner in which she handled national security matters. It does not bode well for how she would conduct WH matters.

So she considers her politics that of the 'old school' Republicans. These moderate and Corporate/Blue Dog Republicans are the Clinton third way.

Considering her politics are right wing, then every damn thing she does is a right wing conspiracy.

She said it herself.

Two parties - Center right Democrats and Extreme Right Republicans - and they have all been playing for the same team and representing the same small group of people for decades.

"Representation' in this country is a sad pathetic joke.

The FBI interview or refusal to do it will be the last straw. Soon, very soon the Clinton's will be faced with a choice, withdraw from the race or face possible jail or even worse the destruction of The Clinton Foundation which will be thew next target of any investigation.

If they penetrate that vipers nest, well the Clinton's place in history will be something less than what they are seeking.

If anything, it will make her MORE sympathetic to her supporters. She is a woman and is being wrongfully prosecuted. Just like Martha Stewart (who I actually have a lot more sympathy for).

Democrats, we tried to warn you. How is that guilt and shame working out?

Yes, her diehard supporters will become more sympathetic to Hillary. The problem is, this reinforces the idea she is untrustworthy and hiding something to everyone outside her supporters.

Making False Statements to a government official a wiki page

Making false statements

Making false statements (18 U.S.C. § 1001) is the common name for the United States federal crime laid out in Section 1001 of Title 18 of the United States Code, which generally prohibits knowingly and willfully making false or fraudulent statements, or concealing information, in "any matter within the jurisdiction" of the federal government of the United States, even by mere denial[clarification needed].[1] A number of notable people have been convicted under the section, including Martha Stewart,[2] Rod Blagojevich,[3] Scooter Libby,[4] Bernard Madoff,[5] and Jeffrey Skilling.[6]
This statute is used in many contexts. Most commonly, prosecutors use this statute to reach cover-up crimes such as perjury, false declarations, and obstruction of justice and government fraud cases.[7]

How to Avoid Jail Time for Lying to the Government

Are you aware that it is a criminal offense to lie to a federal government official? Title 18 of the US Code, Section 1001, a favorite of federal prosecutors, makes it unlawful to lie to a government agent, even if you:
· made the false statement without the obligations of an oath,
· didn’t receive warning of the law or its consequences,
· were not trying to cheat the government out of money,
· or lied about something that was not materially influential to government matters.
The Law
Federal law makes it illegal to intentionally make false statements in any matter “within the jurisdiction” of the government. With the ever far-reaching powers of the federal government, much of what you say or lie about can be construed as a lie within government’s jurisdiction.
For example, you lie about the number of hours you worked on your time sheet and submitted it to your employer. Your employer submitted these documents to the government under some regulatory obligation. Guess what? Your little lies could be a federal crime, which could get you in big trouble with the law, should the government have an interest in something related to you, your employer, or the like. You could find yourself in a mess of trouble even if your lies never particularly influenced anyone, so long as they are under the scope of Uncle Sam’s power.

HOW TO AVOID GOING TO JAIL UNDER 18 U.S.C. SECTION 1001 FOR LYING TO GOVERNMENT AGENTS
By Solomon L. Wisenberg

Solomon L. Wisenberg is a partner and co-chair of the white collar criminal defense practice group of Nelson Mullins Riley & Scarborough, LLP.

What do Martha Stewart and enemy combatant Ali Saleh Kahlah Al-Marri have in common? They were both indicted, under Title 18, United States Code, Section 1001, for lying to federal government agents. Ms. Stewart now stands convicted of intentionally misleading SEC and FBI officials who questioned her about insider trading. Mr. Al-Marri was one of several hundred immigrants who voluntarily submitted to FBI interviews in the wake of the September 11, 2001 attacks. He was later charged with lying, during his interview, about the timing of a previous trip to the United States. Here are two criminal defendants from widely divergent backgrounds. Yet both were ensnared by Section 1001, a perennial favorite of federal prosecutors.
