Finally, MSM Gets the Underlying Issue of the Clinton Email Scandal
It's been a long time coming. Since the Clinton email scandal broke almost a year ago, most of the discussion has been sunk in the weeds of "others did it!" "nothingburger!" "Benghazi political bonus point!" "over-classification!" "she said she was sorry!" "beat dead horses much?" etc.
In the movie What About Bob, Bob (played by Bill Murray) announces that the world is split into two groups of people - those who like Neil Diamond and those who don't. As a longtime Neil Diamond unfan, the line completely cracked me up*. The political world seems almost as simple as Bob's world; there are two groups of people - those who think the Hillary Clinton email "scandal" is in fact a SCANDAL sans ironic quotation marks, and those who think it isn't, that it is one more in a long line of Republican make-believe smear jobs that a incredibly brave and resilient Clinton has been able to stave off yet again, adding even more to her Weebles-wobble-but-they-don't-fall-down credibility.
Let me say right off that I was in the first camp as of Day One of WTF Hillary. Ironically, it was the Democratic Party and even Clinton herself who had educated me that Private Servers Are Very Bad Things Used By Bad People Who Don't Want The Public To Know What They Are Up To like Karl Rove, the Bush Administration and the RNC during the Attorney Gate dust-up in 2007. In that case CNN summarized the private server issue as "Whether White House officials such as political adviser Karl Rove are intentionally conducting sensitive official presidential business via non-governmental accounts to evade a law requiring preservation—and eventual disclosure—of presidential records."
Hillary Clinton herself demonstrated her trademark umbrage at the practice of using private servers to thwart the concepts of transparency and accountability in our government:

Sounds pretty definitive to me. Hillary completely gets that secret email accounts and hiding government information is the type of Constitution shredding behavior that we can count on Democrats and her in particular to avoid as we sanitize the joint and let the sun shine in after the miscreant Republicans are out of office. Oh, wait . . . . .
From Day One of Nothingburgergate, anyone who had been repelled by the secretive and sinister actions of the W Bush administration would have been barfing in their NYTimes to discover that, far from eschewing the behavior, Hillary Clinton enthusiastically participated in the once repulsive Republican practice herself, because CONVENIENCE. Sometimes it's just more convenient to shred Constitutions than not, yannow?
Because she didn't want to carry more than one device, despite having a State Department entourage that resembled a Borax 20 mule team. You would have thought that one lackey could have born the extra weight of one more electronic device.
I was appalled at the hypocrisy and the lack of transparency from Day One of Condididittoogate, because of FOIA, the law that allows all the annoying peons like public interest groups and/or journalists to paw around in public records to try to figure out what government officials are doing on our dime. These pawers and guardians of the public commonweal are the ones who fuel the unhealthy interest of our politicians in esoteric electronics that worker bees have no need of. Most of us don't spend any time trying to figure out how to create closed loop communication systems between ourselves and our henchmen that can be conveniently hoovered of yoga appointments and invasion daydreams at the touch of a button. We don't have aides and entourages that we need to be able to speak to within a cone of silence.
I was mad on Day One of TreyGowdyhasapointyheadgate over the perception of Hillary's Rovelike subterranean tunneling under the foundations of government to create secret stashes of information that the rabble will never have access to. I didn't even need the added flourishes of National Security violations and classified information to think that Hillary Clinton had disqualified herself.
But I had no idea that the entire Democratic Party and numerous people within that Party would be willing to toss all their individual and collective integrity on the pyre of Hillary Clinton's political ambitions. That, I have to admit was a shock. Because of this scandal the Democratic Party can never again bring up issues of transparency and accountability and oversight without everyone breaking into hysterical laughter.
Because of Hillary and the Democrats, Donald Trump can roll up to the White House with moving vans filled with servers labelled "None of Your F-ing Business America!" property of Trump Inc. Good work, Democrats!
Remember how I started this whole piece off with a title that said someone finally in the MSM was getting it? Believe it or not, the editorial Board of USA Today has a great piece that correctly says that we don't even have to have the icing of Security because the underlying issue, plain and simple is SECRECY. Reader, I confess that my eyes moistened and I mouthed a silent "thank you!" when I read this:

President Obama explained the principle himself on his first day in office in the first line of a presidential order on FOIA: “A democracy requires accountability, and accountability requires transparency.” The same day, Clinton was confirmed as secretary of State. Disregarding the spirit of Obama’s directive, she created a highly unusual private email system that had the effect of shielding her official communications from the public, nosy reporters and her political enemies in Congress.
Clinton argues that was not her intent, that she merely acted out of convenience. For the next four years, what Obama had ordered should be public was, instead, shrouded in secrecy. Clinton didn’t just ignore the commander in chief, she ignored the FOIA law, which her own party worked mightily to strengthen in the years after President Nixon’s Watergate scandal.

The issue of how the Freedom of Information Act works or doesn’t work is an issue that cuts across federal agencies. However, when it comes to transparency, Secretary Clinton went above and beyond what the law requires.
Clinton took the unprecedented step of asking the State Department to make all of her work-related emails public. She provided nearly 55,000 pages of emails that were or could potentially be work-related.
In reality, nothing could be a more cynical stretch of the truth. Hillary Clinton asked that her emails be made public AFTER 36 (I think) civil suits, countless unfilled FOIA requests, years of sandbagging and ignoring a Congressional committee, years after leaving office and only after negotiations with the State Department to reclaim what was rightly theirs.
I can't think of a more cynical and contemptuous response to the entire issue - to attempt to make Hillary Clinton as a figurehead of government transparency and accountability. But, you know, it kind of falls into that altered reality where Nancy Reagan was a strong advocate for Aids Victims.
*Neil Diamond - I never cared for his music that much but I was blown away when he insisted on appearing at Fenway to sing Sweet Caroline, the anthem of the Red Sox after the Boston Marathon bombing. I now think he is one totalloy kick-ass kind of guy.

I thought save and continue meant save what you have up to now and continue to write. So you may see this diary change over time as I continue edits to make it tighter. I now know that "draft" is the button that I should use.

For your convenience,
while writing, use the Save and Continue button plus create a publish date for a much later time than you intend to publish, say a day later. Then you can do your editing, previewing, and everything before you publish fairly easily. As a helpful hint because I am very technologically challenged, I hit Save and Continue every few minutes while drafting.
Once you are happy with your essay after viewing Preview, then just hit Publish and all is good. One word of caution, you cannot immediately Publish before your essay is que'ed up in the Publisher mechanism. For example if you were set to publish at 2 pm eastern, then you cannot publish early in the hour before 2 pm eastern.
This is the way I do it. There may be an easier way. But the bottom line for me is that I have found that the Save and Continue button is your best friend when composing an essay.

Political parties don't have integrity (same as corporations). They follow their perceived interests, unfettered by considerations of right and wrong. Nobody is surprised when they engage in behavior that they would loudly condemn if somebody else did it. Both Tea-GOP and Dems provide many examples of this.

I found articles about hillary's unsecured phone
Yesterday disturbing. She requested her phone to be secure but was denied. There were comments in the emails that were released that not only did they deny her a secure phone but also they noted she left the secure building to check her emails on her blackberry. They assumed that she was just checking personal email but little did they know, she only had one account to check and it had personal and government information in it. Now, as she requested many times to have a secure phone like obama and she was denied many times, she can't claim she didn't know she was using an unsecured way of communication. This is huge in my mind.

What was the weirdest part of all that is that Hillary could have very easily used a PC or a laptop to check her email, which is what Colin Powell did, but she adamantly (it appears) to have insisted it was her blackberry or nothing.

I posted this info and articles yesterday at kos and it was pulled from view. They're gonna be blindsided when this breaks. And it better! I know msnbc and cnn are avoiding it now but, come on, the emails are proof of connections of the clinton foundation and other countries, that Blumenthal had confidential information and hillary was talking to him when Obama said he's banned, she had an agenda of business opportunities when overthrowing governments, she knew she was using an unsecured device when checking emails.....what am I missing?
I read somewhere that hillary has been very careful with her choice of words when saying that she has "not sent or received any classified material". They pointed out that classified isn't the term used for security, it's confidential. Like non confidential, top secret and so on. Hmmmm. Does classified count without adding "as confidential"? I don't know.

is a classification tier. (The lowest when I had a security clearance.)
During my career with DOD, it was,
(1) Confidential
(2) Secret
(3) Top Secret
(4) And a tier above TS, called various names, depending upon the Agency. This would be info that the President, Cabinet Members. Top Pentagon Brass, etc., would have access to.
A handful of emails that were found on FSC's server, had to do with our drone program in North Korea (or some such topic).
If there are current civilian/military DOD, State Department, etc., employees here, and this has changed--your correction would be much appreciated.

I was thinking the same thing but wondered if it could be twisted as some others agreed that "classified" was meaningless. And we know how very carefully worded statements can be misleading. It got me thinking in circles.
I forgot the North Korea thing, I feel like it had to do with their nuclear weapons site. Maybe I'm confusing it with something else.
Being able to prove she knowingly handled classified information at the time or not, there's obviously content that should disqualify her from being president IMO. Looking at her email, knowing that it's not on a secure device, and not knowing whether that email could have sensitive information when she clicks on the message.....

Here is what I do not get.
From what I have read, HRC and her staff had to go to classes, attend meetings, whatever regarding the handling of government documents. One of the things they supposedly learned was that if they receive something they think should be secure that THEY needed to classify it as such, not just say "Oh, well, it wasn't classified when I received it."
How is it that the SOS in four years never, ever received any classified/confidential/etc. materials? I am sure there must be a process where "delicate" information is handled only on paper. But really? Four years with not one piece of sensitive material slipping in? Doubtful.

Even the msm commented on it. Her initial position was that no classified info had been sent or received. Then she changed to no info Marked Classified had been sent or received.
I still say it would take a special brand of stupid to send info marked classified over the non classified network. So I'm pretty sure that either they synopsised classified info, which should have gone thru a review, or just stripped the markings & sent it, like that one email of hers directed.
And yes, confidential is still classified. It's the lowest level, but it's still a pain to handle it.

Paetreus plead guilty because they found a notebook in his desk at home with confidential government documents. This is way beyond transparency. Hillary needs to watch Forest Gump, Stupid is as stupid does. She will have plenty of time this fall to watch it. The question is will it be from her home on probation, or from government accommodations.
I was so flabbergasted by this whole thing from the
very beginning because of Rove and Petreus and Scot Walker - I just assumed that she and the Party would have a little chat and that she would decide not to run in order to spend time with the family, etc. That didn't happen. The Democrat and left wing sites attempted to tamp it down and the Conservative and right wing sites used it as an inexhaustible fuel source of outrage. IMO it's different from her other scandals because there is a there there. Half of the country makes comments and jokes about orange jumpsuits in regards to our probable candidate. Unbelievable.

I totally agree with this. Just the fact of setting up the private server after the email training she received is bad enough. Convenience to not need to carry a 2nd Blackberry -- wtf?!?!!?!?
As the emails are being revealed, we are finding out terrible things, like how she was publicly opposed to a trade agreement with Columbia but privately supported it, and how she supported deposing the democratically elected leader of Honduras so her buddies could mine the shit out of the country. How could anyone trust her after hearing that?
I really don't understand anyone who considers themselves a progressive being cool with HRC after learning this.

Look, I can understand not being a tech genius. I get that; as someone who changed majors from PC hardware repair and network administration to web design and application development, people who DON'T understand technology and how to effectively apply it keep my bills paid (or soon will).
So how, by Zeus, does such a person know that:
1. I need an email server of my own.
2. I need it in my home.
3. I need it because I don't want to use a second physical device.
NOBODY DOES THIS. Nobody. There's just no legitimate reason, ESPECIALLY if you want to keep it all secure! You'd need your very own network admin, one with actual, physical access to the hardware.
Unless Hillary was doing all the administration and maintenance tasks herself... which I promise she was not. People, these things are very technical tasks requiring specific training and a dedicated curriculum from which one learns, a curriculum nobody in her position has time for.
Which, of course, means someone other than her knows something they're not telling.

According to this article, Hillary's pal Sidney Blumenthal somehow had access to classified NSA intelligence, and was (illegally) sending her emails with these reports.

We know that Brian pagalino set it up.
He worked IT on her 2008 campaign. She then brought him with her to state - I don't know if as a contractor, gov civilian, or political appointee. He was paid 5k to set it up, which would not cover all the support for 4 years.
He was granted immunity & has been answering the fbi's questions. Now that he has immunity, congress wants him appear again - he previously took the 5th.
Initially I thought HRC said that they set up
the email on a server that was already in place for President Clinton and the Clinton Foundation. Does anyone remember that statement or is it a false memory of mine?
I always wondered how that might impact the security question. For instance would an administrator at the Clinton Foundation have a way to access the server and see what was going on at State?

Another day and another reason why I am so glad to see you writing here Phoebe.
I am going to give my perspective on this whole email thing. There are several very disturbing things about it.
1) The obvious lack of transparency. No matter what else, this smacks of both entitlement and the attempt to hide something from the public record.
2) Use of a private unsecure server to conduct government business. Not using good judgment.
3) Mixing of public and private emails. Never, never, do private business on a government account.
4) Deciding which emails to turn over to the FBI and deleting the rest. It should be up to the FBI to determine which emails were relevant. Something tells me that the private emails were not just yoga appointments, but were related to the Clinton Foundation at the very least.
No matter how innocent Clinton and her supporters try to characterize this, it is not innocent. It is secretive and a lack of good judgment at its best. And I suspect it was far worse than that.

Yes, it does all smack of entitlement and the impression that because she's Hillary Clinton the rules don't apply to her. I was struck by how after she and her lackeys were out of the State Department, that some of this unfurled because the Kerry State Department was actually trying to comply with a Benghazi request and noticed her email address and then asked her to return all emails from this address. She and her aides were apparently running interference the whole time she was in office. This is a lot of the stuff Judicial Watch wants to depose her aides about, because they were one of the groups who were stiffed on their FOIA requests.

...Obama is letting this thing play out so that she can be taken out of the race before the convention, rather than letting this explode if/when she's the nominee or the president. The thing I keep wondering is, if Obama were determined not to let the investigation come to fruition in the next few months, why wouldn't he have already had the FBI put a lid on this?

Excellent piece, whether you were prepared for publication or not! I'd like to add that I addressed Markos himself after his first edict on the fact that he wrote that the email problem was nothing. I asked how we were to give "constructive criticism" to HRC if there turned out to be a "there" there. (OK, I was a bit snarky, saying the only thing I could think of was to give her tips on telling better lies.) I got bupkus from him. Full fingers in the ears, closed eyes and singing so he doesn't have to acknowledge anything outside the reality he wishes to present. What a sad let down this has been for me, as I turned to the GOS after several other favorite Progressive blogs gave up the ghost or turned into The Huffington Post. SO glad this is now here for real Progressives. Again, great article and thanks for writing it.

John Davidson kind of "pop" music. Cracklin' Rosie - bleecchh! The stuff that the Lawrence Welk crew would do production numbers of to prove they were "hip". But the So Good! So Good! moment when he came out onto the field in Fenway has made him a folk hero to me now.

Yes, but the series ended in 1970
It was one of the longest running Westerns and spanned decades. It's sponsor was 20 Mule Team Borax the entire time I believe because Borax is mined in Death Valley. You can still find it in some grocery stores and online.
Side note -One time a few years ago I was completely mad at how outrageously expensive laundry detergent had gotten and I found a recipe for making your own which was really easy - grated Fels Naptha soap, water, Borax and any scent you wanted to add. It was very low sudsing, but it worked. I must not have been the only one, because suddenly laundry detergent got reasonably priced again.

I have often wondered why Clinton wanted her own server. I am not buying the two devices excuse. It would be far easier to keep things kosher just by having the problem of having to communicate with one or the other devices. And then she had all of the information, whatever it happened to be, stored in her server, at her home. Who was managing it? Was it Tempested? Why did she want to keep all of the correspondence? Was it hacked? Did she plan on using the information at a later date? To what end? Is there information on there that corresponds to deal making involving The Clinton Foundation, amounting to a private Chamber of Commerce op running out of the State Dept? Is it insurance? I’d like to know, and so would a lot of other people.
The simple answer is they don't know and they don't care

The key point to me
is that there are checks and balances when a government official uses a government server. That official can't unilaterally delete content and then wipe the server.
Clinton did both of those things with her private server. And we just have to "trust her" that she didn't delete any content that was work related.
Even with a person that everybody considers to be trustworthy, this is not the way government transparency should work.

The whole point of HAVING a private server AFAIK is to
have the ability to wipe the server.
Wiping a server means that there is stuff you want to bury very deep. Consider that Clinton's aides had clintonmail addresses as well as government accounts. To me, that means they had a closed loop of communication within a single server. If they had yahoo addresses or google addresses or any other provider addresses, their communications would exist on another server as well that could have been subject to subpoenas, etc. in a court case and there would have been no way that anyone would be able to get an outside provider to wipe their server on your behalf - just not happening.
That's one reason why the Blumenthal emails from an aol server can be matched against the Clinton server. If her server doesn't contain all the emails that his does, that would be a thing that would make someone go hmmmm.

There are some articles out there that have compared this years election to 1968. They say Bernie is McCarthy, Trump is Wallace. Then they say Hillary is Humphrey. But I think they may have it wrong. Hillary may in fact be Nixon.
