This was not a decision on the appeal
The Becks have not won their appeal yet. This was a procedural order that allowed the appeal process to continue. Here's an explanation I posted last week in the Evening Blues for Thursday:

No discovery yet
They haven't won the right to proceed with the suit. They've won the right to proceed with the appeal.
At this point, the lawsuit remains "on hold" until the appellate court decides whether to overturn Judge Zloch's order dismissing the case. Unless and until that happens, nothing else can be done in the lawsuit, including discovery. If the Becks lose the appeal, the case will be over and there will never be any discovery.
This is all technical legalese, which is notoriously confusing, especially the procedural parts.

finding, next to last sentence. I know exactly what it means.
