WSJ: Ongoing FBI Investigation of Clinton Foundation Impacting Comey's Latest Actions

The Wall Street Journal's out with multiple stories, today, discussing the fact that there's substantial unrest within the FBI relating, in large part, to an ongoing investigation concerning the activities of the Clinton Foundation, above and beyond the John Podesta emails/Hillary Clinton email server story. Just by reading today's articles, it's becoming quite obvious (at least to this reader) that a significant portion of this entire, over-arching story, relates to the November 11, 2011 Doug Band memo, disclosed in the next-to-last Wikileaks dump, which I featured in my last post here, October 27th.

Here's an excerpt of the first of two articles in today's WSJ (various other MSM outlets are covering multiple, interrelated stories this morning)...

...A spokeswoman for the FBI’s New York field office referred questions to the FBI’s National Press Office. Officials there did not respond to an email seeking comment Sunday evening.

A Clinton Foundation official said, “We are not aware of any investigation into the Foundation by the Department of Justice, Federal Bureau of Investigation, or any United States Attorney’s Office and we have not received a subpoena from any of those agencies.”

A spokesman for the Clinton campaign did not immediately return a phone call and email seeking comment...

...recently, the foundation’s internal strife has been laid bare in the disclosures that appeared on the WikiLeaks website.

For example, WikiLeaks has published emails and documents that exposed a brewing feud in 2011 between Doug Band, a foundation official who had formed a consulting firm called Teneo, and Chelsea Clinton, who was taking a stronger role in leading the foundation.

The emails revealed details about the mix between foundation activities, the Clintons’ personal income and Teneo’s rapid growth. A 2011 memo from Band to foundation lawyers laid out the role that Band played building the business and asking his corporate clients to contribute to the foundation and provide opportunities for Bill Clinton to make paid speeches.

A Clinton Foundation inquiry would be completely separate from the FBI’s probe into Clinton’s use of a private email server while she was secretary of state — an investigation that was ostensibly ended in July without charges for anyone, before Comey said in his recent letter there were new emails investigators wanted to examine.

At a congressional hearing in July over the email investigation, Comey notably declined to say whether agents had looked at the Clinton Foundation.

“I’m not going to comment on the existence or nonexistence of any other investigations,” Comey said.

When Rep. Jason Chaffetz (R-Utah) asked if the Clinton Foundation was “tied into” the email probe, Comey responded, “I’m not going to answer that.”

So, while the previously-excerpted article does mention the Clinton Foundation investigation rather extensively, it's the WSJ story from earlier Sunday evening, which mentions the Foundation no less than 15 times in which the reporter tells us: a.) the Clinton Foundation is/was under investigation by the FBI as recently as just a few weeks ago; and, b.) it's that entity which is, in large part, at the heart of the FBI's "Internal Feud Over the the Hillary Clinton Probe."...

...According to a person familiar with the probes, on Aug. 12, a senior Justice Department official called Mr. McCabe to voice his displeasure at finding that New York FBI agents were still openly pursuing the Clinton Foundation probe during the election season. Mr. McCabe said agents still had the authority to pursue the issue as long as they didn’t use overt methods requiring Justice Department approvals.

The Justice Department official was “very pissed off,” according to one person close to Mr. McCabe, and pressed him to explain why the FBI was still chasing a matter the department considered dormant. Others said the Justice Department was simply trying to make sure FBI agents were following longstanding policy not to make overt investigative moves that could be seen as trying to influence an election. Those rules discourage investigators from making any such moves before a primary or general election, and, at a minimum, checking with anticorruption prosecutors before doing so.

“Are you telling me that I need to shut down a validly predicated investigation?” Mr. McCabe asked, according to people familiar with the conversation. After a pause, the official replied, “Of course not,” these people said.

For Mr. McCabe’s defenders, the exchange showed how he was stuck between an FBI office eager to pour more resources into a case and Justice Department prosecutors who didn’t think much of the case, one person said. Those people said that following the call, Mr. McCabe reiterated past instructions to FBI agents that they were to keep pursuing the work within the authority they had...

...For agents who already felt uneasy about FBI leadership’s handling of the Clinton Foundation case, the moment only deepened their concerns, these people said. For those who felt the probe hadn’t yet found significant evidence of criminal conduct, the leadership’s approach was the right response.

In September, agents on the foundation case asked to see the emails contained on non-government laptops that had been searched as part of the Clinton email case, but that request was rejected by prosecutors at the Eastern District of New York, in Brooklyn. Those emails were given to the FBI based on grants of partial immunity and limited-use agreements, meaning agents could only use them for the purpose of investigating possible mishandling of classified information.

Some FBI agents were dissatisfied with that answer, and asked for permission to make a similar request to federal prosecutors in Manhattan, according to people familiar with the matter. Mr. McCabe, these people said, told them no and added that they couldn’t “go prosecutor-shopping.”

Not long after that discussion, FBI agents informed the bureau’s leaders about the Weiner laptop, prompting Mr. Comey’s disclosure to Congress and setting off the furor that promises to consume the final days of a tumultuous campaign.

Obviously, the Doug Band memo from November 2011 (see link to my previous post here, up above) really is at least one of the biggest "smoking guns" here, to the point where I'd call even that strong term an understatement.

After Terry handed McCabe's wife more than half a million, McCabe was looking pretty bad. He has now ratted out DOJ in an attempt to exonerate himself.

What we need now is for an honest DOJ career person to expose how and why Justice sabotaged both the email and the Foundation investigations. Then the unraveling can begin in earnest.

Bill didn't go onto that plane to pressure Lynch. He went on to thank her for a job well done.

I'm deeply disturbed by the number of people, including my own mother, who are falling in line with the Hillary campaign narrative of "Oh, terrible Trump, we must prevent Trump from getting in. Oh, those people are so deplorable."

It's reminding me of Stanley Milgram's famous experiment: they don't want to keep pushing the button and delivering the shock, but they do, because an authority figure tells them that they must. Or, more accurately, because an authority figure tells them there's a Really Bad Guy standing there that they have to stop.

Now, that said, I see a lot more Trump support, in terms of signs and people w/t-shirts, than I do Clinton support; I think Trump's supporters are more enthusiastic, by a long shot. But I'm actually incredibly creeped out at the spectacle of people I've known for years falling in line, not just with Hillary, but with a narrative handed down from on high. It's like their critical thinking skills have become beside the point. They haven't lost them; they just don't listen to them.

Knowing that the passive electorate, so beaten down by economic crisis, under and un-employment, police harassment and debt slavery, has accepted as the norm a two-party duopoly, the Clinton mafia drove a nasty bargain the whole way.

1. They've been laying the groundwork for decades for Her run, and after the sting of losing last time, clamped the hatches down hard this time. An air of fait accompli filled the Party and everyone was told to get in line...or else. Especially those who went against Her last time. Their vindictiveness, resulting in keeping ledgers worth of recorded transgressions, perceived or imagined, for everyone who they thought stiffed them, is legendary. Repayment time was a big factor. In the hermetically-sealed bubble of Beltway Boneheads this seemed perfectly normal to those jettisoning their conscience in order to get in the Hills bandwagon.

2. They then gathered up packs of attack dogs from every conceivable angle, put them on the payroll and had them lash out at the Commie Sanders, who was messing up the program by drawing massive crowds, winning overwhelmingly the youth vote and generating historical levels of small donations and volunteers. He was embarrassing her in every way.

3. When that didn't work they knew that had to work the refs, by greasing some palms and twisting some arms, which they did do effectively for "endorsements," of local Dem election boards to fudge the numbers (in 2008 on district in Harlem, registered votes only for Clinton, none for Obama).

4. When a roar of dissent began gathering they laid it on thick with accusations of "conspiracy theorists" and charges of sexism, racism and any other lame and weak disparagements.

5. After they ignobly trashed Sanders supporters at the Convention, they put on a saccharine Disneyfied xenophobic, militaristic and quite frankly fascist show of support for Her Majesty, by padding the stands and threatening opposition inside. Its purpose was to entice RW voters who respond to the military displays, lots of flags and chants of "USA!"

6. Next to the trouncing of the little people challengers. Most people don't know about 3rd parties, because the media colludes with the duopoly to keep the stars quo. To top that off, they viciously disparage any challenge from the Left.

6. They continue stomp their feet and bark threats, demanding the media concentrates solely on Trump, the GOP Frankenstein, to make up for all the free coverage they gave him. Fear, panic and irrationality dominate the media, the Democratic Party and over course the lemmings who go the MSM for their worldview. That's take us up right to now...

The tactics the whole way were so transparent, pathetic and desperate, for anyone to see with half a brain. The revelations about cheating and collusion were laid bare too, if you cared to look.

Yet, they still have not managed to put away the worst candidate ever seen in politics. What's that saying about who they really are? The long litany of abuses, lies, malfeasance, arrogance, hubris, entitlement, corruption just keeps getting longer. There's some serious karma coming to bear right now on these folks with this latest development.

Seems to me it all comes down to that the electorate are both so beaten down in so many ways and so gullible to propaganda, that they naturally respond like helpless, irrationally fearful children. Rather than informed citizens who should be in the driver's seat of delivering a potentially fatal blow to the Democratic Party when one has in all likelihood has been given, or at least a serious knockdown punch has, to the Repugs, by voting 3rd party.

So sad and depressing that we're all encountering loved ones and friends who can't think straight from being bitten by the rabid dogs of fear. Same for me RA and CStS. One thing we know for sure, and maybe it will be the difference, is that a very large majority of folks are disgusted beyond belief with the election and may just in the end decide to do something different for a change.

This weekend, two highly educated friends came to visit and both said they were voting for Hillary. I tried to explain to them why I could never vote for her because she is such a hawk. And they were in disbelief that she was the one who is promoting the expansion of the wars in the Middle East. One even suggested that maybe she feels the need to show her toughness because she is a woman. I said that was not the case. That she had a long history of being pro regime change. Then the Trump boogey man issue was raised and they were shocked when I said that I thought as far as wars, Trump would be the better choice. It was obviously that we were getting no where in the discussion and the weekend was just starting so we switched the topic to lighter subjects.

I guess this Kallstrom ex-fbi guy made a second career out of head talking on right wing outlets like Fox News, never heard of him until now. Is he a crank? How I came to agree I don't really know. Truth, is that the intended thought production? The more I learn the less I know, or something.

Kallstrom says that the FBI rank and file agents are all good people and can be trusted. It's just Comey and the leadership that is tainted (paraphrased). Maybe one of the 'good' agents will leak the truth about what is going on at the Bureau.

Really the appointed heads of departments are figure heads that will dictate a bunch of stuff and try to rearrange stuff when they start. They come and go while the people who actually do the work remain for 20 or 30 years.

At least where I worked the political appointments had no affect on how we did our jobs or what we thought in the course of carrying out our job. In fact we had very little respect for their authority.

He explains that the Clinton Foundation had “engaged an array of fundraising consultants” over the past decade but “these engagements have not resulted in significant new dollars for the Foundation.” In other words, it wasn’t working as a conventional charity.

Mr. Band then explains how he and his Teneo partner Declan Kelly had to carry the fundraising load, and did so by packaging foundation solicitations with other services such as a meeting with Bill Clinton, $450,000 speeches or strategic advice. Many of the donations, from U.S. companies like Coca-Cola and Dow Chemical and foreign firms like UBS and Barclays, occurred while Hillary Clinton was Secretary of State.

Why exactly were donors writing checks? The Band memo makes clear that donations untied to additional Clinton or Teneo services weren’t all that appealing to potential supporters. This is significant, because the large grant-making foundations in the U.S. are almost entirely run by Clinton voters. So you know they weren’t turned off by the brand name. They’d contribute more if they thought they were also buying goodwill and influence with a current Secretary of State and a potential future President.

McCabe may be a little late in his newfound "independence". His conversion to being a "good guy" comes only after WSJ and others revealed the double McCabe bribe: Dr. Jill McCabe on the front end and Andy McCabe on the backend. If Trump wins, Andy, you and the Weasel will find your remedial actions have come too late. And Lyin' Loretta will become a jailhouse lawyer also.

It's been quite interesting to watch all the different configurations of offense/defense being attempted by team Clinton as well as the interactions between the DOJ and the FBI during this entire fiasco of everything regarding the 3 entwined issues: the server, mishandling classified information and potential/possible influence peddling between Hillary as SOS and as a family member/beneficiary of the Clinton Foundation.

As always in situations like this, it's the unexpected that brings down the best laid plans of mice and men and women - Huma's cache of thousands of emails turning up unexpectedly in the unrelated investigation of her husbands misdeeds was the lose nail in the shoe of the horse that felled the horse and threw the soldier that lost the battle that lost the war that lost the realm.

How ironic is it that despite the best efforts of the DOJ and the FBI Director to previously tamp down, defuse and make go away the server/National Security issues that something unignorable literally gets dumped into their lap at the last possible moment?

He got an email "from Google" saying someone had used his password to try to access his account so he needed to immediately change his password. The way I saw it worded was questionable on the surface. If someone used his password, how did Google know it wasn't him? Anyway, he clicked the link to go change his password which started a script that captured what he typed in.

I also read elsewhere that an assistant forwarded the message to the Clinton "IT Team" and the IT people said it was legit. Don't know for sure if that is true.

Although it is generally stupid, people fall for these things every day. A reminder to everyone to be careful.

If Podesta had gone to gmail through the address bar in his browser, and then changed his password, rather than clicking the link in the email to get there, he'd be fine. A practice I hope everyone here has.

different from your regular one. Whenever I use a VPN, my periodic check of emails will generate a Gmail email.

It's necessary to check the return email address or the URL of the website where the email is sending you. That's where you can see that it's not really Google.

Anything trying to get your password from you or with an attachment you're being urged to open is a red alert.

You'd think that someone handling so much information that should not be made public (from the point of view of Podesta) would be a little more aware of a threat that's been around for 20 years.

Of course, he might have been acting, but the impression he gave was that even though everyone else in the US and the rest of the world knew about the dikileaks he was just hearing about it. (Biden said we didn't know where these new emails came from and the interviewer told him from Anthony Weiner's laptop an Joe covered his face and groaned like it was news to him.)

trotting out former DOJ officials (who are openly supporting the Clinton campaign nonetheless) about how Comey is ignoring FBI rules that have been around since the Earth was formed - or something - and how that constitutes meddling in the election. NPR this morning has been full of these shills!

Hardly a mention about the fact that Clinton did NOT turn over ALL her emails as required and about the fact that now all these newly discovered emails are on devices formerly in possession of her closest aide.

God, this is such a unbelievable election! Rather than talking issues that the nation is and will be facing we are talking the Clinton Foundation, mishandling of state secrets and Trump's own financial machinations and foul mouth. How low can we go?

Would you be okay with George Bush having an illegal server as SoS, and a foundation receiving millions from foreign governments and weapons industries while he was okaying arms sales, then destroying his emails so the public would never see them? While under court order to turn them over? Tell me how okay you are with this, once the name is Bush instead of Clinton, so you can admit you have turned into a pro-choice republican, which is essentially what the Democratic party has become."

serving her heinous and their corporate masters. What's in it for them? Big bucks. Big jobs.They will be the decision makers in the fall of our society. They will be the decision makers in the fall of America. We can look to these people as the destroyers of the life we know. Maybe that's not a bad thing.
