Keith Scott Shooting - Did Charlotte Cops plant the gun they claim he had?

As many of you are well aware, Keith Scott, a father of seven was shot and killed by Charlotte police on September 20, 2016.

The police claimed that Mr. Scott was holding a gun when he got out of his car, refused their orders to drop the alleged handgun, and had to be shot because he posed "an imminent, deadly threat" to them. The family has denied the claim that Scott was holding a gun. Charlotte Police Chief Putney has refused to release police video of the incident to the public, claiming he cannot do so under state law, though the ACLU has challenged his position. Chief Putney also claims that he has no evidence to show the shooting was unjustified, even though ...

[T]he videos he has seen don't show "absolute, definitive, visual evidence" that Scott pointed a gun at the officers.

Justin Bamberg, an attorney for the Scott family who also watched the police videos, said they fail to prove that he was armed. Scott can be seen in the video calmly walking back after he was approached by police, according to Bamberg.

"It is impossible to discern from the videos what, if anything, Mr. Scott is holding in his hands," he said in a statement.

An image of Mr Scott lying on the ground surrounded by police has been circulating on social media, which supporters of the police have claimed shows a handgun lying at the feet of Mr. Scott. Here is that image as posted on the website of The Charlotte Observer:

The image is blurred and not definitive in my mind, but Chief Putney himself has relied on this image to support his claim there was a gun at the scene of Scott's killing:

Putney said that the image, which police acquired through routine monitoring of social media, appeared to be genuine and un-retouched. It shows what appears to be a handgun on the pavement at Scott’s feet.

One thing I wish to point out. This image, which purports to show a gun a Keith Scott's feet, was taken after police had established a perimeter around the "crime scene" as you can can clearly see yellow police tape in the foreground between whoever took the picture and the police and Mr. Scott's body. It is unclear how much time has passed since Scott was shot and killed and this image was taken, but it seems apparent that this is not a picture of the scene.

Yesterday, the family of Mr. Scott released video from his wife's mobile phone, which was taken just prior to and after the shooting. It's a harrowing and frankly disturbing video, which can be viewed at NPR, at NBC and other news sites online, including the New York Times:

Ms. Scott left their apartment to bring Mr. Scott a cellphone charger, the lawyers said, when she saw the officers around him and began recording the scene on her phone.

The Police Department has said that officers saw Mr. Scott, who was black, standing beside his S.U.V. holding a handgun, then saw him get into the vehicle.

The video, which lasts 2 minutes 12 seconds, begins with shaking images of grass and the voice, apparently that of an officer, shouting, “Hands up!”

Immediately, Ms. Scott said, “Don’t shoot him,” and began walking closer to the officers and Mr. Scott’s vehicle. “Don’t shoot him. He has no weapon. He has no weapon. Don’t shoot him.”

An officer can then be heard yelling: “Gun. Gun. Drop the gun.” A police S.U.V. with lights flashing arrived, partly obscuring Ms. Scott’s view, and a uniformed officer got out. From that point, there are five officers, most of whom appeared to be wearing body armor over plain clothes, around Mr. Scott.

“Don’t shoot him, don’t shoot him,” Ms. Scott pleaded, her voice becoming louder and more anxious. “He didn’t do anything.”

Officers continued to yell “drop the gun” or some variation of it — at least 12 times in 38 seconds.

“He doesn’t have a gun,” Ms. Scott said. “He has a T.B.I.” — an abbreviation for a traumatic brain injury the lawyers said Mr. Scott sustained in a motorcycle accident in November. “He’s not going to do anything to you guys. He just took his medicine.”

“Drop the gun,” an officer screamed again as Ms. Scott tried to explain her husband’s condition. The officer then said he needed to get a baton.

“Keith don’t let them break the windows. Come on out the car,” Ms. Scott said, as the video showed an officer approaching Mr. Scott’s vehicle.

What happens next is that you hear gunshots being fired at the 50 second mark of the video (as posted at NPR). Ms. Scott moved toward the death scene, and continues recording. Within seconds her video shows Mr. Scott on the ground surrounded by what appears to be four police officers, two of whom are bending over his body. It was at this point I stopped the video and took a screenshot at the 1:14 point, 24 seconds after you hear the gun shots that killed Keith Scott, her husband. Here is the image I captured as shown by Ms. Scott's cell phone:

Please take note that this image was taken moments after Keith Scott was gunned down, and before the Charlotte-Mecklenberg Police (CMPD) had secured the scene. Do you see anything that looks like a gun lying at Mr. Scott's feet? I do not. There is no image of any object, blurred or not, at Mr. Scott's feet, much less one that resembles a gun.

Now compare it again with the image taken after the scene was secured and yellow tape put up that has circulated widely on social media, and which police sympathizers have relied upon to prove Scott had a gun.

Now some have claimed that the angle of the two images, the one in Ms. Scott's video and the later image that shows the secured scene, are different, and that the officer wearing a red shirt was actually standing over the gun to protect it.

Jim Cavanaugh, a retired ATF agent, told MSNBC later on Friday that it seemed likely to him that the officer in the red shirt was intentionally standing right over the handgun to guard it.

So I took another screen capture from Ms. Scott's video at the 1:30 mark which gives the viewer a good look at where the officer in red was standing. Here it is:

Again I see no gun or other object between the legs of the officer in red, a mere 40 seconds after the shooting. Between 1:30 and 1:32 of Ms. Scott's video, the officer in red takes a step toward Keith Scott's body with his right foot. Look carefully. I see no gun or other object revealed to have been hidden between his feet after he makes that movement. At other times both before the 1:30 mark and after it, the same officer makes various movements away from that "standing position" that do not appear to support any theory that he was standing over the gun to protect it.

I've watched the video countless times now. Why the gun would need protection in any case, when so many officers were at the scene, is beyond me. I would think they would avoid standing near the weapon that supports their contention Keith Scott was holding a handgun when he was killed by one of their officers so as not to contaminate the scene. But what do I know?

To be honest, these two conflicting images of the scene, one before the yellow tape went up and one after, suggest to me two possibilities besides the official police narrative. Either the image purportedly made by a witness that is circulating on social media was faked or the gun was planted there by the police after the scene was secured and Ms. Scott no longer had access to record.

Now the CMPD and Chief Putney could help clear this up by releasing the videos they have of the officers' encounter with Keith Scott and by releasing any photographs of this alleged gun at the scene. Because if there was a gun at the scene, we know that the police forensics team took photographs of it, photographs that would be time stamped and dated, and which would show the exact position of the gun police claimed that Mr. Scott was "brandishing" at them, thus justifying the officer who fired his weapon at Keith Scott, killing him. To date however, they have refused to do so. Make of that what you will.

But it is consistent with what analysis of the wife's video showed - a pair of black gloves falling to the ground. If you look at the "gun" I believe you can see what is consistent with one of the fingers in a glove.

As many pictures have shown there wasn't a gun on the ground at first and the guy in the red shirt is further away from Scott.
The picture that shows a possible gun, the red shirt guy is next to Scott who appears to have had his pants pulled down.
WTF was the reason for pulling his pants down like that in public for everyone to see?
I understand that the cops were in the area to serve a warrant on someone else, so what was the reason why they approached Scott instead?
Anyone know?

I had to watch the video you linked to 3 times to even figure out where the victim actually came from. At first I thought guy in red who looks like he's wearing some type of industrial protective mask you'd wear in a manufacturing plant was the one trying to break the vehicle glass, but he's using the truck for cover from his buddies with guns. I looked at the wrong vehicle twice before I realized that the victim was in a totally different vehicle.

And I am upset that the cops are being trained by Israel's Military!
What is the reason for them to be trained by another country's military?
And why is every peaceful protest met by the riot police? The protests are usually being non violent until the cops in their riot gear show up.
Look at how they were pointing weapons at people who were only standing there.
And remember that picture of 10 or more cops pointing their rifles at the one person who was just standing there?
It's my opinion that the reason why they militarized the police was to get around Posse Comitaus.

I was asking why our police are being trained by the Israeli military and I have found the reason,

Since 9/11, cops have been traveling abroad to learn from one of the most repressive and dangerous State forces in the world today—the Israeli military and intelligence apparatus.
The purported reason is counterterrorism, but protests and crowd control methods are commonly discussed.

The article also talks about the militarization of the police which has increased under the Obama administration, of course.
As we know, what happens during wars usually happens at home too.
Obama told us that he was rolling back the transfer of military equipment to police forces but he really didn't do too much. Stopped sending them bayonets and a few other items, but the more damaging equipment is still being transferred like the LRAD which can make people lose their hearing and the microwave device that will heat up people's skin.

I wrote about how it's the cops that are the ones who make the protests become violent and this article backs me up.
It's done on purpose so that people know that if they ever think of rising up against the government that the police are quite ready and willing to put any uprising down.
They practiced on OWS and are honing their skills on the BLM protests and half of the people in this country are cheering on the police brutality because they are going after Thugs and Looters

There is no other reason for them to not show it and it totally defeats the purpose of having body and dash cams. You release it ALL the time as an impartial presentation of events. Where is this crucial piece of evidence? Fingerprints on it?

If you look at the cast shadow from the street sign or what ever it is, the space between it and Mr. Scott is empty in the wife's video, and the black object (gun/glove?) is nowhere to be seen. Mr. Scott's body hasn't moved in relation to the Ford Explorer or whatever that vehicle is in the upper left of each view.

By the way, why did they pull his blue pants off?

If you look at the photo from Mrs. Scott's video, there's nothing. If you look at the photo with the police tape, the object appears to be about 1 foot from Mr. Scott's feet (using the size of Mr. Scott's feet for prospective). I believe it was Van Jones who said last night on CNN that it's not uncommon for there to be "dropped guns." Wonder why no one trusts the cops. Has anyone mentioned whether that gun was registered? If so, to whom?

And I also want to know why it was necessary to remove Mr. Scott's pants right out in public like that. Were they rendering first aid? (read: snark) Where is the ambulance Mrs. Scott called for?

And the saddest part is that the cops were there to take care of an unrelated issue. Why they decided it was Mr. Scott's time to die is unknown.

Every cop carries a throw down gun, usually taken from some punk who didn't do anything to get arrested. This way, when a shooting is iffy, they have cover for the action they took. We all know cops have a license to kill, especially when confronted with deadly force.

The only problem is when they are confronted by a disabled man in a wheelchair. But they usually get away with that also, even if he didn't pack heat.

No I don't think that's a gun and if it is it's most likely a throw down. Why is killing black people by the militarized thug cops still going on with no end in site. Barber calls out trump but I hear nothing from the Democrat's about reining in the armed and dangerous killer cops. Or a death sentence should be enacted? Besides, people are always getting shot, for instance, after explaining that they're reaching for their license, for complying with police orders. Funny, they always seem to be people with darker skins, or very poor/homeless/mentally ill - those most perceived by their killers as being vulnerable and least able to defend themselves or have survivors raise a ruckus.

Pardon us for getting upset about just another routine murder by police - it shouldn't bother us a bit!

That cops yell gun, gun, when there is no gun as an excuse when they later shoot the guy and then plant a gun. The man was in his car at the beginning of his video when they begin yelling gun, with the window rolled up. In fact you can clearly hear one of the cop yelling for his "fucking baton" so he can smash the car window in. Watch the entire video, and you can hear his wife say he has no gun, and pleading with him to get out of the car so they don't break the window. Now if they really believed he had a gun, why would they risk their lives to get close enough to an armed man to smash the window to his truck to get at an armed man? It makes no sense. If he is in his car with a gun you surround the car and wait him out.

Possession of marijuana played a significant role in the police killing of Keith Lamont Scott on Tuesday. Charlotte-Mecklenburg Police Department Chief Kerry Putney said during a news conference that officers were trying to serve a warrant for someone else when they spotted Scott rolling “what they believed to be a marijuana ‘blunt’ ” in his car. At first they allegedly didn’t think much of it, until they saw Scott had a weapon and thought, “uh oh, this is a safety issue for us and the public,” Putney said.

If this is true, then why has it taken so long for them to say this? Why didn't they release this information on the day of the incident?

The official police statement says officers “gave clear, loud and repeated verbal commands to drop the gun,” but Scott “refused to follow the officers repeated verbal commands.” And then Scott “exited the vehicle with the gun and backed away from the vehicle while continuing to ignore officers’ repeated loud verbal commands to drop the gun.” That was seen as “an imminent physical threat” and an officer opened fire. A lab analysis “revealed the presence of Mr. Scott’s DNA and his fingerprints” on the gun that was loaded, notes the police statement.

If anyone has seen the Twitter video, it shows Scott walking backwards with his hands at his sides and not pointing the 'gun' at anyone. Just because if he had a gun in his hands shouldn't qualify as being a threat to the cops.

They evidently hadn't come up with the cover story at the time. And then had to get the poor guys DNA and fingerprints on the gun, which wasn't easy because it had been invisible for some time, as can be seen in video upthread, and therefore had to be located in some officer's possession - an officer who may not even have been present to drop an actual gun at the scene to show in pictures widely showing the area in which it was claimed to have been dropped by the book-armed victim.

The poor guy was probably too terrified to speak or come near these murderers. I'd probably be, too.

Why would a Black man in the US want to get out of his car when a whole group of police - for no reason? why approach him to begin with? I wonder if they'd had Israeli anti-terrorist/anti-Palestinian-teenager-type training or were recycled Army with PTSD? If so, the department's also at fault and I hope they get sued right out from under their roof.

But this happens right throughout the US because there's no culture of public service, more a propaganda-instilled 'them against us/us against them' division between so many groups, especially dangerous in the public service. Police forces are a civil service group, essential civilian serve-and-protect, only they aren't protecting many Americans against themselves.

Until this sort of cover-up attempt nonsense is stopped, this won't. This was yet another bald-faced murder, among an endless stream, and right in front of the poor man's wife! By the freaking police they pay to protect them! And I gather right in front of his own house, with his son expected shortly and probably walking right into the scene of his father's murder by police.

This is forensically fairly easy to ascertain that the black object is about 18 inches to the left of two pieces of paper on the cement. One piece of paper is to the right of Mr. Scott's shoe, the other is nearer the curb, partially hidden by a pine branch (see the first (top) illustration.

The police in the red shirt, who is supposedly hiding a gun with his foot, is straddling the line made between those two pieces of paper in image two and four.

Here (embedded) is another eye witness video from a different angle.

I just thought of something I hadn't previously considered. It was said that the cops saw Mr. Scott enter his vehicle carrying what they thought was a gun. That's supposedly why they went after him. After yelling "drop the gun" numerous times, one cop took a bat right up to the vehicle to break the window to get Mr. Scott to get out. Now, call me dumb, but if I thought someone had a gun, I wouldn't go after his vehicle window with a bat. They had to include the part about the window because Mrs. Scott told her husband to get out of the vehicle because she didn't want the cop to break the window, and that's heard on her video.

Comments at that youtube video say that the dropped item is a black latex glove. When it is first dropped it does appear like it floats a bit like a glove in air. But it still believe the gun was planted and it was an execution by cops. The slow release of videos by cops was pretty telling. And they still have not released all video -- even as the city burned.

Were there two objects dropped? Could have sworn that something was dropped further back and bounced more to the front but I'll have to look again with hopefully less blurry vision this time. Gloves wouldn't bounce - but it would be feasible for the guy tossing the gun down to also have a glove to pass, to keep police fingerprints off it. And the glove should have been wrapped over the gun, obviously, so as to be able to release both without adding evidence of this, because I don't recall seeing gloves on any of the cops, (I tried to check for those on at least those officers in the videos with the red-jacket guy) it being warm and all.

Speaking of evidence, isn't dropping stuff all over a crime scene (as it would be either way) rather a no- no?

Pretty sure the object claimed to be a gun in a picture looked to me a black soft leather something, glove being an excellent fit for it, folded under a bit on one side. It also appeared to me to be rather flat in relation to stuff in the picture and rather randomly lumpy. On the other hand, I am often wrong and keep developing blurred vision from absolutely not crying - but this must be what the more aware people in Nazi Germany felt, as various identifiable groups were abused and murdered freely... helpless, horrified and utterly heartbroken.

The American nightmare, within and without, comes to the world, in videos as well as jets and drones... and my heart is with you all. (Except for those responsible and cooperating, of course!)

If they do not want to immediately show any official police video evidence, you know that it implicates, rather than clears, the police involved in this.

That object appeared to bounce in a dropped-gun-like manner. (And it would have been funny, had it gone off and hit him.) The object on the ground in a previous video looked like a soft black leather glove, the sort you'd want to handle a throw-away weapon you were planting on someone with. But if the officer picking it up placed it in an evidence bag after ensuring that the victim's finger-prints and DNA were on it, it would all work out. Or a dirty coroner could simply adjust the paperwork to claim that the victim's finger-prints and DNA were on it. (Yes, we've all at least read detective stories/watched something like Quincy in our distant youth - if anyone here actually remembers Quincy?) Barring multiple witnesses and videocams.

But as has been pointed out up-thread, in an open-carry state, what does the mere presence of an unfired book gun he pointed at nobody have to do with anything anyway?

Here is second 51 of the video taken by Keith Scott's wife. This is less than a second before they opened fire. He has his back to the police shooter to the cop to the left and his side/back to the cop in the red. His hands are down, in no threatening position. making no threatening gestures or sounds. He wasn't even looking at the cops. Clearly an execution.

In later career, I transitioned to family law, have represented cops or spouses of cops so numerous, it boggles the mind.
The measure of murder or self defense on camera is the blink of an eye. The "gun" on the ground and it's weight and measure, whether it can bounce with measurable force, fingerprints, even the possible scrape on the sidewalk/street, how much finish of the gun was scraped off, how much of the surface of the street was measured, angles of scrapes, from afar (throw), or upright drop,(cop dropping) , his drop/throw statistics of the gun being there and in that position and on and on and my head hurts, my heart is just about crushed, from what I have seen above.

I've seen countless videos of pat downs (both w/ handcuffed person standing and prone), but I have never, ever seen them pull a person's pants down. There is no need for it. I know the pants sometimes fall down (not the case here), and I've seen them try to pull them back up, actually; but why pull them down?

I know the bigger question is why did they kill this man, but when I saw the pics in the essay, it was my first thought - why did they pull down his pants?

cops are questionable sources. According to a psychologist I worked for, the psychological evaluations he did on many cops weren't much different from the ones he did on criminals. Our cops don't have to go to Israel, or any other country, to learn sadism. This situation has been a learning experience for me. I never knew that cops planted guns or that they yelled "drop the gun" so that others viewing the incident would believe there WAS a gun. I wonder if they planted the marijuana also.
