State Dept. Withheld Key Email From Clinton’s Private Server in FOIA Lawsuit

The State Department has now acknowledged that it withheld a key Benghazi e-mail in response to a Freedom of Information Act (FOIA) request filed in July 2014. The State Department acknowledged finding the e-mail in 2014, but it was withheld in its entirety until last week.

This latest admission comes in a FOIA lawsuit filed by Judicial Watch, a conservative legal watchdog group, that seeks records related to the drafting and use of the Benghazi talking points. According to Judicial Watch, it contradicts an earlier admission made by the State Department in the same lawsuit. In a letter dated April 18, 2016, the State Department writes:

Also, upon further review, the Department has determined that one document previously withheld in full in our letter dated November 12, 2014 may now be released in part.

The document in question is an e-mail from then Deputy Chief of Staff Jake Sullivan addressed to Hillary Clinton concerning Benghazi talking points to be used in discussions with Senators. Although redacted almost in its entirety, the e-mail is important because it contains Clinton’s private e-mail server address, hdr22@clintonemail.com. Had the State Department disclosed the e-mail at the time of the 2014 FOIA request, it would have exposed Clinton’s use of a private e-mail server to conduct official State Department business in the early fall of 2014. The timing is significant because the disclosure would have occurred several months before the Clinton campaign says she deleted several thousand “personal” e-mails.

7:05 p.m. UPDATE:

In a statement to LawNewz.com on Tuesday evening, Judicial Watch President Tom Fitton said, “The State Department can’t keep track of its cover-ups.” Fitton added, ” These changing stories are why two federal court judges granted us discovery.”

And because of all this, now we've got to deal with Trump!

I still think that whole thing was completely contrived, and that nobody had a clue how popular he was going to be, least of all, him. I seriously wonder if he's having second thoughts. The bits about Bernie being cheated? The most obvious conclusion is that he wants Sanders to go third-party to split the Hillary vote--or at least, that's the obvious conclusion being drawn by what few Clinton supporters I can get on the record. If that's the case, why doesn't he, Trump, go Indie? Oh, he wouldn't want to split the vote and have it benefit Clinton?

Fascinating, to consider all this in such a context, isn't it?

is if started making noises about asking Sanders to be his running mate as they are both "Outsiders". I honestly wouldn't put it past Trump to pull such a move. He knows what kind of media attention that would get him.

I am quite positive Bernie would never accept that, but damn, if he did? That would be the most bizarro world story ever, lol!. (Then Trump could resign and be done with it and get to go back to exploiting his name for profit, which I think his whole run was about in the first place. A way to better build his brand and sell some more books.)

Dear FBI, the Democratic Party’s Future Rests Upon Your Investigation of Clinton’s Emails

H. A. Goodman

To the Honorable James B. Comey, Jr. and all the good people at the Federal Bureau of Investigation,

The majority of the Democratic Party does not believe there is an ongoing FBI criminal investigation regarding Hillary Clinton’s emails. They believe, as the former Secretary of State has told them, that your work is merely a “security review,” or as one Democratic strategist call it, “another BS scandal.” Your work, thus far, has been relegated to yet another “witch hunt.” In fact, Clinton and her campaign have managed to convince millions that former secretaries of state did the same thing, which of course isn’t true.

...

To a great many people, there is simply nothing Hillary Clinton can do wrong; even FBI investigations are merged with Republican Benghazi hearings.

Ultimately, your hard work, and your investigation into Clinton’s email server and correspondence, is viewed as a big, fat “nothingberger.” As Esquire’s Charles Pierce writes, The Great Hillary Email Nothingburger is Still on the Grill, and It’s Certainly Overcooked. Sadly, the FBI has become part of a satirical narrative centered upon Clinton being the victim of never-ending Republican attacks.

It’s important for everyone at the FBI to know that your investigation, and I say this with all due respect, is viewed as a source of amusement for many writers, pundits, and observers loyal to Clinton. ... MORE

talking points have had just enough of a grain of truth to them to not be so NJ. We too have been inoculated to think they are just total loons and nothing they say is ever remotely true - but sometimes it surely is, and right now we discount that at our peril. All those ugly "attacks" on the Clintons over the years by the Right Wing made us think it was just all about party, but this IS how they triangulate to screw us over. Hell, I bought into the whole racism thing with Obama, and when he turned around and cynically used that as an excuse to fastrack TPP? There was that triangulation, for all to see.

used, it should have been revealed with the very first FOIA requests ever filed concerning her email communications early on in her tenure as SOS.

IMO there must have been a very active effort within the DOS to keep it under wraps. Notably, it was only after HRC and her interference running minions were out of office that the Kerry DOS actually started attempting to really comply with FOIA requests, or at least that's how it looks.

Mysteriously enough, her file of Benghazi communications were archived and effectively hidden while they were actually under subpoena - State Department Office Removed Benghazi Files After Congressional Subpoena

The House Benghazi Committee requested documents from the secretary’s office in a subpoena filed in March 2015. Congressional investigators met with the head of the executive secretary’s office staff to discuss its records maintenance system and the scope of the subpoena last April. That same month, State Department officials sent the electronic folders to another bureau for archiving, and they were not searched in response to the request.

That story is from the Washington Free Beacon which is conservative AFAIK, but as someone else noted, it is the rightwing media that is doing the reporting on the emails.

THIS is how the GOV servers enter into this scenario, and that's why the IT guy got immunity?

Since Hillary's private email was the ONLY address she used...

I hadn't seen that stated flat out, but it was the conclusion I drew and it sounds like it's what you're saying, more or less, with that acknowledgement---that by using his credentials, this IT guy did something he knew could get him fired--he went outside of protocol and left the government vulnerable. To grant Hillary her hearts desire--convenience.

??? Yeah, as if. This wasn't about convenience, it was about her being able to see her email before anybody else did, as well as hiding shit she didn't want seen in the sunlight.

Wonder how many Little Debbie emails reference "vote counting" in the upcoming primary? Maybe some dirt on how The Donald came to be a candidate? of why didn't anyone say anything during the entire four years she was SoS. Surely Obama and everyone she contacted knew she was not using a gov address, and NO ONE asked her about it. Not once.

I am pretty sure that Obama's statements pretty much pardoning her have nothing to do with covering his own ass. Right?

Today's daydream: Wouldn't it be nice if someone were to hack her current emails and publish them? President Sanders!

there was a saying that "The first liar never had a chance." The problem with our current government officials is that lie after lie is stacked on top of another or intertwined with the other lies that it is getting increasingly difficult to see who the first liar was. I think I will start with Obama's statement of wanting there to be government transparency.

Thanks for the link.

about Hillary didn't know how to access email from a PC or laptop (!) which is the setup the State Department itself proscribed and which is what her predecessors used. It seems as though there was NO response to Clinton or her staff that was acceptable if it involved the slightest bit of inconvenience or change to her regular routine.

How hard could it be to show Hillary how to go into email on a computer?

Once Hillary was warned about the threat to security her blackberry offered to evildoers, every use of it in insecure surroundings or relative to sensitive communications was conscious flouting of that security IMO. She literally does not seem to think that rules are applicable to her.

This year, by comparison, Hillary Clinton's organization can ask donors to give nearly three-quarters of a million dollars each. Here's how it works:

Donors who are rich — and willing — can give $5,400 to the Clinton campaign, $33,400 to the Democratic National Committee and $10,000 to each of the state parties, about $360,000 in all. A joint fundraising committee lets the donor do it all with a single check.

On Jan. 1, the contribution limits reset for the party committees, and the Hillary Victory Fund can go back to its donors for another $350,000 in party funds.

All told, a single donor can give more than $700,000 for the election. That's serious money, according to campaign finance lawyer Brett Kappel. He said, "It also shows you where campaign finance law has gone. We're now back in the era of soft money."
