HOA blues
Good morning everyone.
Cool temps moving in to greet the official end of summer. Harvesting is pretty much done. A few more tomatoes and some late corn waiting to be picked.
Still have that 100' of potatoes to dig up. Will start next weekend on it. E2 is still recovering from back surgery, so it's on me.
I'll probably need back surgery when it's over. Well, I know a good surgeon now. LOL
Grandson's truck broke down last week and the part he needed was a week away. He asked to borrow the farm truck to get to work for a week. I said no problem, we have other vehicles.
Now the truck is a 1986 Mazda B2000 that runs like a top, even with 390k on it. But it looks, well.......like a 40 year old truck. It ain't exactly pretty, but the body is still straight and it's even got a new exhaust system , so it's very quiet.
But the housing tract HOA where he rents told him he couldn't park the truck in the tract.
I guess it is to old. This seemed a little over the top to me. But I've been out of the housing market for over 20 years now, so I just don't know how things have changed.
Long story short, he brought the truck back and managed to find other accommodations.
Now, more than ever, I'm committed to driving it until it's 50. Inshallah.
And I will make it a point of visiting him regularly.

Oh, it is worse than that.
HOAs take it upon themselves to rule every aspect of the lives of the residents. What vehicle, where parked, the color of the exterior walls and door, the length of the grass, the presence of weeds (and there are *always* weeds), whether you have the approved blinds or you chose to hang curtains, whether the smoke from your BBQ grill is blowing into a neighbor's yard, the condition of your fence, and so on.
Back before the damned place burned down, we were renting a home in a neighborhood that was ruled by a very aggressive and obnoxious HOA. And Karen (that was actually her name) would patrol the neighborhood, shoot pictures, and send out notices to anyone transgressing the unwritten law. She was a human Flock camera, that one.
But most of all, she loved to shit on renters. She didn't want us there, so she took every opportunity to try to piss us off- and she usually succeeded. Grass is too long, the next day grass is too short, didn't remove snow from the sidewalk before 9am, didn't pull weeds in the common area across the fence from our lot, gate was sagging, wrong color curtains, car was too noisy, smoke from the grill blowing into the vegan neighbor's house. The list goes on. The best one was when a neighbor (owner) bought a boat and parked the trailer in their own driveway. Karen sent a dunning letter to us telling us to move the boat. Excuse me? $50 that time.
They billed us $50 several times for these various affronts to humanity. I always said that I'd pay them all when we moved out. Well, the fucker burned down, so we slipped quietly into the smoke wafting into the vegan neighbor's house, and flipped her off with all 4 hands as we slunk out of the neighborhood. Didn't pay them: let them file a lien against the landlord, if they want. I didn't sign any contract obligating me to give her blowjobs, and there was nothing in the lease that put us on the hook for it. Byegones.
Funny thing was she spent most of her time screwing with we renters. Nobody else pulled weeds from the common areas, and I was the person who ran the snowblower for the 4 houses on our cul-de-sac after a snow- the owners didn't bother. Harassing renters was just a labor of love for her.
I like our current apartment. All of us there are on an equal footing, at least. And there is no way in hell that I will allow my life to be run by an HOA again...

They say it's to keep property values up, but I have always passed on any property that has an HOA. At some point potential buyers will start bidding less to buy one.

When we were looking some rural property a few years back, we found a nice piece (6 acres) miles up a river bordered by National Forest (Gifford Pinchot) that we discovered had a homeowners association.
There were no neighbors. Go figure.

backs are a PITA, and back surgery is a very scary thing. Have know folks who had them go wrong and hence declined to even consider it for mine.
HOAs are also a PITA, and it is best to avoid them whenever possible. Theu also have a habit of shooting from the hip and overstepping their authority, but who wants to go to court over the color of their garage door or the age of their car.
Seriously busy day planned here, this is my first sit-down since 06:00, but I need to get out east and get some labs done before the whole world also gets there, so its best that I boogie on out.

HOAs, also known as POAs,
(Property Owners Assoc), are crazy. If a lawyer works for one, say, to sue a property owner for having the wrong roof height, that lawyer must attend special legal courses, and obtain a bond for at least $100,000. Nothing says "Sue me!" like knowing the insurance company will pay something every time. This is Texas law, and I have no idea if other states have similar laws.
I have never lived in a subdivision, never had to lock horns with anyone about my use of my property. I am positive I would not fit in with that type of organization.

I have given lectures
to homeowners who wanted to know how to put some controls on their HOAs. You are correct that it is a contract, and putting items on an agenda to get a rule changed is their primary options. And running for a position.

The golden rule
Do unto others... My personal variation on this is try to the greatest extent possible not to get into disputes with neighbors (or with anyone else if at all possible). Neighbors especially tend to still be around after the "violation" is just a memory. Since I retired it's pretty much a blanket rule. I emphasize this is my personal rule of thumb. Each to his own. Some encroachments may be too much to overlook. If we have some matter where I have to get HOA approval or must deal with the HOA, I'll let other family members handle it. They are much more diplomatic and resourceful than moi.
The Chinese aphorism below I saw in a photo of a scene in some Chinese neighborhood where it was spray painted on a masonry property wall in red paint. I understand it to in be the negative, don't do to others, what you don't want done to yourself. Likely ancient India and Egypt had earlier expressions of the rule.
Coincidentally, I received correspondence from the HOA yesterday, trying to recruit me to run as a "director." Thanks, but no thanks.

HOA's are dead to me.
My left eye started twitching just thinking about our years ago fight and, in the end, flight from an HOA in Burlington VT. It appeared idyllic, all units having a view of Lake Champlain with beautiful, one of a kind sunsets every night. I guess we just weren't cool enough or something enough to make our way into the inner sanctum of folks who could do whatever they wanted. We lived under dystopian control. You probably didn't know that tomato plants are unattractive but destroying green space for overflow boats and cars was right in line with community values. We just wanted to build a deck like everyone else, but our Board member neighbor didn't want to have to see us from her deck, the largest in the community. One day, our attorney asked us if this was "our fight", our hill to die on. We both sat back and relaxed for the first time in months. Days later we put the townhouse on the market and moved away. Far away.
I wonder
if they have the power to ban Flock cameras in the neighborhood?
