Saturday Open Thread - 9/14/24: Odds and Ends

I have had quite a week, friends! I tried to keep up with the news as best I could, but stuff and things get by me when I am immersed in work. This one was very intense.

Let us know what went into the Friday news dump! Please!

Meanwhile, I have a question. Do you have informal marriages or what might be called, "common law marriage" where you live? I would really be interested in your input.

The reason I ask, Texas has such a creature, and when some people get together have a kid, then split, one moves to another state, were they married or not? Who gets custody of the child? Or, when couples live together for decades, one dies, is the survivor entitled to inherit the created estate?

In Texas, you might think you are married and you are not, or vice versa.

Criteria: Married to nobody else; co-habiting; holding yourself out to your community as married; 18 years old or older. Most folks do not realize if you are married for any legal purpose, you are married for all legal purposes.

And then, you can separate for 2 years, no divorce is necessary.

Fun stories ensue.

You want your gf to have insurance for her pregnancy of your child. You call her your spouse on your insurance forms. Then, you separate, a divorce is filed.Divorce or insurance fraud, your choice!

You report to the IRS a marital status for some marital benefit. IRS agents knock at your door.

You are married, or a Federal prisoner! Oops!

You imagine you are married to that person who can only get government SS benefits from their former spouse if they are single, then they die. You imagine you get right of survivorship to your home. Oops.

So, in Texas it is possible to believe you are married or not married, much to your surprise.

*If informal marriage folks stay separated 2 years, and nobody files for divorce, it is as the informal marriage never happened.

common law marriages. BUT. Though Ca doesn't recognize common law marriages formed in Ca, it does recognize common law marriages legally perpetrated in some other state that does recognize them. Nota Bene: Ca is a community property state so this can be a two edgec sword.

@enhydra lutris That urge to get awarded half the value of a home through divorce sometimes overwhelms folks, and they start to imagine that they were really, really married.
One I have on the books right now is children of the deceased Mom claim a 50% interest in a home on 7 acres and want the bf to be forced to sell and move. Well, I have all the receipts of all the payments made, and decedent's financial contribution to the purchase amounts to 1%. The bf should be able to buy them out of their inherited 1% equity.
Still, opposing counsel is trying to come up with some theory. So far it is a community property claim at the same time they declare there was no marriage.
How are the renovations going, friend? And who is doing the cooking this week?

@enhydra lutris Our plan is to put in a car port on poles with a metal roof. We cut down a huge, dead oak tree to clear the area where we will erect it.
If we wall it in, it will cost $1500 for a permit. All we want is a roof for hail and sun protection.
My sports car is for sale, will pay for the car port.
On another note, I chatted with the Mayor yesterday. The Colony Ridge developers have bought property in town, less than a mile from my office. They are expanding their territory. Their business model is to loan money for property purchases with no back ground checks, no credit check, and their target population is illegal immigrants. Their colonia development north of Houston is overrun with cartel, and so dangerous, cops won't go there. If that property near my office becomes some sort of safe house, it will give me a good reason to get out of here. It was known to be a meth house. Bad, to worse.

and as he was somehow licensed to perform the act, it was accepted as a legal
tender situation for the purposes of IRS, state authority, etc.

Perhaps if some question arises it may be Swiss cheese for suing parties?
Haven't gotten there yet, so don't really know.

@QMS from the county clerk that is a declaration of informal marriage. Fill it out, file it with the clerk. No other documents are required.
This whole married or not issue typically arises when 2 people are getting some government benefit that is only afforded to a spouse. One example is military retirement offering cheap homeowner's insurance. If your significant other has to get insurance to satisfy the finance company, and you use your military benefit to save them money by filling out the forms that you are married, trust me on this: you are married. Or you committed a federal offense. Choose your poison, soldier.
These situations are getting to be more common in this miserable economy.
Any news on the long range missiles agreement with the Ukies? I'd hate to see the London Bridge fall down.

Inverview: Former US security adviser "Moon's North Korea stance was overly optimistic"

“I believe so. What Kim Jong-un hopes for from Trump is a ‘weak agreement.’ While he might give up some long-range missiles, he is likely to hold onto his existing nuclear weapons and short-range missiles aimed at South Korea. After that, he could try to take advantage of Trump’s skepticism about stationing U.S. troops overseas and make an effort to withdraw U.S. forces from the Korean Peninsula. However, I believe all of Kim Jong-un’s efforts will ultimately fail, as Trump is unlikely to be deceived by him again, as he was during his first term. Despite this, Kim Jong-un will continue to pursue these goals. His recent anti-unification declaration and the increased level of missile provocations may very well be laying the groundwork for another summit with Trump.”

McMaster doesn't know anything about Korea. Trump wasn't deceived by Kim Jong-un, he was deceived by his own staff, and the notion that he was actually the Commander in Chief. If he goes to a summit with Kim Jong-un, it would be purely for the PR, no substance. He is just incapable of standing up to the deep state or the media after 70 plus years of propaganda. McMaster knows more about North Korea than Moon Jae-in? Don't make me laugh. Only the Chosun Ilbo could publish this crap. The most pro-Japanese newspaper in South Korea, the approved newspaper of record during the colonial period. McMaster's perspective on this is virtually the VOA Korea "ex-CIA employee" analyst line, I listened to for years.

According to Kim Jong-tae, in a presentation today, probably one of the most astute political observers in South Korea, there has been a rolling coup going on in South Korea since Yoon took office. Yoon and his termites in prosecutors offices throughout South Korea began undermining the Judicial branch during the Moon administration. Prosecuting political enemies of the right was his bread and butter and what brought him and Han Dong-hun center stage politically.

Kim Jong-tae contends that virtually all senior ranking generals from the Moon administration were retired and replaced with less experienced two stars suddenly promoted to three star rank or higher prematurely. He claims the politically screened officers are unqualified and incompetent for major commands. In the past I've also seen the highest level management of the National Intelligence Service has also been purged as well. These important government institutions no longer have independent judgement beyond far right/ new right rhetoric such as that of McMaster. If he thinks North Korea provoked every shooting incident or confrontation along the DMZ or maritime NLLs, he is poorly informed at best. He clearly isn't aware of the incident in the West Sea in which the South Korean navy shot at and sank a North Korean maritime patrol craft that was pursuing a Chinese vessel fishing illegally in North Korean territory near the border. The NK vessel had strayed across the NLL. That incident was followed by the Yeonpyeong Island bombardment incident, and the sinking of the Cheonan, a South Korean naval vessel, both by North Korea.

The most interesting thing about this is that Kim Tae-hyo, was in the Lee Myung-bak cabinet at the time, and now is a deputy national security advisor to Yoon, again following an aggressive and provocative policy toward North Korea. Is MacMaster unaware of the propaganda balloons from the South overflying the DMZ which violate UNC policy? Does he think the repeal of the provisions of the 9.19 agreement favored by the US and adopted by the Yoon administration wasn't provocative? What about massive firepower demonstrations adopted by Yoon in the former buffer zones near the DMZ and NLLs? The resumption of loudspeaker propaganda in the DMZ on the UNC side?

The US had a golden opportunity to engage Kim Jong-un and North Korea in a more positive relationship but simply blew it off because the US MIC and Japan's LDP government which is committed to keeping Korea divided and weak wanted it that way. Now high end estimates of the North Korean nuclear inventory have tripled. How successful was that? Even arch conservatives on Korea like Victor Cha from CSIS, thought McMaster's so called "bloody nose strategy" against North Korea was a dangerous idea. When you are to the right of Victor Cha you know you are dealing with a nut who cannot and should not be taken seriously. The rejection of better and more constructive approaches to North Korea, lead inexorably to a more substantial and dangerous relationship with Russia. Does McMaster know more than Siegfried Hecker? Now that the Yoon administration is obviously paralyzed and struggling, there are discussions concerning Yoon's military appointments, and the potential for martial law. There is a recent article in The Diplomat:

The author works at least in part for Korea Times, so I expect some kind of soft sell. One of my South Korean commentators said that the author stated that Yoon's lying in a televised debate during the election campaign about his wife's corruption "could topple him from office, but it wasn't likely to happen." I wrote an analysis over two years with virtually the same title. It was about his professional misconduct and his wife's corruption up to that point. Yoon should have never been elected. Now, the problem is that there are probably a dozen things that could justify Yoon's impeachment. He's steadily losing support, because of his purges in key government institutions, his obvious political prosecutions, his abuse of office to protect his wife's criminal acts, his oppression of the media, and complete indifference to the legislative process. The capitulation to Japan, his attempt to rewrite history, along with a terrible economic situation and medical crisis have pushed his credibility to zero. He rules basically by intimidating government officials in the major institutions of government. Rule by fear. What's left?

Yoon and his wife, both corrupt, do whatever they like, and think the presidential staff, and conservative press like Chosun can package and sell it to the public. Gallup Korea reported his job approval rating is down to 20 percent, the lowest it's ever been. His prosecution of the former President Moon Jae-in is over the top. The history of Yoon's polling numbers is similar to that of Lee Myung-bak and Park Geun-hye administrations. The fact that the Diplomat could address a topic like this (even if an apologia) shows that the US establishment thinks South Korea is "locked into the military's Indo-Pacific policy" of the US and Japan, and that there is nothing that can change it, no matter who is in office.

I never thought I'd live to see the day when I would respect Kim, and consider him the adult in the room.
I am not surprised Yoon and wife are ruining SK. I am surprised to see that Japan has gone so far to the dark side. Why doesn't their position on the map and close proximity to their "existential threat" neighbors force them to employ diplomacy?
The only true diplomats around are from China and Russia. Maybe Hungary. The rest prefer to bomb their problems away, not talk and resolve them.
My fall back position is to follow the money.
As for kid cases, seems I finish up on 2 or 3, and it makes room for new kid cases.
The newest one is to protect a 4 yr old girl who lives with Mom, from Dad's 14 yr old son, during visitation periods at Dad's house.
Little girl was almost raped by the teen half-brother. Someone walked in before it happened. Naturally, Dad cannot agree to do anything that makes his son look like a criminal, or himself negligent in supervision of the little girl. The person who interrupted the crime is way to afraid to come forward.
I figure this will be a monster court fight.
It says a lot about our society that these sorts of incidents are not rare, soryang. You would be shocked if you knew what was going on inside houses in your neighborhood!

@on the cusp People are prepared to believe anything about Kim, the dictatorship, the excesses and suffering of the people there. The typical stereotype is that "Kim is crazy." My goal isn't isn't to defend him or his system. But he's not "crazy" he's a rational actor in geopolitical terms. I think it was Chas Freeman who said the goal of diplomacy is to understand the other side's perspective. What are the historical and political circumstances that brought the division of the peninsula about? What are the interests of the other side? What brought about the extreme nature of the system perspective in North Korea? It isn't like Japan and the US had nothing to do with it. What approach is most likely to move in the direction of goals that you would like to see?

I heard Col. Macgregor going on a riff about this with respect to China. There's no reason to go to war with China. He basically said the "freedom of navigation" issue was bs, and the dispute over Taiwan or the South China Sea islands was so much blather.

I'd wouldn't be too surprised by the awful things some people do to their children. But I would be appalled. More power to people like you OTC, who act effectively to protect the children.

Such reflections are politically forbidden in the US. Thus, enlightenment and wisdom is retarded across our entire culture, as we work our way toward collapse.

I, too, continue to have revelations and suddenly see truths that were right in plain sight all along.

I never thought I'd live to see the day when I would respect Kim, and consider him the adult in the room.

The deeply perverse outcome of the Korean War was manufactured before we were born. Although I studied China, I never got a real fix on Korea. It seemed like the country was an unfinished psy-op. The West (US) had embedded a strategic Evil in the Korean peninsula — a persistent and deadly zone of hostility zone that artificially severed the country. This would eventually make South Korea very easy to manipulate. It now reminds me very much of Ukraine. A time would come when the US would weaponize South Korea and turn it into a geopolitical pawn — a proxy that would provoke China into a military response. With US nuclear weapons now in country, South Korea could be transformed into a direct nuclear threat against China — and a bright target destined to soak up counter strikes, after the US fires on China. Which is currently scheduled for early 2028, just in time for a US war President to snag a second term.

The US sees no other option. It must attack China and deliver a crippling blow to its economy and infrastructure. If the US hesitates, it will lose its hegemony over the world, and will no longer dictate the Rules of global trade the world must obey. Instead, the US will become a second rate nation and "communism with Chinese characteristics" will gain a foothold in every government. The Neocon Nightmare is that the 21st century will belong to China, and not America.

I didn't see or fully understand the US had to weaken and cripple China (and much of Asia) before it could claim Global Supremacy over the entire world. But the Kim Family understood this all along.

@Pluto's Republic was during The Cold War, so everything was taught thru the lens that China was evil, backward, and stupid. They were not remotely considered an economic rival. That trip Nixon took there in 1972 marked an economic turn to relations.
Korea was taught much the same way, except the people of the south, where military bases would be strategic, were sensible and friends of the US. The northern Koreans were bad communists, and we had to protect the good guys of the south. That is the extent of my university education.

How can one have a discussion on growing negative opinions toward Israel and not mention the ongoing military and citizen actions actions in Gaza and West Bank.

I did get an email from The Corbett report. James sent a video from 2015 entitled: "Meet Allen Dulles: Fascist Spymaster.
I want to watch it before I drop in the actual video here to make sure it is good.
Admittedly, I do not know enough about the Dulles brothers. They were given short shrift in my college history courses. Imagine that, the peak years of the Viet Nam conflict.
We need a better understanding of China, Russia, and Iran, so this info you provided is helpful for our journey towards the truth.

Washington state does not recognize common law marriage, but does have a "Committed Intimate Relationship" designation that is usually invoked only to split assets.

@earthling1 @earthling1 When I saw "Kandy corn" on the bag, I thought it was a brand name. I later found it was a variety of sweet corn. What we typically plant is called peaches and cream sweet corn. Turns out it is Kandy. All the best agriculture advice comes from Texas A&M University. She said she was worried that her husband had disclosed to his attorney that they were both adopted, later found they were birth siblings, but according to law, when a person is adopted, it is as if they born unto the adoptive parents. They married knowing that they were brother and sister.

@humphrey I have visited rhino, elephant, and giraffe rescue sites in Kenya. I made friends with a blind rhino, a friend with a baby male elephant the guides told us to avoid. He singled me out of the crowd of 10 folks.
