NATE SILVER: With Gary Johnson polling at 24% in New Mexico, a crazy election outcome is 'plausible'
Renowned statistician Nate Silver said on Sunday that a new poll showing Libertarian nominee Gary Johnson with 24% of support in his home state of New Mexico made the chances of an Electoral College deadlock “plausible.”
Silver wrote on his FiveThirtyEight website that Johnson had a 2% or 3% chance of winning the Land of Enchantment state. If that were to happen, and Trump and Clinton were to split on key swing states, neither of the candidates could reach the necessary 270 votes needed to secure the presidency.
In such a scenario, the election would be thrown to the House of Representatives, which would determine the fate of the election.
Silver did caution that while “plausible,” it was certainly unlikely that such a scenario would play out.

So, wouldn't it be something if this is how it all played out. I'm not happy that it's Johnson who's got the slight chance at upsetting the apple cart. I would much rather it be Stein. WHY DOES THE GREEN PARTY HAVE SUCH A HARD TIME GAINING ANY TRACTION???
I wonder, how would this all play out if it DID go to the House? I'm not at all smart enough to try to predict what the Republican's would do besides ensure that Shillary never saw the White House again unless she was taking the tour.
Any ideas and does anyone here think that this is even a remote possibility? I was going to try to talk two millennial friends of my son out of voting for Johnson. Now, maybe that's what we need. Or is that foolish?
Comments
I saw that poll this morning.
Right now, the conservative vote is split.
But if trump supporters (heck, if I were a Berner in NM I might vote for Johnson instead of stein) would switch to Johnson then Hillary loses and chaos ensues.
Since there are more red than blue states, trump wins in the house.
Johnson polling 13% in Utah
No chance of winning, but the chance of throwing the winner.
If it went to the House, what do you see happening? This is
probably a stupid question but they couldn't throw Kasich or Cruz back into the mix, could they?
Those two scare me.

Conceptually I agree
IF it goes to the House, I could see lots of different names mentioned in back rooms, names that aren't Clinton or Trump.

12th amendment
Part of the 12th amendment
The person having the greatest Number of votes for President, shall be the President, if
such number be a majority of the whole number of Electors appointed; and if no person
have such majority, then from the persons having the highest numbers not exceeding three on the list of those voted for as President, the House of Representatives shall choose immediately, by ballot, the President. But in choosing the President, the votes shall be taken by states, the representation from each state having one vote; a quorum for this purpose shall consist of a member or members from two-thirds of the states, and a majority of all the states shall be necessary to a choice. And if the House of Representatives shall not choose a President whenever the right of choice shall devolve upon them, before the fourth day of March next following, then the Vice-President shall act as President, as in the case of the death or other constitutional disability of the President.
Pretty sure you have to have
Electoral votes to be considered.
I'm told they have to pick from the top three.
But didn't look in the Constitution to check it out.
If they don't pick one by some date and the Senate has picked a VP, the VP becomes President. Hello President Kaine or President Pence.
I've seen lots of changes. What doesn't change is people. Same old hairless apes.
So we could have a Prez & VP from diff parties?
That would be bizarre! I thought we tried that way back in the beginning and fixed it so that FUBAR scenario could never happen again.
Help me out, History folks. . .
Actually, that's how we started out.
Granted, the founders didn't want parties, but they evolved pretty quickly. And even if during washington's presidency we didn't have formal parties we did have major philosophical splits. By 1800 we did have parties & the election was a real mess & changed how we pick prez and vp.
https://en.m.wikipedia.org/wiki/United_States_presidential_election,_1800
If Senate picks VP & House picks Prez, 2 diff parties possible?
What about today?
If the Senate votes on VP, from top 3 candidates, and House votes for prez, from top 3 candidates, couldn't we end up with 2 people from 2 different parties? How exactly does that work?
Edit: made to into top. Sorry, on my phone.
12th Amendment
The current procedure for selection of POTUS and VP, in the event that no one gets 270 electoral votes, is in the 12th Amendment to the Constitution, as modified by the 20th Amendment:
*The part in brackets was superseded by section 3 of the 20th amendment, which says:
"Don't go back to sleep ... Don't go back to sleep ... Don't go back to sleep."
~Rumi
"If you want revolution, be it."
~Caitlin Johnstone
Sounds to me like they could pick anyone they want.
Someone not named Trump or Clinton, most likely. Unless I am missing something in there.
"I’m a human being, first and foremost, and as such I’m for whoever and whatever benefits humanity as a whole.” —Malcolm X
Only from the top three EV getters.
So, they can't select say Joe Biden if he doesn't have any EV's or isn't in the top three if he does.
Worst case, they can't select a new pres or VP (say they all were killed in a terrorist attack or a meteor).
Then, Paul Ryan probably would be President or maybe Nancy Pelosi unless they have set up some other succession scheme as the Amendment allows.
I've seen lots of changes. What doesn't change is people. Same old hairless apes.
Okay, thanks
The whole thing was really hard to read and interpret. Especially through beer goggles.

it could be Trump Kaine.
The current working assumption appears to be that our Shroedinger's Cat system is still alive. But what if we all suspect it's not, and the real problem is we just can't bring ourselves to open the box?
Yes or Clinton-Pence
but more likely Trump-Kaine

No way
House Democrats are going to vote for Hillary even if Bernie won write-in in Vermont and Wyoming.
Remember, the vast majority were hand picked by DWS. Congressional Republicans would rather vote for Satan than an admitted Socialist. It would be political suicide.
An interesting scenario is what if Hillary dies after the election in which no one got 270 EV's? And AFTER the EC has voted. Then the House has the choice of Trump or Johnson. Who do Congressional Democrats vote for? My guess is Johnson.
It won't be Bernie because your write-in campaign is competing with the Stein campaign.
I've seen lots of changes. What doesn't change is people. Same old hairless apes.
Got the numbers on the poll? Anyone under 40 polled?
There are statisticians who believe that at this point on-line polls are a better view. Many are freep-able with bot stuff, but let's assume that the latest 2 I have seen and voted in and could not vote twice are slightly realistic. Stein is pulling over 60% of votes in both, Clinton has less than 5%. So, Stein supporters, stay the course. There will be a significant bite out of Hillary's numbers even with "fixing". So, we get Trump. He make take down the Clintons and finish destroying the old-guard Third Way.

Do you think that somehow the Repubs could bring back
the threat of either Kasich or Cruz? I said this before, those two scare me. Kasich is smart and so is Cruz. But Cruz can't hide the batshit crazy and he made a lot of Repubs angry with his stunt at the nomination convention. Plus he's not liked by anyone outside of his immediate family and Glenn Beck as far a I can tell. But Kasich, another smart guy, doesn't have the bad reputation that Trump and Cruz has. People, for some reason, think he's a 'sane' Repubbie.
I've read scenarios here that Bernie could still win so if it's possible for that to happen, why wouldn't it be possible for the right to dig either Cruz or Kasich and somehow install him in the White House. **shudder**

I've mentioned this before in several comments.

HELLO - She keeps racking up Republican support
Even if the House doesn't flip, she has quite a bit of Republican support. Don't know exact numbers, but she is a DINO, after all.
This is one crazy election year!
Right, just since Trump became the nominee
You're referencing GOP support in the general election, when the only choice for someone like George Bush is Trump.
Do you think GOP support for Hillary would even exist if the GOP nominee was Jeb Bush?
FDR 9-23-33, "If we cannot do this one way, we will do it another way. But do it we will.
We're talking about a House vote for prez, right?
If Jeb were needing to be elected via House vote, I'm sure he'd win, provided the House doesn't flip before the vote.
However, like you implied, she has Repub support because of Trump. I suspect there are more who hate him than have actually stated so.
Trump is the one running against Hillary. Sooo, it's completely plausible to presume that the Repubs in the House who've announced their support for her would vote for her. Add in her DINO cult following there too, and Her Heinous wins.
HELLO Enjoy that tea leave reading!

SO now jump to Jan 6th 2017, Neither Trump or Hillary got to 270. Suddenly there'es a 3rd or even 4th choice. Are you saying at that point in time, Republicans in the House are going to select Hillary as POTUS?

I think the Bushes are pretty cozy with the Clintons
Jeb shared his donor list with her back when Bernie was still in the race. So it depends on how much influence the Bushes still have over the non-libertarian side of the party.
It also depends on whether Trump, Hillary and Bernie are the top three choices. If they are, you're damned skippy the Republicans will vote for Hill.

How Bernie Sanders Could Become President With Only 130,000 Votes
6 days ago 14 Comments
After reading Dawn Papple’s excellent article in The Inquisitr a few days ago, about how theoretically it was possible for Bernie Sanders to still become President, I shared the article with some friends and found that they were confused at how this scenario could occur, so I decided to write my own article and hopefully answer everyone’s questions, as well as recruit a few hundred people to help me make this into a reality. ...
... Last Question, Crazy Guy; I’m a Jill Stein Supporter Now. What Role Does Jill Stein Play In All of This?
Great question!!
Jill actually does play a role here.
Although Jill herself has stated that the 2016 election is about “consolidating power” to win the 2020 election, Jill Stein supporters may end up helping Bernie Sanders in this scenario.
Jill Stein supporters should continue canvassing, donating and phone-banking on her behalf.
Not only will your activism help Jill in 2020, but a truly concentrated Jill Stein movement in a few battleground states could swing those states to Trump and keep Clinton from achieving the 270 electoral votes required to gain the Presidency.
Our Bernie write-in campaign in no way hinders Jill’s progress.
Wow!! You’ve actually convinced me. What do I do now?
Email me at..
BernieSandersWriteIn@gmail.com
We need phone-lists of Vermont residents.
We also need people who are willing to travel to Vermont for one month or who already live there.
Yes, this is a longshot, but Bernie Sanders’ candidacy was a longshot from the very beginning.
It is worth a try just to keep the government from falling into the hands of either of these two warmongers.
This is our only hope to stop both Clinton and Trump.
I am ready to make the sacrifice, but I can’t do it alone.
Who’s with me?

...Update: The latest results from 270 to Win indicate that Iowa has turned Red, Clinton is at 264 and Trump is at 268. Consequently, if Clinton takes Nevada, she will make it to 270. If the new projections are accurate, both Vermont and Wyoming will be needed to prevent both leading candidates from reaching the requisite 270 electoral votes.

How many states count write in's?
You can write in a presidential candidate here in OR but the vote is not counted. This is kinda pointless as Bernie himself does not want to be the nominee. If he did he would have taken it to Philly and at least called out the election fraud, DNC 'bias' and the large amount of registered Democratic voter's who were stricken off the voter lists. They rigged it from here and back and every which way. So why would Bernie Mr.Honorable want to throw a monkey wrench in the coronation he's out pumping for?

Bernies got nothing to do with this
This is a national grassroots effort. In fact half the Our Revolution Slack team started a new SLack just to organize the effort.
Huh? This is not about Bernie being the nominee. This is about the House picking a POTUS.
This is about writing in Bernie Sanders and Tulsi Gabbard in a state like Vermont, in an effort to deny 270 to Trump and Hillary.

It's a real world brain puzzle.
Thanks for presenting it.
Why not just work to
get Jill Stein up to at least 10%. All thin Bernie could still win this ignores the fact that he really did win the primary and chose not to contest it or go against the odious DNC and every freaking Democrat in congress who folded and kissed the Clinton's ring. As for Gary Johnson's polling I'd say as bat shit crazy as the Republican voters are they sure as hell do not fall in line like the Democratic voters do. Forget about Bernie he's with her. The other night at a family dinner of 6 people 2 were voting for Hillary due to Hairball fear, 3 we're voting for Stein and 1 was going for Johnson. Interestingly the breakdown in age/generation was the 2 Hillary votes were x'ers, the 3 Jill Stein votes were 1 millennial and 2 old geezers, me and Shah. The 1 Johnson vote was a millennial who has always had some libertarian leanings mainly in civil rights issues.
Well, those are the first people in my generation
that I've met or heard of who support Hill. I know they're out there--we split about 1/2 and 1/2--but I've never run into one before.

If it went to the house
1st: by law the house has to pick from the TOP THREE electoral vote winners.
This eliminates all but Hillary,Trump,3rd choice that got votes.
If the 3rd choice is Johnson, I wouldn't be shocked for the House to pick the pot-smoking republican who hijacked the libertarian party. House will NOT vote for Hillary. If they vote for Johnson, they can tank the odiousness of Trump from the republican party. So in conclusion if Johnson is the 3rd place finisher: JOHNSON IS CHOSEN
If the 3rd choice is Bernie or Jill, the house has to make a tough choice. I believe they choose Trump because backing Hillary would get them all primaried, but the powers that be prefer Hillary. House republicans may say they made a noble sacrifice of their party to stop trump and choose Hillary. Chances on who is chosen: 60% Trump 40% Hillary
When I was a kid, Republicans used to red scare people, now it's the Democrats. I am getting too damn old for this crap!

I don't see those words in the 12th and 20th Amendments. The 12th says the Electors (whoever they are) get together and write down who they vote for for President, and Vice President.

Here
If no candidate for President has a majority of the total votes, the House of Representatives, voting by states and with the same quorum requirements as under the original procedure, chooses the President. The Twelfth Amendment requires the House to choose from the three highest receivers of electoral votes, compared to five under the original procedure.

if it goes to the House it's 1 vote per state
so Oregon, with 5 Dems, 1 Repub would vote for Hillary. All of them thar Southern states, with lots of Repub House members, would vote for Trump....probably. If one party has the majority of states' reps then it'll win in the House. I believe it's currently overwhelmingly Repub.
30 seats
but its moot. The POTUS selection would take place after the new congress is sworn in January 6th.
And frankly Trumps support in the GOP is not widespread. If the number of congresspersons who hate both Trump and Hillary is enough, then a 3rd name is in play. Remember Bush and Cheney have said they wont vote Trump.
FDR 9-23-33, "If we cannot do this one way, we will do it another way. But do it we will.
I see no Democratic congressperson
who is willing or wants to take on the Clinton's from the so called progressive caucus, the black caucus, to the godawful neoliberal centrists. They all will fall in line even if push comes to shove from the electorate who may reject her and him. Like with Bush 11 she's in. It's her turn. No doubt about it. Trump lets them off the hook which I happen to think is the reason he's still standing.
Good cop, bad cop is the game they have played for decades and in this election they may have overplayed their cards. Expect more outrageous inflammatory bs. from Trump that causes The Mad Bomber to roll her weird eyeballs and purse her nasty evil mouth. Then she will trade meaningless insults with him that insult everyone's intelligence. So it goes when all the players are on the take. Who gives a shit what Cheney or Bush11 says. Why after being soundly rejected do they still have power? They have got to be the most reviled pols since Attila the Hun. Why are they even in play?
They were gone daddy gone soundly rejected by the public in 2006-2000. But no the Democrat's had to revive the dead rejected Republicans and breath life into the embers left by the Bushies staring Cheney. The congresspersons D or R don't hate any of their esteemed colleagues past present or future. They are complicit and refuse to use any of the checks or balances of power prescribed by law. 60+= a majority and reaching across the aisle and getting victories for compromise with RW lunatics is democratic. It's a fools game to buy into the fictitious kabuki partisan divide. They are a duopoly and their all playing 'we the people' for all it's worth. Who believes this stupid badly produced farce of democracy.
Are we assuming that some big flood of Democrats
is going to take over the new congress & vote Hill? I don't think Congress is trending D--not that I care, you understand, but I don't think that's happening.
The issue is that it puts the Repubs in a difficult spot if they have to choose the President and choose Hillary. Their rank and file are not happy with her; they're not falling in line.

I heard a candidate on Alan Combes
Who is running for the House and running for President at the same time.
I may have that garbled, but his rational is that neither candidate will get the electoral votes. And the House can vote for anyone they want. Anyone. So he will lobby there.
Edit: This makes no sense. I believe he wanted to win to lobby inside the House for Johnson. He seemed sane.

I'm not going to hold my breath
on that particular scenario. I would love to see Johnson take NM simply because a 3rd party candidate hasn't won a state since Wallace (IIRC). If we're going to break the duopoly, that would be a good start.
Having that put the whole election into a sub-270 tie is a long shot. I still think someone will win outright.
Right now 538 has NM solidly blue, so Johnson would be taking some votes from Clinton.
Last week was a full court press against Trump. Maybe it's the beginning of the end for him. Maybe Clinton has a seizure on TV this week and the race flips again. Early voting starts soon.
I still can't believe that Clinton can win Colorado, even with a poll in today by Monmouth (who I know nothing about) showing her up 11. If the state of the race vis a vis the polling is off by that much, I would expect Trump to take NV, FL, and PA. Or he could be in the final meltdown and Clinton takes this with 300 EV.
I'm really afraid that we need to hold an election and count the votes to make sure. Do we still do that in this country?

They don't know
How to poll these states. For instance in my state of Washington Stein seems to have a huge following outside the Seattle metro where Clinton is disliked. She is likely at this point to get more than 10% . This could actually throw the election to Trump.
Fantasy scenarios:
1. Hillary wins in the house. This is unlikely because for this to happen the house Rs would have to turn coats, and the R secretaries of state are more likely to have done that already, throwing the general.
2. Trump wins in the house. Likely because the Rs always fall into line. Means that the "freedom caucus" would have "staged a coup". or at least that's how the pundits would describe it.
3. Johnson wins. Likely if it goes to the house and the house Rs. fall in line with big business corruptocrats "but not Trump".
4. Write in Bernie wins. He would have to win a sttate or two . Then, in the house, the representatives vote for the most respected, honest person. If this happens expect the sky to open and the trumpets to sound in January.
5. Kasich wins. Placeholder for any pro corruption corporatist not named Trump, Clinton or Johnson. Possible if Swillery croaks between now and the inauguration.
