Breaking - FBI Director Comey not recomending indictment

UPDATE: Full transcript of FBI Director James Comey's statement on the Clinton investigation can be found here: Washington Post

# # #

Just watched FBI Director Comey's Statement to Press on Clinton email server and email investigation:

Comey said, based on past cases, FBI would not recommend to Department of Justice any criminal charges be filed.

Other remarks by by FBI Director Comey (based on my handwritten notes) follow:

1. Said he had not cleared his statement with any other official in the Federal Government.

2. Claimed that while they recovered some of the deleted emails, they could not recover all of them.

3. Began investigation after referral from intelligence agency over concerns classified information was maintained on Clintons private servers. Made a point ot say this was not one server, but several, as well as multiple devices used.

4. Found evidence of 110 emails from the 30,000 provided by Clinton that contained (a) 8 email threads that Top Secret information (highest level), 36 that contained Secret information and 8 that contained confidential information (lowest level). Also found 2000 emails that were later up-classified to have contained confidential information.

5. Found several other emails not provided by Clinton from other sources, including emails retained by recipients of her emails. Of those recovered emails, 1 contained Secret information and 2 contained confidential information.

6. Was unable to forensically recover all of the emails that Clinton deleted. Stated her aides who received those emails scrubbed their devices or accounts in such a way as tom make it impossible to recover.

7. Found no evidence of deliberate or intentional misconduct by the lawyers who worked to delete the emails not turned over to State Department. Said lawyers for Clinton did not read emails, only subject matter headers, after searching the data base by using various "search terms."

8. Did conclude that Clinton was "extremely careless" in her handling of top secret and other classified information on her servers. Evidence showed that reasonable person should have known it was not safe to have such information on servers not maintained by the US government. States many people were aware Clinton was using a private server for her emails.

9. Stated Clinton's servers were not protected from intrusion by hostile interests as well as government servers or even servers used by private companies such as Google regarding their gmail.com servers.

10. Found no evidence of intrusion of Clinton servers by foreign entities or hackers, but said the potentially her servers were hacked because it was unlikely evidence of the intrusion could be discovered after the fact due to the poor security protection of Clinton servers.

11. Did find evidence that email accounts of Clinton email corespondents were hacked.

12. Stated Clinton made a habit of using her devices to send emails while in foreign counties or other places.

13. Though the FBI could find no evidence of hacking, their assessment is that foreign or hostile interests likely did obtain classified information as a result of her use of unprotected private server on which she maintained classified information.

14. Did not recommend indictment because FBI determined that no reasonable prosecutor would bring case based on these facts. All prior cases in which indictments were brought involved instances of intentional action, and FBI found no evidence that was the case here. Did not comment on whether the "extreme carelessness" he spoke of earlier was sufficient to meet the alternative standard of "gross negligence" in the statute to Clinton with criminal violations.

15. Claims this did not mean that what Clinton did was right, or should carry no consequences, only that he would not recommend criminal charges.

16. States investigation was above board and apolitical. He stated he was proud of the professional manner in which FBI investigated this case.

He then left podium and took no questions from press at that time.

Is that Comey appears to have made that last bit up. Intentions have no bearing on charges of this nature, and negligence should be fully indictable.

While I didn't expect her to be indicted, the weak rationale for not doing so is despicable. Comey is a stooge.

Plenty of others have been convicted for much less. Hillary is literally above the law.

WHO could possibly vote for a person who was RECKLESS and EXTREMELY CARELESS with government documents ( please stop calling them just "emails") as SOS, to be POTUS? "To be clear, this is not to suggest that in similar circumstances, a person who engaged in this activity would face no consequences. To the contrary, those individuals are often subject to security or administrative sanctions. But that is not what we are deciding now."
In other words, there is plenty of scope for prosecution, but since the culprit is such a powerful person, we can't suggest that in this case?

So if ANONE ELSE DOES THIS then they would probably face consequences, but not Hillary.
IF that doesn't show the fix is in for her, then what does?

back from the 1%, now is the time to speak up or forever hold his 'piece/peace'.

***
Speak your piece means "state your opinion or view." One sense of the word piece is specific to this expression.

Hold your peace means the same as hold your tongue: "to keep silent or to not say anything about something." It's commonly heard in traditional marriage vows:

***

Sander's either believed what he was telling us or he didn't. To go silent all of a sudden is really bad optics. If he backs this incompetent and corrupt woman in the end, what was the point of his 'revolution'? To in the end aid in the election of everything he said is wrong with government in this country today?

For shit's sake, she lied about this 'server' thing for how long before she told the truth about it? Then she lied about the emails themselves. That's not my definition of the word 'careless'. There is NO escaping the fact that she lied until she couldn't lie anymore and then started to 'cooperate'. WTF kind of president is that? (We won't even consider things like destabilizing governments, okaying arms deals to her foundation's 'benefactors', etc. right now.)

If even the low-level flunkies in the financial sector who participated in the massive, industrial scale fraud that crashed the economy and vaporized trillions in wealth were allowed to get off scot-free without so much as a wrist slap, how can anyone realistically expect that someone as high up on the food chain as Hillary Clinton would be held to account for her malfeasance?

This all brings to mind a memorable quote from Clarence Darrow: First and last, it's a question of money. Those men who own the earth make the laws to protect what they have. They fix up a sort of fence or pen around what they have, and they fix the law so the fellow on the outside cannot get in. The laws are really organized for the protection of the men who rule the world. They were never organized or enforced to do justice. We have no system for doing justice, not the slightest in the world.

Senate approves women registering for the draft

*
The Pentagon recently dropped barriers to female service members participating in combat roles, a move that raised the issue of whether women should be included in the draft were it to be reinstated.
And at the beginning of February, the commandant of the Marine Corps, Gen. Robert Neller, and the chief of staff of the Army, Gen. Mark Milley, voiced their support for the inclusion of women in the Selective Service now that all military positions, including combat roles, have been opened to women. The U.S. Marine Corps had opposed the opening of certain combat specializations to women.

There is no question that the mercenary army makes it much easier to go to war and stay at war. Politicians love it. Spending more money on advanced weapons systems instead of troops is also popular with the military industrial complex. And so many activities formerly carried out by soldiers are now privatized--more good money to be made from the taxes we pay. I don't see the draft coming back anytime soon either.

There were two separate cases and investigations. The email issue - which they are not going to indict. But there's also the foundation:

The second criminal FBI investigation involves “Public Corruption” relating to the Clinton Foundation itself. The allegations against her are that she used her position as Secretary of State to personally enrich herself and her husband by doing favors for foreign governments and receiving hundreds of millions of dollars in contributions to the Clinton Foundation in return. According to some sources, Saudi Arabia is responsible for 20% of Hillary’s campaign contributions.

An extreme example of irregular activity (among many others) involves Bill Clinton’s friend, Frank Giustra, a Canadian who asked Hillary for permission to own shares in a uranium mine in Utah. As Secretary of State, she had the power to grant this permission to a foreign national – which she did do.

Giustra turned around and sold 80% of his shares to Vladimir Putin. So now a Russian corporation owns the lion’s share of a uranium mine on US soil – and that corporation is owned by the similarly-corrupt Vladimir Putin.

Now get this: Giustra subsequently contributed $145 million from the proceeds of the sale of his shares in the uranium mine to the Clinton Foundation. Records of this transaction would likely be on the Clinton server but in order to subpoena them, a Grand Jury would need to be summoned.

Are both cases settled?

Great framing. Just the outcome they wanted from the FBI's "security inquiry"...no criminal charges and something the campaign can work with/spin.
