Breaking - FBI Director Comey not recomending indictment

Just watched FBI Director Comey's Statement to Press on Clinton email server and email investigation:

Comey said, based on past cases, FBI would not recommend to Department of Justice any criminal charges be filed.

Other remarks by by FBI Director Comey (based on my handwritten notes) follow:

1. Said he had not cleared his statement with any other official in the Federal Government.

2. Claimed that while they recovered some of the deleted emails, they could not recover all of them.

3. Began investigation after referral from intelligence agency over concerns classified information was maintained on Clintons private servers. Made a point ot say this was not one server, but several, as well as multiple devices used.

4. Found evidence of 110 emails from the 30,000 provided by Clinton that contained (a) 8 email threads that Top Secret information (highest level), 36 that contained Secret information and 8 that contained confidential information (lowest level). Also found 2000 emails that were later up-classified to have contained confidential information.

5. Found several other emails not provided by Clinton from other sources, including emails retained by recipients of her emails. Of those recovered emails, 1 contained Secret information and 2 contained confidential information.

6. Was unable to forensically recover all of the emails that Clinton deleted. Stated her aides who received those emails scrubbed their devices or accounts in such a way as tom make it impossible to recover.

7. Found no evidence of deliberate or intentional misconduct by the lawyers who worked to delete the emails not turned over to State Department. Said lawyers for Clinton did not read emails, only subject matter headers, after searching the data base by using various "search terms."

8. Did conclude that Clinton was "extremely careless" in her handling of top secret and other classified information on her servers. Evidence showed that reasonable person should have known it was not safe to have such information on servers not maintained by the US government. States many people were aware Clinton was using a private server for her emails.

9. Stated Clinton's servers were not protected from intrusion by hostile interests as well as government servers or even servers used by private companies such as Google regarding their gmail.com servers.

10. Found no evidence of intrusion of Clinton servers by foreign entities or hackers, but said the potentially her servers were hacked because it was unlikely evidence of the intrusion could be discovered after the fact due to the poor security protection of Clinton servers.

11. Did find evidence that email accounts of Clinton email corespondents were hacked.

12. Stated Clinton made a habit of using her devices to send emails while in foreign counties or other places.

13. Though the FBI could find no evidence of hacking, their assessment is that foreign or hostile interests likely did obtain classified information as a result of her use of unprotected private server on which she maintained classified information.

14. Did not recommend indictment because FBI determined that no reasonable prosecutor would bring case based on these facts. All prior cases in which indictments were brought involved instances of intentional action, and FBI found no evidence that was the case here. Did not comment on whether the "extreme carelessness" he spoke of earlier was sufficient to meet the alternative standard of "gross negligence" in the statute to Clinton with criminal violations.

15. Claims this did not mean that what Clinton did was right, or should carry no consequences, only that he would not recommend criminal charges.

16. States investigation was above board and apolitical. He stated he was proud of the professional manner in which FBI investigated this case.

He then left podium and took no questions from press at that time.

There is evidence to support a conclusion that any reasonable person in Secretary Clinton’s position, or in the position of those government employees with whom she was corresponding about these matters, should have known that an unclassified system was no place for that conversation.

The second case involved public corruption

The FBI investigation into Hillary Clinton’s use of private email as secretary of state has expanded to look at whether the possible “intersection” of Clinton Foundation work and State Department business may have violated public corruption laws, three intelligence sources not authorized to speak on the record told Fox News.

This new investigative track is in addition to the focus on classified material found on Clinton’s personal server.

"The agents are investigating the possible intersection of Clinton Foundation donations, the dispensation of State Department contracts and whether regular processes were followed," one source said.

The development follows press reports over the past year about the potential overlap of State Department and Clinton Foundation work, and questions over whether donors benefited from their contacts inside the administration.

with the destruction of all of those emails which probably were the smoking guns in the case of corruption. Comey stated that they were only able to recover a small percentage of the deleted emails.

IMHO, once Hillary Clinton decided to mix SOS emails with her so-called private emails on her private server, all the emails automatically became the property of the US government. IMO, that means that she destroyed US government property and destroyed evidence. Maybe an attorney her can enlighten us on that fact or point out where I am wrong. Thanks.

We all knew that an indictment was a long shot, at best. Also, how can Comey make these two statements with a straight face?

“Although there is evidence of potential violations of the statutes regarding the handling of classified information, our judgment is that no reasonable prosecutor would bring such a case.”

“To be clear, this is not to suggest that in similar circumstances, a person who engaged in this activity would face no consequences.”

He's basically saying that she's guilty, but he won't recommend an indictment. Anyway, it's a pyrrhic victory for Hillary, since "I'm not a crook" isn't exactly a potent rallying cry.

It is "likely" that hostile interests got classified information:

Query: Was the classified information from Hillaryleaks more or less sensitive than Wikileaks?

One conclusion: Hillaryleaks were obtained as they were generated and therefore more timely than Wikileaks, which were released years (?) after the fact.

Second conclusion: We know exactly what was revealed by Wikileaks. The "damage" to national security is a known quantity.

There is no way of knowing exactly what information hostile interests acquired from Hillaryleaks, so the "damage" to national security is more serious because we must presume that every single email Hillary sent or received could have been acquired by any number of unidentified hostile parties.

He's saying no reasonable prosecutor would bring criminal charges. If she were still in government she could face administrative sanctions. Dismissal would be the most serious. Loss of security clearance would be an option, and for a SoS probably enough to force her out. Many more people face administrative action than criminal charges.

I'm not saying that would have happened to Hillary. Comey may be right that there would not have been a criminal case against someone else. Someone else would have faced administrative sanctions.

Nothing in his statement suggests that he's a big fan of HRC.

I've heard her say that in an interview. She would not acquiesce. Why should she when she is not beholden to the establishment in any way? She'll take it to the courts. I don't see her making any sort of grand bargain with Hillary (or Trump). Hillary has something like 40% in the polls and it will go down further, especially with every point given to Jill Stein. We can do this. We can get Jill Stein her 15% (bringing Hillary to 25% or less) and then, after the debates, we can make Jill President and create a whole new much, much better World.

I am really sad about this item, it just confirms we have lost our way. Too many people are not engaged and too few of us give a rat's ass. Well fuck it! I am still going to fight and work against every Democrat going forward. Does that mean I am a Republican- no. I am an independent and will no longer vote for any Democrat because they let this crime happen. The president is giving rides to this criminal- yes she is one because if this had happened to you or me we would be in jail.

From this day forward I will work to break the democratic party because it has been hack-jacked by criminals- it is worse than the mafia.

What can you do- educate people use facts and data not emotions, someone people will not care or listen but you will convince others of the "fix" and system is working against them. Also, do not donate to a party unless it is a third party because both groups are just criminal organizations. Finally, vote but not for any incumbents unless they are third party candidates.

So he says. Indictments for gross negligence and destruction of evidence would have rescued the dem party, but Comey just effectively stuck a fork in it by not recommending justice be served. It's a two-fer: make a case for her carelessness and incompetence, while letting her get away with what any reasonable (his word) person would consider criminal misconduct. Disgusting.

Navy engineer sentenced for mishandling classified material

Nishimura, deployed in Afghanistan in 2007 and 2008 as a regional engineer, admitted to downloading classified briefings and digital records onto his personal electronic devices. He carried the materials off base and brought them back to the U.S. when his deployment ended.

An FBI search of Nishimura's home turned up classified materials, but did not reveal evidence he intended to distribute them.

He was sentenced to two years of probation and a $7,500 fine, and was ordered to surrender his security clearance. He is barred from seeking a future security clearance.

The little guy gets zapped.

Norway's funding of Clinton Foundation under scrutiny

Dagbladet first reported that Norway’s contributions to the Clinton Foundation are broken up into sub-groups in order to make the combined contributions appear smaller than they actually are.

The foundation, which created by former US President Bill Clinton and has current presumptive candidate for president Hillary Clinton in a key role, reports funds from Norway and the Norwegian Agency for Development Cooperation (Norad) separately and further splits up the support between the different parts of the foundation, each of which reports its own donors.

Norad reports that the Norwegian contributions to the Clinton Foundation have amounted to $89.6 million (747 million kroner) between 2007 and 2015, while the Clinton Foundation’s website lists the support as between $10 and $25 million.

Dagbladet also pointed out that the Clinton Health Access Initiative, which has been an independent organization since 2010, has received Norwegian financial support that is not reflected amongst the list of donations to the Clinton Foundation.

The newspaper then reported that an internal memo from Norad contends that Foreign Minister Børge Brende broke the government’s own foreign aid principles by giving the Clinton Foundation 30 million kroner last year.

The Clinton's will leave a BIG brown fecal stain on HIS legacy due to all this. While HRC supporters are cheering no indictment what comey said was that HRC did things a SOS should never have ever done, that she jeopardized national security and showed extremely BAD judgement.

Now the credibility of the entire Obama state department is being called into question.

Remember Comey's words, "no reasonable prosecutor would bring this case." And I am sure that Comey was informed that Lynch was a "reasonable" prosecutor, over the weekend....after Bill's little Tarmac visit to his very reasonable appointee. Everybody involved gets to keep their job. Isn't that reasonable?
