Convicted spy cites Clinton emails to seek leniency
A Navy sailor who has pleaded guilty to espionage charges for photographing classified areas of a nuclear submarine is citing Hillary Clinton’s email setup in an effort to avoid jail time.
Lawyers for 29-year-old Kristian Saucier told a federal court in Connecticut on Friday that the Justice Department’s decision not to press charges against Clinton, despite the existence of classified material on more than 100 messages on her machine, was one of several cases that should compel a reduced sentence.
His attorneys argued:
“Wherefore, it will be unjust and unfair for Mr. Saucier to receive any sentence other than probation for a crime those more powerful than him will likely avoid.”
Really can't contradict that one, myself, but my guess is that the judge laughed at a little person trying to get a similar break. He'll be sentenced on Friday...
This guy would not have been caught/prosecuted had he kept his cell phone (camera) to himself - it was found at the bottom of a dumpster.

to see how this shakes out. My non-attorney guess will be the judge says the clinton sham has nothing to do with Mr. Saucier's case. They are 2 separate cases. Therefore, Mr Saucier, you are one screwed dude...firing squad for you, caviar for the clintons!

Federal diary in the WaPost had an article on how mere mortal federal employees are treated for security violations right after comey's statement. Several lawyers who specialize in defending clients whose security clearances are at risk weighed in. They said as soon as the petraeus slap on the wrist was handed down they started using that to defend their clients, and that they fully intended to use the Clinton defense.
It may or may not work in the case you cite, but it will in others.

Petraeus was charged; Hillary was not.
Establishment media, including the Military Times, have establishmentsplained that what Petraeus did was ever so much worse than what Hillary did.
So there.
Not so much two separate cases as
several different systems of justice.
The system of justice applicable to Hillary means no charges at all.
The system of justice applicable to Petraeus means misdemeanor charges.
The system of just applicable to Chelsea Manning and Edward Snowden means no quarter whatsoever, ever.
