Unusual Intervention by McCabe, Yates, in FISA Application

Trisha Anderson, the principal deputy general counsel for the FBI and head of the bureau’s National Security and Cyber Law Branch, who approved the application for a warrant to spy on Page before it went to FBI Director James Comey. During her Aug. 31 testimony, she described the FISA application process as being a linear path and noted there is a specific “system called FISAMS within the Bureau that tracks in a linear fashion all the approvals on a FISA.”

Yet, despite the rigid description provided by Baker and Anderson, it appears the linearity process was not adhered to in the case of the Page FISA. According to Anderson, pre-approvals for the Page FISA were provided from both Deputy FBI Director Andrew McCabe and Deputy Attorney General Sally Yates, before the FISA application was ever presented to her for review.

“[M]y boss and my boss’ boss had already reviewed and approved this application. And, in fact, the Deputy Attorney General, who had the authority to sign the application, to be the substantive approver on the FISA application itself, had approved the application. And that typically would not have been the case before I did that,” said Anderson.

Anderson told investigators that the Page FISA “was handled a little bit differently in that sense, in that it received very high-level review and approvals — informal, oral approvals — before it ever came to me for signature.”

15 to 20 FISAs Signed in 20 Minutes

The signing process by the FBI Director appears to be more of an official act than any sort of actual review. Anderson testified that the Director might receive 15-20 FISAs to sign each day that contained large amounts of documentation.

“[They’re] very thick. It’s not unusual for the Director to receive a stack this tall. I’m indicating about a foot and a half between my hands here, for the benefit of the reporter,” Anderson said.

Anderson testified that the FBI Director was allotted 20 minutes in which to review the entirety of the day’s FISA applications—not 20 minutes per FISA.

Mlr. Baker (House Majority Investigative Counsel): And you said just a minute ago — I thought you said that the Director has 20 minutes set aside to review all the FISAs?

Ms. Anderson: Approximately, yes

The Woods file, which provides facts supporting the allegations made in the FISA application, is attached to every FISA application and is provided by the originating FBI agent in each case.

However, Sally Moyer, who was a unit chief in the Office of General Counsel, told lawmakers that only the originating agent and the supervisory special agent in the field actually look at the Woods file during the preparation of a FISA application:

Mr. Somers: So you don’t — do you review the Woods’ file?

Ms. Moyer: No.

Mr. Somers: Did you review the Woods’ file in the Carter Page application?

Ms. Moyer: No.

Mr. Somers: Okay. So beyond the case agent, who looks at a Woods’ file?

Ms. Moyer: The supervisory special agent in the field.

Mr. Somers: In the field. But no one else out of the field of that chain looks at a Woods’ file in general?

Ms. Moyer: That is correct, except both of those individuals sign the Woods’ form indicating that the facts are true and accurate and that they have documents to support those facts.

Mr. Somers: Do you know if that happened in the case of the Carter Page?

Ms. Moyer: I don’t think it did in this case.

Mr. Somers: Previously you had mentioned, I think, that to your knowledge an audit or a Woods review has not been performed on the Carter Page FISA.

Ms. Moyer: Correct.

Meanwhile, Moyer testified that without the Steele dossier, the Page FISA would have had a “50/50” chance of achieving the probable cause standard before the FISA court. Notably, to this day, the Steele dossier remains unverified by the FBI and is considered largely discredited.

A damning 99-page April 26, 2017 unsealed FISA Court Ruling issued by presiding FISA court Judge Rosemary Collyer provided further insight into additional FISA abuse engaged in by the intelligence community in relation to Section 702 data and minimization procedures.

to come to grips with the information as it becomes public because it's partial and it's in and out of sequence. And even when it becomes public, it's sometimes full of redactions.

A couple of things stay clear for me though. One is that the NSA Director, Michael Rogers, was alerted during the 2016 primaries that private contractors had unwarranted access to FISA data, and upon that notification he stopped it. He put an end to it. The other thing is that the DNC later established in a lawsuit against Russia that the date they found they were being hacked was just after the date that NSA Director Rogers stopped the contractor access.

Those two things leap out at me. So I've wondered if Trump won't release documents because they may show the DNC was being surveilled by the RNC, or some other political entity connected to his party, or even his campaign. The DNC is covering it up because it could be the Atlantic Council, or one of the Council's bad boy contractors, or, of course, it could have been the CIA or any one of its many private entities. Obviously nobody really wants the information to become public, except the American people.

Personally, I think the DNC was being surveilled under a warrant by the FBI. And I think the person who gave Wikileaks the DNC emails was in law enforcement, a whistleblower. The emails are evidence of violations of money laundering and voter suppression.

But what does this have to do with FISA? The FISA court and its warrants have to do with foreign agents acting in the U.S. Could the Podesta brothers' activities have activated a warrant? Or could investigation of Clinton's State Department activities have activated a warrant?

Would Trump, then, be constrained from releasing such information because it exposes the complete corruption, foreign and domestic, of our entire government?

This sounds the most likely explanation to me. The Swamp includes Dems, Repubs as well as some unaffiliated Alphabet agency SES employees. Public service is so passé, it’s only about the Benjamins now.

It’s enough to give you the warm and fuzzies.

Now is the time for mass petitions for retrial or filing of appeals. Too many people were tarred and feathered in a concentrated effort by the ‘Left’ to actually rig our government for the worst candidate in history. In a law abiding country, there would be plenty of worried people right about now.
