6-13-2016 – LAS VEGAS REVIEW-JOURNAL – Pahrump woman arrested for falsifying party affiliations on voter registrations – CARSON CITY — A Pahrump woman was arrested Wednesday on 11 felony charges involving allegations she falsified party affiliations while registering voters before the June 14 Nevada primary, the secretary of state’s office said. An arrest warrant issued for Tina Marie Parks listed bail at $50,000 cash or $100,000 bond. The arrest follows an investigation conducted by the state’s Election Integrity Task Force after it received complaints from voters who said Parks, while working for the conservative outreach group Engage Nevada, filled out their applications and listed the wrong party affiliation.

7-18-2016 An Electoral System in Crisis lulu Fries’dat & Anselmo Sampietro in collaboration with Fritz Scheuren - Fritz Scheuren, a member of the statistics faculty at George Washington University, and a former president of the American Statistical Association, has been a collaborator in this research. Examining the data from the study, Scheuren said, “As a statistician, I find the results of the 2016 primary voting An Electoral System in Crisis unusual. In fact, I found the patterns unexpected [and possibly even] suspicious. There is a greater degree of smoothness in the outcomes than the roughness that is typical in raw/real data." This is a 39 page detailed scholastic analysis of our broken election system. Excerpts:

In January 2014, The Presidential Commission on Election Administration published a report stating, “Perhaps the most dire warning the Commission heard in its investigation … concerned the impending crisis in voting technology. Well-known to election administrators, if not the public at large, this impending crisis arises from the widespread wearing out of voting machines purchased a decade ago (p.62.)” This report was issued over two years ago, but unfortunately very little has been done since then to rectify the problem. So the issues we are reporting here, of security problems on old and failing machines, are not surprising. However we did find security issues with even newer electronic voting equipment, such as the machines in New York State. At a congressional briefing on voter suppression, held on April 21, 2016, Rep. Hank Johnson (D-Georgia) expressed grave concern about the security of the voting equipment: “There is a very insidious, treacherous and deceitful method of voter suppression, and it has to do with the integrity of the voting process itself… one possibility, and I think it's a very good one, is that someone's manipulating the counting of the votes. Someone is hacking into these computers that tabulate the votes."

An Environment of Corruption The portrait of an electoral system in crisis is further supported by reports from election integrity organizations, media outlets, and individuals on social media that voting is increasingly taking place in a corrupt environment. This contextual evidence of voters purged from the rolls, registrations lost in the mail, party registrations being changed without a voters’ knowledge or intent, voters being sent incorrect ballots, a shortage of ballots, polling places being closed, discouragingly long lines in targeted precincts and states, and disturbingly large disparities between initial exit polls and official results, lends credence to the argument that if one form of fraud is already in play, another form of fraud is more plausible. This information is being aggregated by election integrity groups such as Election Justice USA, through voter testimonials and lawsuits that are in progress around the country.

Voter Fraud vs. Election Fraud There is one other critique that is worth taking the time to examine. Professor J. Celeste Lay’s comment in an interview with Doug Johnson Hatlem is a good example of this: “Most of this discussion is driven by Sanders supporters who are disappointed he is not winning and want to claim he has more support in the Democratic Party than he actually does … Until proven otherwise, I’ll go with the numerous studies demonstrating the infinitesimal amount of voter fraud in U.S. elections.” Lay is conflating voter fraud with election fraud. They are opposite behaviors. Voter fraud is when a single voter is trying to scam the system by voting twice, or voting when he or she is not authorized to do so. It has been demonstrated to be rare in the U.S. Election fraud refers to the illegal interference with the process of an election. In election fraud, the voters are the victims of an organized effort to rob them of their rightful influence. How common is it? According to Walter R. Mebane, Jr. and Allen Hicken, both on the political science faculty at the University of Michigan, election fraud occurs in a majority of democracies. In their 2015 Guide to Election Forensics, they write, “During the first half of 2015 alone, for example, allegations of election fraud occurred in Bangladesh, India, Israel, Macedonia, Nigeria, Pakistan, Russia, Togo, the United Kingdom, the United States, and Zambia … data compiled by Kelley and Kolev (2010) on national An Electoral System in Crisis elections conducted in more than 170 countries from 1978–2004 indicate … 61% of countries experienced some degree of (known) cheating.” In correspondence, Mebane was firm that, “the problem of detecting election fraud really is extremely difficult.” This raises the larger issue: Is it incumbent on the voting public to police elections and prove that fraud is taking place? Or is it more appropriately incumbent on election officials to provide convincing evidence that the election results are accurate and secure?

7-19-2016 – ThinkProgress – Federal Judge Strikes A Critical Blow Against Wisconsin’s Voter Suppression Law – To prevent voters who cannot reasonably obtain ID from being disenfranchised, the federal judge Adelman issued a temporary order requiring the state to accept affidavits from voters who say they could not obtain an ID. It’s a serious blow to the state’s voter suppression law, although one that still must clear a very difficult hurdle if it is to remain in place. Adelman previously struck down the voter ID law, but this law was reinstated by an especially conservative panel of a federal appeals court.

The exit polls have been adjusted to fit electronic vote totals since 2004 when they appeared to show Kerry winning against Bush. Explanations were developed at that time to explain the differences between the exit polls and the vote totals which was that exit polls are generally unreliable. This assessment of exit poll reliability was developed by Karl Rove who was an assistant to George Bush. In order to keep the Media Consortium business money coming in, Edison Media Research has always edited, or “cleaned” as they put it their data since that time. The raw data exit polls are stored at the University of Connecticut. No one has ever requested them. We are requesting it for the first time.

People who want to see raw data are often labeled “conspiracy theorists”. We want to make sure you know that we will be described as such. Actually, we are just people wanting to see unedited exit polls and to learn what really happened during our primary elections. As you may know, the exit polls and the electronic vote totals are very different in eleven states. The Media Consortium and Edison Media Research canceled the exit polls for California, New Jersey, Delaware, South Dakota, North Dakota, Montana, New Mexico and Puerto Rico, after receiving a letter from Cliff Arnebeck, the other lawyer who works with Bob Fitrakis asking the Edison Research to put a hold on the raw data.

We are expecting the Edison Media Research to file a motion to dismiss. They have up to sixty days to do this. During this time, we need to spread the word about this lawsuit to as many people as possible. We also need to raise funds to address further legal costs. Our costs are going to rise significantly now. If we raise money beyond our legal costs, we will be able to direct some of this money towards alternative media education so that many people in the US begin to know about the kind of election editing that goes on.

If we are successful with this lawsuit, we will then file another lawsuit to look at the paper ballots. Everyone will be educated throughout this process about the real role of Edison Media Research and the Media Consortium in presenting news about our elections. The Media Consortium consists of CBS, NBC, MSNBC, ABC, Fox News and the Associated Press (AP). Our examining the ballots will show us who really won the Democratic presidential primary. Although Bernie may have already conceded by that time or before then, at least he will know what the truth was about how many votes he really garnered. He can do with that what he wants. Additionally, voters will know the truth about the Democratic presidential primary and how votes were handled.

6-29-2016 Election Justice USA files lawsuit to Stop the Certification of California Primary Results – Attorney Bill Simpich of Election Justice USA, with plaintiff Citizens Oversight under the direction of Ray Lutz, filed a complaint for injunctive and declaratory relief against the state of California intended to stop the certification of the June 7, 2016 Presidential primary results. The defendants in the case are Alex Padilla, Secretary of State of the State of California; Michael Vu, San Diego County Registrar of Voters; Helen N. Robbins-Meyer, San Diego County Chief Administrative Officer; and San Diego County, a municipality. The filing indicates several issues with the large number of vote-by-mail (VBM) and provisional ballots and cites the Registrar of Voters office’s failure to adhere to the Voter Bill of Rights (Elections Code Section 2300), which protects citizens’ rights to proper observation of all aspects of the voting process, as well as ballot counting procedures. The primary cause of action is based on the violation of the right to vote. The intent of the voter was compromised when voters were not given proper ballots by which to exercise intent. Because of this, high numbers of write-in and provisional ballots have been removed from the counting process. In addition, the plaintiff alleges that the ballots cast for the Democratic presidential candidates have not been fully counted by either Defendant Vu or the county registrars.

I tweeted the Orange County Registrar, among others: @LACountyRRCC: “NPP provisional voters issued DEM ballots will be processed as NPP-DEM crossover with the Pres vote as marked.” @OCRegistrar? His response:   @SimonRedacted that is the way we have always processed them. So one county just implemented the policy thanks to a handful of eagle-eyed and vigilant volunteers. Another claims it has always been thus. I fear this rather egregious lack of uniformity among California counties in their vote-counting methodology is yet another tip of yet another iceberg. Who are you going to believe: us, or your lying eyes? That’s the good word from Democratic Party powers that be and their transcribers in the corporate media, in response to the “allegations” by Bernie Sanders supporters that the nomination was stolen by Hillary Clinton.

I used scare quotes around the word “allegations” because the truth is plain to see and undeniable by anyone with a microgram of honesty: Hillary Clinton cheated. If the rules had been followed, Bernie Sanders would be the nominee.

As with all things Clinton, of course, definitions matter. It depends on what the meaning of “cheat” is.

To most people, “cheating” means breaking the rules of a contest. By this standard definition, there’s no doubt that the Clinton campaign, its political allies and the Democratic National Committee cheated in favor of Clinton and against Sanders. They broke the law. They disenfranchised voters. They broke party rules. And they violated long-standing customs that are so widely accepted that they are essentially de facto rules of the Democratic Party and the American political system.

Bernie Sanders, on the other hand, ran a clean campaign.
