Why are democrats helping McConnell turn the courts right?

We know there are democrats who are told to vote republican so that other democrats can get excused to not vote therefore giving them fake progressive bonifides.

Bernie keeps saying that we must vote Trump out because he is the mostest dangerous president of our lifetime. How come he doesn't rip democrats for helping Trump be that most dangerous president of our lifetime? Why doesn't he call Pelosi out for funding Trump's heinous agendas? Kids in cages? Defund DHS until they are released.

And has anyone heard of democrats being outraged over the unnecessary hysterectomies being done on immigrant women? I have seen a few tweets from the ladies of the squad, but that's it.

We are witnessing kabuki theater on a daily basis with the most corrupt congress in my lifetime. They don't even pretend that they care about our lives. Not when they did the biggest transfer of wealth to the upper class while not doing a damn thing for millions of American's who stand to lose everything. Utility shutoff moratoriums are coming to an end just in time for winter unless congress acts. Millions are at risk at being evicted from apartments and homes because both parties refuse to act.

What will Biden supporters do when he continues doing what Trump is doing on many issues? Issues that Trump is continuing from the Obama era who continued doing them from the Bush era. What will they do if democrats roll over and let McConnell appoint another Supreme Court justice? Is there anything the can do? Yes. Hillary has offered these 3 suggestions. 1 and 2 are nonsense IMO, but 3 is what they could have done to force McConnell to give Garland a vote. Gee...why didn't they do that? Hmm? Obama? Why did you just roll over for McConnell?

Hillary Clinton has offered a three-part plan for fighting against the rapid replacement of Justice Ginsburg:

1) Win over GOP Senators on principle.

2) Pressure GOP Senators in tight re-election bids.

3) Use procedural obstacles in the Senate.

- To start with, Democrats must refuse a continuing resolution so long as there is any threat of McConnell forwarding a nominee.
- In addition, Democrats must deny the Senate unanimous consent. Not just unanimous consent on the nomination, but on everything. The Senate has less than two weeks of scheduled sessions in the remainder of the year. Democrats need to deploy every possible roadblock to scheduling hearings, holding hearings, bringing a nominee forward, scheduling a vote … these are delaying tactics.

I have no hope that democrats will fight McConnell with every trick in the book because they did not use them to make him bring Garland up for a vote. Nor have they been "Resisting" republicans nor Trump in the last 4 years. Sure they bitch and moan a lot about what's happening and pretend that they can't do anything about, but boy is that a fundraiser money maker for them. Jimmy covers what dems could have done and why they did not do a damn thing. He also reminds of that Rand Paul shuts down congress whenever he f'cking well wants to. Republicans placed secret holds or filibusters during Obama's tenure, but democrats never use that option. If Rand Paul can bring congress to a screeching halt, then why couldn't Bernie have done that on the 1st CARES act? Hint: He could have. He just didn't want to. Jimmy rails on how Bernie has never once stood up to Schumer. Well he is not alone. Is he?

Democrats have no problem if right wing judges overturn past legislation that previous democrats have passed. They want lots of rights and legislation overturned because that is what their donors want. Plain, Simple and Period

My first reaction upon hearing about RBG was that the pressure campaign will get even louder than it already is to vote out "the most dangerous POTUS of our times" and told a friend that. I'm sorry to report, but not surprised AT ALL, that she thinks that will be a great thing! Today I hope Biden/Kopmala win so maybe she'll pull her head out of her ass and see the reality, but even if they do win I highly doubt said head gets removed from said asshole. And really, I'm not even pissed off at her about it anymore, what would be the point? Trump has already loaded up the circuit courts with right wingers FOR LIFE, and how many Democrats voted to confirm those judges, if that is even required (I confess I am not sure)?

How many times are we going to watch this same shit show and think things will change? What on earth would make my friend think that Biden is going to save us? Sounds just like "Make America Great Again" to me, but to point that out is heresy now on the "liberal" side. It's important to have completely BLIND faith, be blind to the reality and wish upon a falling star, the American Way. Either that or pray real, real hard and just maybe a few crumbs will be thrown your way as we all ease into the abyss, just BELIEVE and the abyss will be avoided and America can return to normal. They have been doing this since the 1st person Mitch put up. Schumer has let McConnell fast track up to 15 judges at a time. Once he did it so democrats up for re-election could go home early to fundraise. Yeah fundraising is more important that turning the courts right. He did that at least 3 times if not more.

Jimmy's monologue has a lot of information on what dems have been doing and what they did not do when McConnell refused to allow a vote on Garland. One thing he says it was a ruse to get people to vote for HerHeinous because of the importance of the SC pick. And of course I am seeing lots of people blaming Stein and those who voted for her for us being in this mess. Welp, first off Her won 3 million more votes than Trump. Her did not even do anything in Wisconsin and other states to try to rally people to vote for her. No. Instead she went to another California fundraiser even though she did not need the money.

The ONLY person responsible for Hillary's loss is Hillary. Period. I do hope your friend's head sees the sun again sometime soon.

Not so recent for me. As the Senate majority, Democrats confirmed the unqualified (and sexual harasser) Clarence Thomas as the replacement for Thurgood Marshall. A generation earlier Senate Dems said no to Nixon's unqualified nominations. And only four years earlier Senate Dems said no to the odious Bork.

As of 2005 there were but two women on the SC (and had only ever been those two). One retires and not just a man, but a staunch anti-abortion Catholic man, was nominated to replace O'Connor. Democrats (the ones oh so into ID politics) rolled over. Could hardly be bothered to not just say no, but hell no.

Guess we let all those Catholic men decide what women may do with their bodies.

Caitlin Johnstone: RBG death means two-headed uniparty will threaten Americans with removal of civil rights

US Supreme Court Justice Ruth Bader Ginsburg has died, which means the US election is going to revolve around abortion and other civil rights for the foreseeable future.

Which won’t change much, since this presidential race hasn’t really been about anything since the end of the Democratic primaries.

The opportunistic galvanization process has already begun before Ginsburg’s body is even cold, with liberal influencers calling on Democrats to rally to a November win for “the notorious RBG,” and Trump supporters dropping their faux anti-establishment schtick and metamorphosing into a bunch of mini-Mitch McConnells.

Leftists are being shrieked at by mainstream Dems that they need to fall in line and support Biden or they’re personally responsible for every civil right that is taken away by Ginsburg’s replacement.

I’m not here to tell Americans how to vote in November. I’d just like to quickly point out, once again, that an establishment which threatens to remove your civil rights if you don’t support it is an establishment that doesn’t deserve to exist.

Of course, it doesn’t look like that’s what’s happening if you subscribe to the mainstream consensus perspective that America’s political system has two separate and oppositional parties. If that is your viewpoint, you will see one bad party trying to take away people’s civil liberties and one good party trying to stop them.

If, however, you recognize that America has two parties that are owned and operated by a single oligarchic class which has more or less the same overarching goal as far as ordinary people are concerned, it looks completely different.

If you understand that America has a two-headed one-party system designed to shrink the spectrum of acceptable debate down to arguments about how oligarchic agendas should be facilitated rather than if they should, what you see is a single entity threatening to take away your civil liberties if you don’t support it. A single establishment threatening to punch you with its right hand if you don’t let it punch you with its left.

What is the correct response to such a situation? Is it to give the two-headed monster what it wants? Is it to give your energy to supporting the same establishment which is threatening to take away your civil rights?

Or is it to fight? Is it to pour your energy into tearing down an abusive political system which threatens to rob your civil rights if you don’t plug yourself into the mainstream oligarchic establishment? A system which throughout your entire life has done nothing but rob you and pour your nation’s wealth into wars, tax cuts and ever-expanding neoliberal exploitation, regardless of how you’ve voted?

If you think the correct response is the latter, consider refraining from giving your energy to the Supreme Court debate in the coming months, and focus on waking people up to what’s really going on in the world so that they can see their two-headed abuser for themselves.

Again, vote or don’t vote in whatever way you think best; how Americans choose to participate in a pretend election is none of my concern. But do be mindful of those who try to route your energy into a political establishment that has never served you and never will.

In the corrupt universe of American politics today, however, hypocrisy is the coin of the realm. This is especially true when it comes to the US Congress, which long ago stopped advocating for the American people and constitutionally protected individual rights, and instead took up the banner of monied corporate interests. That this corruption would extend to the Supreme Court was only natural – while Article III of the Constitution established the federal judiciary, inclusive of “one supreme Court,” it left how this court would be organized up to Congress.

The struggle between Congress and the Supreme Court has been ongoing since the birth of the United States. The self-appointed power of judicial review, where the Supreme Court, through its 1803 decision in Marbury v. Madison, determined that it had the ability to declare a legislative or executive act in violation of the Constitution, is in and of itself not a constitutionally mandated power. Rather, it represents the Supreme Court’s interpretation of the Judiciary Act of 1789, which was determined by the justices to be contrary to Article VI of the Constitution, which established the Constitution as the supreme law of the land.

Name anyone tRUMP has appointed for any dept. whether it's HUD,Labor, Health and Human services,Interior, Transportation, Energy,Commerce, Justice, etc.then compare it to Obama's appointments and the only real difference is the public image and the speed at which corporate interests are served.

The Dims are the Washington Generals basketball team, always losing. When they are in the majority in both Houses of Congress they claim the Minority Repug Party blocks them from accomplishing all the things they promised on their campaign trail.

When the Dims are in the minority they can't fulfill those promises because they are the minority and don't have that power, so you need to vote more Dims into office.

Meanwhile Repug legislation sails thru Congress again and again regardless of which one is the 'majority'.

Here was the head of the Dim Party, Barack Obama, doing negotiations with Repug House speaker John Boehner during the time of Obama's 'Cat Food Commission'. What a negotiator!

As you said that can go to any department head from either party. It’s just that Trump and people he’s appointed don’t see the need to hide what they’re doing. Paul Ryan said that he wasn’t threatened by his donors to cut taxes or else. So he cut them, but since they were passed so quickly republicans made lots of mistakes and needed democrat’s help in making it right. For their donors.

Both Pelosi and Schumer have been trying to change the SALT taxes that republicans screwed up. Rich people in some states can only write off $10,000 on their property taxes. Pelosi keeps putting it in the CARES act and Schumer has in a bill he’s says he will bring up if Biden wins. This was after democrats walked back rolling back the Trump tax cuts. Hey remember when the Bush ones were supposed to sunset during Obama’s tenure, but they made them permanent instead?

Here's a companion point of view: Republicans are driven to get and keep power. In fact, they feel they own the USA and the Dems are trespassers who get to cross their lawns only occasionally. On those rare occasions when Democrats are steering the ship the Republican Party does anything and everything to get their hands back on the wheels to further their agendas. There are no rules laws precedents or norms that they care about.

The Democrats, OTOH, crave money. $$$$$. lots and lots of money.

Democrats are entirely willing to cede power as long as the spigots of cash continue to surge in their direction.

So, it's not a fair fight. Obama sat back while his Supreme Court was stolen. I don't expect a thing from dems this time either.

Democrats will do as they usually do--- whine about process and rules and FFS impeachments while Republicans position themselves to never turn over the reins.

The only way Mitch McConnell doesn't seat another Judge is if he decides it would threaten his control of the Senate. If he can keep his members together and seat another Trump judge, then that's what he'll do.

Saying he would bring Trump's pick to a vote last night might have simply been Mitch trolling. So much fun to drive his opponents crazy.

More likely is that Mitch knows he has and will hold the votes and it is his intention to do so and land this plane in record time.

Howard Zinn hits it out of the park on how the Supreme Court upholds the constitution. When it’s convenient for them to do so. Or not when it’s something the real power wants.

It starts out with a zinger of truth:

It would be naive to depend on the Supreme Court to defend the rights of poor people, women, people of color, dissenters of all kinds.

It’s a big club and we ain’t in it.

I can understand that sinking feeling. Even listening to pieces of Roberts's confirmation hearings was enough to induce despair: the joking with the candidate, the obvious signs that, whether Democrats or Republicans, these are all members of the same exclusive club. Roberts's proper "credentials," his "nice guy" demeanor, his insistence to the Judiciary Committee that he is not an "ideologue" (can you imagine anyone, even Robert Bork or Dick Cheney, admitting that he is an "ideologue"?) were clearly more important than his views on equality, justice, the rights of defendants, the war powers of the President.

A great point:

If the Constitution is the holy test, then a justice should abide by its provision in Article VI that not only the Constitution itself but "all Treaties made, or which shall be made, under the Authority of the United States, shall be the Supreme Law of the Land." This includes the Geneva Convention of 1949, which the United States signed, and which insists that prisoners of war must be granted the rights of due process.

A district court judge in 2004 ruled that the detainees held in Guantanamo for years without trial were protected by the Geneva Convention and deserved due process. Roberts and two colleagues on the Court of Appeals overruled this.

When the Constitution gets in the way of a war, it is ignored. When the Supreme Court was faced, during Vietnam, with a suit by soldiers refusing to go, claiming that there had been no declaration of war by Congress, as the Constitution required, the soldiers could not get four Supreme Court justices to agree to even hear the case. When, during World War I, Congress ignored the First Amendment's right to free speech by passing legislation to prohibit criticism of the war, the imprisonment of dissenters under this law was upheld unanimously by the Supreme Court, which included two presumably liberal and learned justices: Oliver Wendell Holmes and Louis Brandeis.

Ruth Bader Ginsburg’s Death

First: her refusal to resign when she was diagnosed with pancreatic cancer in 2009 (on top of already being old) when Obama could have replaced her has caused an entirely avoidable crisis. She was selfish, put herself first and this is the consequence.

Bad, bad times, made worse by one old woman’s selfish disregard for everyone else. If that offends you, so be it. Important people don’t get “don’t say bad things about the dead” when everyone else has to suffer because of their decisions.

Senator Murkowski seems appreciate the character of most Americans in that they dislike dirty dealing even in politics. If McConnell proceeds, he will hand several Democratic Senate nominees another issue. Collins is attempting to inoculate herself on this but her statements so far, and like most of her statements over the years, is milquetoast. This might put her challenger over the top. Same goes for Sullivan (AK). Do North Carolina voters share in that American sense of fairness?

McConnell is such a snake. His only redeeming quality is he makes Schumer look like an ass; an ass that the other Senate Democrats choose for their leader.

First, I think they could have by now if they really wanted. But second, I think it’s too useful for them as you mentioned. It’s a reliable get out the vote and fundraising tool. That and 2nd amendment are a lot of what they have.

I think that we should put Krystal Ball's suggestion that god might help us to the test. We should get every man, woman and child in this country to stop what they are doing all at the same time, hold our arms up skyward and shout, "GOD HELP US"! can't stop bashing the left. They're worried that us Bernie Bros won't vote, or vote Green. The way democrats attempt to sway us is to relive HRC and 2016 and blame US for her defeat. Trump, RBG, all our fault. If we actually campaign for Biden, it won't enough, we didn't try hard enough, cheer lead enough. They're thinking is we lost the primary, Biden made (hollow insincere) lefty sounding noises (and then ran to the center), what more do we want? So we should just STFU. After all, we lost, we deserve nothing.

They hate the left, even though they need our votes. I can't see a POC candidate, or a LGBTQ candidate being told "you lost in the primary, you deserve nothing for your causes, so just shut up and get in line."

Well those enemies spent the last few decades moving policy to the right and making our lives worth, but yeah let's embrace them because they are saying mean things about Trump. Well where were those friendly enemies when the Trump tax cuts were being pushed through? When republicans were once again trying to gut the ACA? When Trump appointed industry insiders who had a history of trying to destroy what they had just been put in charge of? Or any of the other acts that McConnell and Trump have done to our detriment? HUH? Answer me that.

Maddow has spent the last 4 years bitching about the things Trump is doing after spending 8 years ignoring when Obama was doing them. She's not alone of course, but she came of age during Bush's assault on the constitution and people agreed with what she was saying. But then she went silent on those issues when it was a democrat doing it.

I am seeing lots of words written about people who vote 3rd party or don't vote at all. They think it our duty to vote against our principals or morals. I had a Twit spat with someone like this yesterday who blamed ME for Ginsberg dying during Trump's watch because I didn't vote for Hillary. I proudly owned that because I will not reward a warmonger, bank sellout, pro fracking and just downright bad candidate with my vote. Why is a candidate earning my vote not acceptable to those who ignored when Obama was doing what Trump is now doing?

Why haven't democrats addressed the GOP's gerrymandering when they had the power to do it? Why do they continue to not have enough voting machines in heavy, poor, minority districts so people don't have to wait in line for hours to vote? Why didn't they sue the states that closed hundreds of voting places during this past primary that left just a few open so people once again had to wait hours in line to vote during an epidemic?

Why did New York get away with throwing out close to 200,000 ballots in a district that would have gone for Bernie? Why why why does this keep happening and no one is held accountable?

Good grief this rant could go on all day. But WHY democrats? Yeah that's what I thought.

Why haven't democrats worked on ending the racist electoral college? One person on vote. Why is it that our elections really only come down to 3 states to determine who gets to be president while the rest of the states are set up so our votes don't count? Why should I stand in line for hours to vote in Utah when it has gone to the GOP since 1964? Why should anyone?

Why is this being treated as a bombshell idea?

I try to see this through the eyes of a younger person. For them, this is normal. They have no experience with a government, and democrats, that actually worked. I think Obama turned off a bunch of new voters with his hopey/changey bag of feel goodiness, while delivering nothing except corporate favors. That was a surprise to them. Clinton with her past history of delivering to corporate interests was well documented.

Now the left are Marxists, socialists (even communists) and hated by r's and d's. If Trump decided to go after us, Pelosi and Schumer and the dem leadership would join in with enthusiasm, if they didn't need our votes. After Nov. 3rd, I wouldn't put it past them to have a bipartisan beatdown on people like us.

Obama did turn off a lot of people with his presidency that failed most everybody who voted for him. He certainly turned me off within weeks of his winning. 1st the FISA vote for immunity for Bush spying on us and then his cabinet picks when he put the people who crashed the global economy in charge of it. And just when people started recovering from it they crashed the global economy again, but much worse this time.

And looking back at Biden’s history I see his hands all over where we are now. He made it impossible to discharge student loans, but kept things so people like Trump could declare bankruptcy over and over. Sirota wrote how companies that are going to declare bankruptcy are loading them up with debt so that they can give themselves bonuses. And of course judges let them get away with it. Yeah I’d be mad too.
