Federal prosecutors concluded an 18-month investigation into a former congressional technology staffer on Tuesday by publicly debunking allegations — promoted by conservative media and President Trump — suggesting he was a Pakistani operative who stole government secrets with cover from House Democrats.

As part of an agreement with prosecutors, Imran Awan pleaded guilty to a relatively minor offense unrelated to his work on Capitol Hill: making a false statement on a bank loan application. U.S. prosecutors said they would not recommend jail time.

The plea agreement included an unusual passage that described the scope of the investigation and cleared Awan of a litany of conspiracy theories promulgated on Internet blogs, picked up by right-leaning news sites, and fanned by President Trump on Twitter.

“The Government has uncovered no evidence that your client violated federal law with respect to the House computer systems,” including stealing equipment or illegally accessing or transferring information, prosecutors wrote in the plea agreement dated and signed Tuesday.

“Particularly, the Government has found no evidence that your client illegally removed House data from the House network or from House Members’ offices, stole the House Democratic Caucus Server, stole or destroyed House information technology equipment, or improperly accessed or transferred government information, including classified or sensitive information.”

Memo confirms DNC server disappearance

Over 40 offices in the House of Representatives may have fallen victim to an “IT security violation,” according to a secret memo from top congressional law enforcement to the Committee on House Administration.

The memo, written in part by Paul Irving, the House’s sergeant at arms, detailed the disappearance of a server for the House Democratic Caucus following its marking as evidence in a cybersecurity probe. Imran Awan, email server administrator to former DNC chair Debbie Wasserman Schultz, and members of his family had logged into the server more than 7,000 times between 2015 and 2016 without proper authorization.

Since then, the memo alleges, the caucus server holding emails from lawmakers has been replaced by a lookalike, but the original is gone.

“[The Awans] deliberately turned over a fake server to falsify evidence,” they said, noting that the data itself was “completely out of [members’] possession.”

Chutkan on Tuesday granted the defense's request to remove Awan's court-mandated electronic tracking device, but kept in place a limit Awan traveling beyond 150 miles from his residence.

A secret memo marked “URGENT” detailed how the House Democratic Caucus’s server went “missing” soon after it became evidence in a cybersecurity probe. The secret memo also said more than “40 House offices may have been victims of IT security violations.”

In the memo, Congress’s top law enforcement official, Sergeant-at-Arms Paul Irving, along with Chief Administrative Officer Phil Kiko, wrote, “We have concluded that the employees [Democratic systems administrator Imran Awan and his family] are an ongoing and serious risk to the House of Representatives, possibly threatening the integrity of our information systems and thereby members’ capacity to serve constituents.”

It details how the caucus server, run by then-caucus Chairman Rep. Xavier Becerra, was secretly copied by authorities after the House Inspector General (IG) identified suspicious activity on it, but the Awans’ physical access was not blocked.

The six-page letter says:

• In September of 2016 … the CHA and [IG] briefed the former Chairman of the Democratic Caucus about suspicious activity related to their server that the [IG] identified. As a result, the former Chairman of the Democratic Caucus directed the CAO to copy the data from their server and two computers.
• The CHA directed the IG to refer the matter to the US Capitol Police. The USCP initiated an investigation that continues to this day.
• In late 2016, the former Chairman of the Democratic Caucus announced his intention to resign from Congress to assume a new position. The CAO and [sergeant-at-arms] worked with the Chairman to account for his inventory, including the one server.
• While reviewing the inventory, the CAO discovered that the serial number of the server did not match that of the one imaged in September. [Investigators] also discovered that the server in question [the replacement server] was still operating under the employee’s control, contrary to the explicit instructions of the former chairman to turn over all equipment and fully cooperate with the inquiry and investigation. [A House source said the “employee” was Abid Awan.]
• The USCP interviewed relevant staff regarding the missing server.
• On January 24, 2017, the CAO acquired the [replacement] server from the control of the employees and transferred that server to the USCP.

Except for what has been previously reported by the capital police and others. You're right. If this doesn't show that we are a banana republic then nothing will. People know damn well that they should have been charged for high crimes against the government of the USA, but they weren't.

Those House communications will also include notes and e-mails between Republicans and Democrats who are working behind the scenes to get certain outcomes in legislation -- outcomes that infuriate us. Republicans don't want the public seeing them work with Dems, and vice versa. In the end, the enemy in DC is us, the public, and anyone hoping to rise in the DC Beltway hierarchy is equally desperate not to give any of us plebes any legal or ethical or even just PR ammunition against them.

It's really the perfect crime.

I believe that Imran Awan is tied to the CIA. How else can they explain away everything shadowy about him and his clan. Awan exported terabits of information out of the House to who knows where.

Snoopydawg told me a while back that there was a deal already made in which Imran Awan would walk. I was not ready to give up on hope for justice back then. I am now ready to give up all hope...period. This freaking reeks of the immunity deals given the Hillary and everyone within her sphere so that no one would be charged.

We the people are paying for this charade of a "government." I am so fed up with it all, I could spit nails right now. And it takes a lot to get me really pissed off, but I am right now. Raggedy Ann is right. Revolution may be the only solution and it probably is already way to late for that to work anyway. We are so screwed. Bad

O’Connor’s greatest sin, of course, was as the swing vote in Bush v. Gore, the judicial coup that handed the 2000 election to George W. Bush and Dick Cheney. It was also widely reported that on election night at a dinner party “Sandra Day O’Connor became upset when the media initially announced that Gore had won Florida, her husband explaining that they would have to wait another four years before retiring to Arizona.” (More on that here.)

Like “swing vote” Justice Sandra Day O’Connor before him, “swing vote” justice Anthony Kennedy has been one of the worst Supreme Court jurists of the modern era.

With swing-vote status comes great responsibility, and in the most consequential — and wrongly decided — cases of this generation, O’Connor and Kennedy were the Court’s key enablers. They cast the deciding vote that made each decision possible kept alive the illusion of the Court’s non-partisan legitimacy
Each of these points is critical in evaluating the modern Supreme Court. For two generations, it has made decisions that changed the constitution for the worse. (Small “c” on constitution to indicate the original written document, plus its amendments, plus the sum of all unwritten agreements and court decisions that determine how those documents are to be interpreted).

What will be Kennedy's legacy? His votes during his time on the court or that he retired so that Trump could choose his replacement? I'm going with the latter. He voted for things that would benefit we the people when they didn't have any effect on the way the corporations run the country. Gay rights? Meh. Unlimited campaign donations and gutting unions? Hell yes because that is what the PTB wanted.

But in the main he has been horrible, a record of ideological and indefensible votes capped by his landmark decision in the Citizens United case. Enough has been written about that to make repetition here unnecessary. As noted, Kennedy not only provided the crucial “swing vote,” he also wrote the majority opinion, which in essence, reduced the broad and complex sweep of both public corruption and the appearance of corruption only to provable, documented, evidence-based quid pro quo exchanges. This is beyond naïve and touches itself the broader meaning of corrupt.

If justice exists in the world, his legacy will be this: First, in giving to Donald Trump the ability to hand a person of relative youth the fifth and deciding Republican vote on the Court, Kennedy has changed the Court for a generation. After his successor is confirmed, no good thing will come from the Court for the next 20 years, and much, perhaps fatal, damage will be done.

Second, thanks to Kennedy’s handing his seat to Trump, the next new justice will be unable to claim the propagandistic “swing vote” mantle held by O’Connor and Kennedy, which fact should destroy the Court’s perceived, illusory legitimacy forever. The full consequences of loss of legitimacy will be considered elsewhere, but suffice it to say that when a nation’s highest court is not just captured, but widely seen to be captured, a constitutional crisis is at hand.

Why did O'Connor vote to give Bush the presidency?

O’Connor’s greatest sin, of course, was as the swing vote in Bush v. Gore, the judicial coup that handed the 2000 election to George W. Bush and Dick Cheney. for revolution - it's a matter of timing, of reaching that tipping point. Look what's happening in Poland. It will take a lot for it to come about in America, but the people are rumbling - look at the demonstrations last weekend as an example. People are beginning to take notice that all is not well in America. We really DO have to be grateful for the Herr Drumpf presidency. Her Heinous would have kept the mask on for another generation.

Bernie Sanders will go down in history for awakening this sleeping giant. He gave voice to what has been ailing us. The rest is up to us.
