Monopolies Kill People
I get to write about this one because TMC doesn't think the headline is strong enough. While we are not prudes here, her proposal would make a sailor blush and I'm not sure how to transcribe the scream of rage that punctuates the end.
Also I have EpiPens, at her suggestion. I have a pretty serious allergy to Bell Peppers, Red, Yellow, Green, and otherwise. I happened to tell her the story of how I was DJing at one of my club's social functions and they served Potatoes O'Brien. What makes them O'Brien and not just greasy chunks of crunchy fried potato is that they add some diced Red and Green Bell Peppers. The entree was 2 paper thin slices of Roast Beef smothered in gravy to disguise the fact that it was mostly gristle and fat and the sides were an over boiled Broccoli/Cauliflower medly and the aforementioned Potatoes O'Brien.
I worked through lunch (I had other duties you know) and I was starving. Even though I knew it was probably a bad idea I scraped off the Peppers and ate the potatoes.
Soon enough I had a raging headache and my partner said, "ek, you don't look so good. Your face is as red as a radish. You'd better lie down for a while." So I did. I passed out for about 3 hours and when I woke up I didn't feel great but I could function. My poor friend had been single handing it the whole time which is not as easy as it sounds so I helped him finish up and break down the system.
Well, in retrospect, to me it seemed funny which is why I tell the story but TMC had an entirely different reaction. She asked, "Were you wheezing?" A little I guess. "Next time you see your Doctor get a prescription for an EpiPen. You were in anaphalactic shock and you're lucky to be alive."
So I did. Since then, though I am very careful, she's had the opportunity to see me burst into hives just from getting near the stuff and never misses the chance to give me that, "I told you so" look though she's far too polite to say it. Instead she says, "Do you have your Benadryl? Take two."
I'm happy that I've never had to use the Pens because they're very, very expensive even though I got mine before the latest round of price increases (I think it was around $250 or so).
Well, just what makes them so expensive? The research was entirely subsidized by the National Institutes of Health which is a branch of the U.S. government. They own the Patents on the delivery system (the Pen part which is also used for other drugs like Insulin and was purchased by the DoD to administer an antidote for Nerve Gas) except for the safety cap on the needle. It costs (generously) $2 to produce. Epinephrine itself has been synthesized for over 100 years, has no remaining Patent protection and costs $1 a dose.
Monopoly power.
In 2012 Mylan was forced to accept a consent decree allowing for a generic alternative to be marketed because of their 98% market share. Pharmaceutical companies, when faced with the imminent arrival of generic competition, frequently raise prices to milk the last few bucks out of their monopoly.
So what happened to the generic alternative? Teva, an Israeli company, was unexpectedly rejected by the Food and Drug Administration. Why? Probably because they couldn't afford the independent (but entirely redundant) testing required for their product. Auvi-Q, a competitor from Sanofi, was pulled from the market last year because of dosing problems.
Now there are other sordid aspects to this story. The CEO of Mylan, Heather Bresch, is the daughter of Senator Joe Manchin, Democrat of West Virginia. She successfully lobbied for the 2003 Medicare prescription drug bill, which barred the federal government from bargaining with drug companies over prices. In 2012 she lobbied for the Generic Drug User Fee Act which made it more difficult for foreign drugmakers to sell their products in the United States. Then in 2013 she was able to prioritize grant money for schools to stock EpiPens under a restrictive contract that did not allow competing products to be used. In her home State of West Virginia EpiPens are mandated in every school, no doubt helped by the fact that her Mother, Gayle Manchin, was head of the State Board of Education.
Also among her proud accomplishments (besides raising the price of EpiPens 450%) is raising her own salary by $16 Million to $19 Million annually AND guiding Mylan through a corporate inversion to avoid paying its fair share of United States taxes.
What an amazingly accomplished businesswoman, except of course, she's not.
She's lowered shareholder value by $3 Billion (12.4%).
She freely admits she only got the the job because of her Father. She didn't even know what the company did. She claims to have an MBA from West Virginia University but only finished 22 of 48 hours of required course work. In 1999 she was given a degree (later rescinded) after being given passing grades in two courses that were "incomplete" and having the University give her credit for 6 classes she never attended. This bit of academic legerdemain was signed off on by R. Stephen Sears, the Dean of West Virginia University's Milan Puskar Business School, on October 22, 2007. Milan Puskar was Heather Bresch's boss at Mylan and West Virginia University's biggest donor including a $20 million endowment in 2003. As a result of the "situation" (as she calls it) the School President and 2 other officials were forced to resign.
In Ms. Bresch's defense she herself says, "Everybody does it. It's standard practice. At least we 'increased anaphylaxis awareness'."
And they've lowered prices- not. Co-pay discount cards are a well known 'Pharma Bro' scam. They only cover co-pays, not the overall price of the drug. Insurance Companies, Institutions (Schools for instance) and the Government (if you happen to be on Medicare or Medicaid) get gouged the full price. Likewise those with high deductibles if they haven't already reached their threshold.
At least 3 Senators are calling for Bresch to face a Congressional Hearing and frankly I think Joe Manchin should face a full fledged corruption and bribery investigation because if this is not quid pro quo then such an animal is as imaginary as a Jackalope.

Joe Manchin have a true "Odd Couple" friendship. They are BFFs, so maybe it shouldn't be surprising that Schumer has scored big from Mylan and Joe Manchin's daughter.)

You see it takes 19 million dollars annually to incentivize someone to sell epi pens and run a company. If you don't get 19 million, I mean seriously who is going to bother ? And yeah, while the NIH may have invented the epi pen, who is going to manufacture,market and distribute a $10 item if you can't mark it up 7, 8 or 9000% ? And frankly, I think you are just jealous that a no talent zero like Bresch can cash her lottery ticket every day, while you work your ass off.

They were only able to sell those items for $10.00 because the taxpayers were forced to subsidize the cost by providing Walmart's underpaid employees with food stamps and housing subsidies. If Walmart had to pay their employees a living wage that didn't require government assistance, they might have to sell those items for $10.25. And that might have eaten into their profit and monopoly power.
I really wonder what it is that will finally bring the average US citizen into the streets and demanding an end to unregulated corporate greed. I'm now over 60 years old and I'm not sure if there is anything a corporation or industry could do that would truly make the American public full out demand change. I'm no longer sure the American public is even capable of revolt.

We paid to develop the epi, and we pay the cost for people who can't afford it with Medicare, Medicaid and the new gift horse, ObamaCare. Your premiums go up every time the cost of your drugs go up. Make no mistake, WE are the ones paying for ALL OF IT. We need to nationalize health care and parts of the banking industry.
I still want to know if we can break deals with TPP and NAFTA legally or otherwise. I just can't feature what in the hell it will take for the people in this country to at least quit voting for the two corporate parties. No protest, no pepper spray, no arrest - just quit voting for the crooks.

There are some things that should absolutely be done solely for the benefit of the citizens of our country. Life saving drugs should be at the very top of the list. No one should be able to profit off the lives of the very people who depend on life saving technologies, particularly when they were the ones who paid to develop them. What these companies are doing is criminal. An Epipen should cost about $10. And even at $10, it would be overpriced. Big Pharma has a racket even bigger than loan sharks and pay day lenders.

The weakness of these "trade' deals is that they are not treaties and the government can leave or even ignore them.
The first trade deal was with England in the 1790s and it was a treaty as specified in the Constitution. The modern trade agreement should be treaties but they are not.

off topic question: what is the reason why
gasoline prices at gas stations vary a lot since a couple of years. I remember (but don't know when it started to change) that gas prices at gas stations didn't vary much, 3 cents the most. I think that was in the eighties.
Today I can see prices vary from location and by the oil companies (ie BP, Exxon etc) up to 40 to 50 cents.
Why is that and what caused it?

Now we have everyone pumping as fast as they can to replace lost revenue.
Sometimes that shows up at the Gas Station, for good or ill.
Gas Station Owners operate on margins as low as 1.5% on their Gasoline products and supplement through repair businesses and Convenience Stores.

And we have local ridiculous price wars between gas stations. Even a year ago, there were daily spot market prices in the local paper about where gas was cheapest. Gone now, since it's hovering around (locally) $2.50/gal. In NY with high gas taxes.

I remember! We'd sit in the car, Dad would roll the window
down to tell the nice service man what he wanted (Dad always drove and they always asked the man), while they pumped your gas they checked under the hood, let you know if you needed your oil topped off or what have you.
Then later they had a choice of "full service" and "self service" lanes and you paid a little less for self service. I guess everyone liked that better, or at least would use either, since they don't have service men any more.

I never knew how to pump gas until we retired and moved to AZ. Even living in Philly l always got gas across the bridge because it was cheaper as well as the service. I worked in NJ so it was no big deal. Also always bought beer and wine in NJ because of way better selection and prices. PA system is from the Dark Ages.

I live in as assisted living facility. It is
part of a chain of places where they send people with medicaid who cannot live by themselves. It is in the classic sense a monopoly. You send these people to an outfit, and the outfit picks the location themselves. There is nobody else to send people too. My doctor who retired pointed that out to me.
The guy living next to me gets around in a wheelchair. He used to have an electric chair to get him around, but he has $40 a month to live in, and he can't afford to replace the battery that died. The single chair he was given to sit in broke some time ago, so he no longer has a usable chair in his room. He sits in bed most of the day.
The people who work here work 12 hour shifts that keep them busy all day long. They only work 3 days a week, so they aren't full time. They make slightly better than minimum wage with no real benefits. Every month or two, all the employees get shuffled from one place to another, so we really never get to know any of the employees.
We live so far out of town, that it makes it impossible for the residents to have any social life at all. The people who live here are alienated and sick. The doctor who comes here makes decision based on speaking to you for a total of 5 minutes, and she doesn't seem to have time to look at your chart.
These people will die much younger then they should have. I think its because of the food more than anything else. They don't feed them enough, and some of its unhealthy. Some days they serve bratwurst to senior citizens.

There are assisted living
facilities for the rich, and then there are assisted living facilities for people like me. The quality of care is a little different.
This is unconscionable.
Sadly it is just another symptom of the total failure of our system which is in no way healthcare. Seniors and the disabled without family who can support them need to be integrated into the community and given a way to gain dignity by helping with tasks they can do... if they choose to. Isolation, disrespect (for the workers as well) and poor nutrition add up to what Grayson dubbed the Republican plan for care...if you get sick, die quickly. I am glad you are able to get away a bit by coming here, ME.

I have such a hard time wrapping my head around the utter lack of empathy one must have to make decisions like these, knowing that people will die as a result. But I admit I'm particularly angry about this particular instance, because it's personal for me. Our smart, kind, funny, wonderful 19-year-old son has an EpiPen for his walnut allergy. He leaves for college today. Fortunately the only time he's needed epinephrine was at the allergist's office, to end a failed challenge; fortunately it's much easier to avoid walnuts than some other allergens; fortunately we have pretty good insurance. But I will never not worry about him. I'm thinking about the many parents who can't afford to keep up with the price increases, and the terror that they must feel. As I said, I'm angry.

anaphylactic shock symptoms from a sting and had done two Epipens at home, ambulance gave her another two. Her heart must have been rolling, my guess is the recovery from 4-bolus epinephrine shocks. Patient will recover.

Will the corporate overlords bother even faking elections after taking over domestic law via private traitors agreements which supposedly 'legally' wash out all existing democracy, law and constitutions (which protect against any such lunatic nonsense as this being purportedly 'legalized' by 'Simon Says' betrayals by public servants) to suit the ruthless self-interests involved?
Why would they give any chance of escape and freedom to the once-free people of Earth they've finally captured in this manner, to do with as they will, without any protections to be permitted them or the environment on which all life depends? Why are we assuming there will be a 'next chance' when anyone currently running or likely to be parachuted in will pass and enforce the corporate coups into 'Simon Says' unconstitutional 'law', to be backed by civil and military forces?
Edit: they're counting on the endlessly repeated 'this time, it's too late and must be left to stand, next time it will be fixed' holding yet again, so that it will be too late for any 'next time'. And this will almost certainly (I'd say certainly) be our last chance for peaceful political change.

I filed a lawsuit pro bono a couple of weeks ago
that modified the divorced parents' requirement to provide health insurance and to mandate they enroll their 7 yr old in the Medicaid program.
His allergic reactions require 2 epipen doses to keep him alive. 2 at his mom's, 2 at his dad's, 2 at school. Both parents work. Dad has no employer insurance, mom has it, but it doesn't pay for epipens.
It had to be done on an emergency basis. They couldn't enroll him in school unless they provided the school nurse 2 epipens.
How fucked up is that?

It would be due to the likelihood of higher "contributions" for doing the corporate business!
Who cares if the EpiPen is financially too expensive for the likes of my son, who is struggling to pay the fees associated with his dying Covered California Obamacare? His coverage won't pay for an EpiPen. It's too expensive. Yet Heather Manchin Bresch, Mylan's CEO and daughter of Blue Dog Senator Joe Manchin of Worst Virginia, deserved a raise in her total compensation from over $2 million to over $18 million for being an astute businesswoman and increasing the profits of Mylan at the expense of the public health. How else can she keep up with Martin Shkreli??? Body count is far too messy when total compensation dollars can be used!
Only fools still don't see that Barry will prove to be one of the worst American presidents ever. As I see it, only Reagan, Dubya, and Buchanan will be rated lower. He coulda been a contendah for the greatest president since FDR (at least), but instead he took a dive. read about the Epipens on any site anywhere including all the MSM. You covered the background of the CEO and the research on the medication and what a ginormous screwing it is at every level.
