Man snuffs child he believes to be possed by Jesus

Am I the only one who has never seen such a headline? (Excluding religious wars and religious warfare, of course.) I'm pretty sure that shit just doesn't happen, at least in the US. Yet, just the other day, yet again some religionist snuffed some kid for being possessed by demons.

It isn't like this shit happens really often, but it happens far too often. In addition to outright intentional Murder there are so-called accidental deaths during the course of exorcisms, or among some who eschew such language, attempts to "beat it out of 'em" or, more broadly "to drive it out of 'em".

While I suspect that very few would hold this act to be protected by the First Amendment, I suspect that that the percentage would jump significantly in a case of mere accidental injury, mental distress or psychological trauma due to an organized exorcism, especially if it were putatively consensual. The prosecutors and courts certainly seem to take a different approach to the latter. Yet, these are all hate crimes.

I would like to propose separate pinpoint legislation (a so-called rifle shot provision) to subject all cases to not only the strongest possible charge given the facts, but to treat them all as hate crimes. Intentional killing is murder. "Accidental" killing during an action that a reasonable person should realize carries the risk of death to the victim is murder two or at least three. Injuries are clearly assault, battery and mayhem. There should be no reduction for diminished capacity or insanity because we do not treat these belief systems as a form of insanity, but instead give them the greatest possible deference whenever and wherever possible.

Furthermore, they all should have hate crime enhancements because in every case the perpetrator is attacking the victim for religious reasons, because of some perceived difference or inadequacy in the victim's religion, and hence, solely because of the victim's religion.

Lastly, in all cases of alleged consensual rituals, undue influence should be a presumption (rebuttalbe by facts of course) overruling the reality of such alleged consent.
