DNC lawsuit dismissed with prejudice - updated

Judge Koeltl, a Clinton appointee, cited the Pentagon Papers case in finding that there could not be liability for the publication of stolen materials.

Judge Tosses 'Meritless' DNC Lawsuit Against Trump, Russia, Assange, WikiLeaks And The Kitchen Sink

Defendants included the Russian Federation, the Trump Campaign, Donald Trump Jr., Paul Manafort, Jared Kushner, George Papadopoulos, Richard Gates, Roger Stone, Joseph Mifsud, WikiLeaks, Julian Assange and several Russians.

In his Tuesday afternoon order, judge John G. Koeltl of the Southern District of New York ruled that the DNC's 14 claims against the defendants were "either moot or without merit."

Among other things:

The DNC's RICO conspiracy claim was tossed for failing to prove an alleged pattern of racketeering activity.
The DNC's claims against the Russian Federation were barred, with Judge Koeltl ruling that "Relief from the alleged activities of the Russian Federation should be sought from the political branches of the Government and not from the courts."
The DNC's allegation that the defendants distributed hacked materials under the Wiretap Act was dismissed.
The DNC failed to state a claim for trade secret misappropriation pertaining to documents published by WikiLeaks
The DNC's "claims for conspiracy to commit trespass to chattels" was dismissed, as they had "not alleged plausibly that any of the other defendants participated in the theft or agreed to help steal the DNC's materials."

Discovery would have been interesting.

The DNC would have had to prove its allegations that Russia hacked its computer and gave the hacked information to Wikileaks. Depending on the integrity of the judge, it could have been "put up or shut up" time.

I've never understood why people say that Russia cost her the election when she got so many more votes than Trump did. People love to say that she won because she did and yet... How does this work in their minds?

as “winning the popular vote”. It’s a meaningless phrase. An accurate statement would be she “got a plurality of the popular vote.” Which also highlights that it was not a majority.

i reckon i've hit epic cynicism by now, but i'd hate to think of the odds stacked against him in terms of 'having hope'. and i won't bring the gif of the sword of damocles to your thread.

meanwhile, chelsea still languishes in prison, fined some exorbitant figure every day she refuses to testify to the GJ. may they both walk in spiritual beauty as they're able...

cuz of the decision the court made regarding Wikileaks publishing the DNC info and tying it to the Pentagon Paper.

And yeah I know that Chelsea is still in prison. I tweet about that daily. Anything that might help them is good in my book. Epic cynicism? I would think that you know where I stand on both Julian and Chelsea.

on edit: i should have taken the time to note that comments are for other readers as well. but i jammed with RL 'must do's' today. but i should have added that i'd seen the news at RT and hadn't even added it to my 'the US, sweden and and US respond to Nils Melzer’s accusations of torture' (of julian), given how they'd responded, and that neither ecuador nor the UK actually answered, save silence, except in a tweet i'd put in from jeremy hunt, UK foreign minister.

but then that diary drew one lone comment, which was a tad sad to me, even past the dark blues of the contents of the OP and tweets. that's all.

and yes, there are solidarity vigils in the UK in august, and the SEP members have been holding rallies around the world. what good will they do or have they done? or assange t-shirts in parliament? so far...none.
