Advocates ask for injunction to be expanded

At the end of last week a US District Judge Thomas Schroeder issued a preliminary injunction that says two students and an employee at University of North Carolina campuses must be allowed to use restrooms matching their gender identity.

Civil rights and legal groups are appealing the ruling's narrowness. Lambda Legal, the ACLU of North Carolina, and the law firm Jenner & Block announced yesterday that they had filed notice of appeal with the 4th Circuit Court of Appeals in an attempt to have the injunction apply to all transgender people in North Carolina.

We are thrilled that H.B. 2 is starting to crumble and relieved for our clients who have had a huge burden lifted as a result of the court’s Friday ruling. But we know the harmful effects of H.B. 2 are far reaching, and that is why we are seeking broader relief for the thousands of transgender people who call North Carolina home.

--Chris Brook, ACLU of North Carolina

Though the district court importantly recognized the serious harm to three of our clients as a result of H.B. 2, that recognition unfortunately didn’t extend to a ruling rectifying those harms for other transgender individuals in North Carolina.

We are optimistic that H.B. 2’s days are numbered and are appealing Friday’s ruling in order to bring relief to all those who live in or visit North Carolina.

--Tara Borelli, Lambda Legal

Judge Schroeder's final decision is expected in November.

That, in its essence, is fascism--ownership of government by an individual, by a group, or by any other controlling private power. -- Franklin D. Roosevelt --

Well, I hope that this ruling presages a favorable official ruling later that can be expanded to all applicable persons, but it certainly is disappointingly narrow now.
