Anyone here from Florida, can you help us out with backstory here? I am sure there must be one. Apparently the family have been growing their front yard vegetables for about 2 decades. The HOA voted to ban front yard veges in 2013. I thought what I could see of the garden in the pix looked very nice. Mine (back yard) should look so good.

BTW, the family are a mixed race couple. I am sure the NAACP and other civil rights orgs. will be stepping right up to help them out. Right. Sure.

A Republican member of the Florida legislature has introduced legislation to make such bans on home vegetable growing illegal in Florida. Please note that the Florida Demonrats are MIA here.

where this couple lives. The voters will have to get involved, not just the courts. I live in downtown Orlando. I have sustenance gardens across the street (neighbors), and a 5-10 minute walk from my house. The latter is larger and grown on public property. They grow veggies, fruits, and herbs. They are neatly maintained and not eyesores. They aren't hassled by zoning. Thanks for the report. Rec'd!!

Miami Shores Village is an incorporated (1932) community in Florida and has a council/manager form of government with five members elected to the city council. The demographic makeup of Miami Shores is 42% non-Hispanic white, 23.8% black, and 30.6 % Hispanic of any race. That means that Miami Shores has a greater percentage of black and Hispanics than the state of Florida overall. For this reason, I doubt that race was a driving factor in the decision of the city council.

While I disagree with the city council's decision to prohibit the growing of vegetables in the front yards of people residing within its corporate limits, I suspect that the reason that the Florida Supreme Court may have refused to hear the argument may be due to the fact that Florida is home rule state.

The latitude of authority granted to local governments varies by state. In some states, known as home rule states, an article or amendment to the state constitution grants cities, municipalities, and/or counties the ability to pass laws to govern themselves as they see fit (so long as they obey the state and federal constitutions).

I hope the bill submitted to the legislature will pass, but knowing the Florida legislature, I would be surprised. The Democratic party in Florida is worthless.

BTW, it was not a HOA (homeowners association) that banned the vegetable gardens. Miami Shores Village is an incorporated community in Florida.

@gulfgal98 I didn't suppose race was a driving factor either, but I still wonder where are the SJWs when you need them?

I hope the bill in the FL legislature won't turn to be not constitutional according to the FL constitution.
